A BILL TO: Remove a Representative from the General Assembly
THE ASSOCIATED STUDENTS OF MICHIGAN STATE UNIVERSITY ENACT:
WHEREAS, The ASMSU Code of Operations Appendix III Title I Section 3
states that “Representations made on behalf of ASMSU are to be neither
misleading, incorrect, nor inherently false, and are to reflect organizational policy
and opinion”, and

WHEREAS, The ASMSU Code of Operations Appendix III Title II Section 1A


states that “All officers, representatives and staff must consult with the Director of
Public Relations before making any statements on behalf of ASMSU”, and,

WHEREAS, The ASMSU Code of Operations Appendix III Title III Section 2
states that “ASMSU shall at no time engage in any unlawful discriminatory act or
practice against persons on the basis of age, color, creed, gender, marital status,
national origin, physical characteristics, political persuasion, religion, sexual
orientation, gender identity and veteran status. If any compensated employee,
elected representative, or volunteer engages in any such behavior, they will be
subject to appropriate disciplinary action”, and

WHEREAS, The ASMSU Code of Operations Title I Section 3 states that


“Inappropriate Acts shall be those actions that involve violations of the
Constitution, any relevant Code of Operations, financial misallocations, or direct
violations of ASMSU organization wide internal policy as specified in the
Constitution” and Title XII Section 1 states that “Non-compliance of a provision
of this Code or action of the General Assembly, by any organization or individual,
shall be considered a violation.”, and

WHEREAS, The Preamble to the ASMSU Elections Code states “ASMSU


prides itself on being a body that represents all of the undergraduate students of
MSU and is not affected by political persuasion. ASMSU does not endorse the
use of political slates or unauthorized political endorsements in its election
process”, and

WHEREAS, The Michigan State University General Student Regulations Section


3.04 states that no student shall “represent a group falsely or use the resources of a
group without proper authorization”, and
WHEREAS, General Assembly Representative Sergei Kelley has engaged in a
coordinated effort, openly using his position as a Representative, to recruit
candidates of a particular political persuasion for the General Assembly, and

WHEREAS, Communications regarding this effort include the official ASMSU


logo and specifically cite the ASMSU General Assembly as the target for these
actions, and

WHEREAS, These communications constitute representations made on behalf


of ASMSU without the consultation of appropriate parties, and serve to mislead
students into believing these actions are official ASMSU activities, but were only
distributed to students belonging to groups representing specific political
persuasions, violating the clauses of the ASMSU Constitution, Code of
Operations, and MSU General Student Regulations cited above, and

WHEREAS, Representative Kelley has made multiple other efforts to


misrepresent ASMSU and violate the Constitution and Code of Operations, such
as seeking and obtaining financial contributions for a personal initiative while
misrepresenting it as an ASMSU initiative, constituting a repeated pattern of bad-
faith efforts misusing the position as Representative to accomplish personal goals
without the consent or approval of the General Assembly, and

WHEREAS, The ASMSU Constitution, Article II, Section 9J states that the
General Assembly shall “Exercise those powers not specified nor prohibited in
this Constitution that are necessary to carry out the duties of the General
Assembly”, and

WHEREAS, As no set disciplinary action exists for General Assembly


Representatives, it is under the purview of the General Assembly to take actions
in the best interest of the Organization and General Assembly, therefore be it

RESOLVED, The General Assembly of the Associated Students of Michigan State


University votes to remove Sergei Kelley as a Representative of the
College of Agriculture and Natural Resources, effective immediately.
