1) The patient has the right to demand that all information,

communication and records pertaining to his care be treated as


confidential. Any health care provider or practitioner involved in the
treatment of a patient and all those who have legitimate access to the
patient's record is not authorized to divulge any information to a third
party who has no concern with the care and welfare of the patient
without his consent, except:

a. When such disclosure will benefit public health and safety;


b. When it is in the interest of justice and upon the order of a
competent court; and
c. When the patients waives in writing the confidential nature of
such information;
d. When it is needed for continued medical treatment or
advancement medical science subject to de-identification of
patient and shared medical confidentiality for those who have
access to the information.

2) A shall be liable for qualified trespass to dwelling. Although the act


done by A against B constitutes an impossible crime, it is the principle of
criminal law that the offender shall be punished for an impossible crime
only when his act cannot be punished under some other provision of the
Revised Penal Code.

elements of medical malpractice are: (1) duty; (2) breach; (3) injury; and
(4) proximate causation. Once a physician-patient relationship is
established, the legal duty of care follows. The doctor accordingly
becomes duty-bound to use at least the same standard of care that a
reasonably competent doctor would use to treat a medical condition
under similar circumstances. In the present case, there is a breach of duty
because the psychiatrist failed to comply with, or improperly performed
his duties under professional standards since he did not follow the usual
psychotherapy techniques intended to treat his patient.

committed by the mother and the nurse acts as an accessory to abortion
thus may be also held liable.
9) The act of faith healing in the Philippines is allowed. If a person acted in
pursuance of his religious belief and the act is in accordance with the
tenets of the church he professes, then his act is not deemed to be a
practice of medicine but a part of his religious freedom.
