Hon'ble [t. Governor Dr. Kiran Bedi ji,

From the day your good self assumed office in the Raj Nivas, Puducherry as
Hon'ble Lt. Governor, Vour actions have been in violation of the democratic ethos and a
clear disrespect for the elected Representatives, which I have been trying to bring to your
goodself knowledge and also I have been advising your goodself to change your goodself
for the good governance of Puducherry. But again and again your act of commissions and
omissions have become detrimental to the peace, progress and good governance of
Puducherry.

1. Your goodself have completely disregarded the Cabinet decision on AFT and
Swadeshi Barathi mills. After detailed deliberations, especially taking into
consideration of the welfare of the workers, the Cabinet decided to (i)
lmplement VRS scheme for employees as it was done in 2013 and (ii) run the
viable units with their own resources in order to have a healthy employment
opportunities for the youth of Puducherry. But your goodself have directed suo-
moto closure of AFT Mill ignoring the welfare of the employees and forgetting
the basic fundamentals that Sovernment should be a model principal employer
to be an example for other such sick industries. Also your goodself action is in
comolete violation of provisions of Rules of Business of Government of
Puducherry. (which you are also well aware).

2. Ministrv of Home Affairs (MHA) has recently directed for redelegating the
financial powers of the Hon'ble Lt. Governor for good governance. But you have
completely ignored the directions of MHA by misquoting and misinterpreting the
prevalent rules for your advantage with the only aim of having HLG's
misgovernance in Puducherry.(You are well aware of your own misinterpretation
and misgovernance)

3. My office through official and non official mode has been requesting you to fill
up of the cadre post of Secretary to LG, so that you may have a good advisor and
bring a positive energy in your office. But your goodself are more interested to
run your office with a retired Consultant, who is well known that his deeds will
not make him accountable 'has been advising you by misquoting and
misinterpreting the rules. Also he is holding an illegal designation, in violation of
MHA directives. (Which is one your violations).

1 It has become a habit for your goodself to lssue directions to department

officers (HoDs/HoOs) directly from Raj Nivas without the knowledge of the
Ministers concerned. Your goodself is well aware that the Rules of business has
clearly spelt that Ministers concerned are responsible for the disposal of
business pertaining to their respective departments. But no where your goodself
is ready to follow/read the rule of this land and you act as if the Rules of
Business of Government of Puducherry, 1963 is not applicable to your goodself.

5. Inspections/da ily visits clearly falls under

the ambit of the department business
under the Rules of Business, which is to be carried out only with the knowledge
of Minister in charge. I have been emphasising this since your goodself assumed
the office. But for the sake of your goodself social media publicity your goodself
have made it as a habit to do field inspections( with five cameras surrounded
your goodself) and shout at officers and show your "l know everything attitude"
and direct officials to prepare irrelevant policies, plans, SOPs, etc... All such
actions are also live streamed by you to show officers in bad light and your
goodself as a Messiah of media governance. Such fake actions of yours has
created a cadre of frustrated officers who have lost their motivation to work.

6. Conducting one-to-one Department review meetings with Secretaries and

Directors which doesn't fall under the domain of Hon'ble LG business actions as
per the Rules of Business.

7. Calling files directly to Raj Nivas with oral directions and not following due office
p rocedu res for summoning files.

8. Free Rice Scheme is a novel scheme which is a first step in achieving legal
obligation of Food Security and stopping hunger deaths. lt is because of this
policy that Puducherry is highly ranked in the NlTl Aayog SDG lndex. But your
goodself have in an unilateral and insensitive manner stopped the 'free rice
scheme' and changed it into direct transfer scheme, in violation to the scheme
guidelines. Also it has become a habit for your goodself to unilaterally tweak the
scheme implementation without following any aid and advice of the cabinet.

9. It is well known that Pongal is a festival where every household of Tamilians

celebrate with Sweet pongal and share their happiness with fellow Tamilians.
To have a good and shared happiness, Government of Puducherry and
neighbouring Tamilnadu are providing Pongal gifts 'in kind' for last many years.
But your goodself being an outsider and not understanding the shared
happiness has wrongly interpreted the scheme and has unilaterally stopped the
scheme without understanding the culture of the land.

L0' Also your goodself have invented a new practice of sending files directly down
to the officers from LG office bypassing Chief Minister & Ministers and also
forcing/threaten ing the officers to implement Hon,ble Lt. Governor notings
without the knowledge of Chief Minister & Ministers, which is a violation of the
prevalent practice and Standing orders / Rules.

11. lt is also known any awards/certificate given in Government need to have some
basis because of the value such awards/certificate gets in the Society. But your
goodself have invented your own awa rds/certificate without any basis, which
will create unnecessary confusion in the governance system.

12. Suo-moto tests to government officers/ officials are conducted by your office
without any legal basis. Also such irrelevant tests are used as a publicity tool by
your goodself to claim that "l know everything" and it is also used to name &
shame officials creating a frustrated league of officers.

13. lt has become an open & transparent habit for your goodself to threaten
officers, that their careers will be spoiled if they don't toe the line of Hon'ble Lt.
Governor.

14. Excessive use of social media in governance and day-to-day interventions

through social media in complete violations of office procedures. Forcing official
to give official replies in social media.

15. Not following established administrative procedures / orders in accessing

private funds for government works.

16. Introducing a new 'block sanction system' for sanction of funds under schemes
thereby causing inordinate delays in execution of works.

17. Running Raj Nivas with too many officials posted on 'placement duty' basis from
many other departments, over and above the sanctioned strength in Raj Nivas
for self promotion.

18. Running a parallel grievance redressal system virtually replacing the existing
government mechanism.

19. Troubling the officials frequently on holidays and compelling them to come for
visits on week-ends.

20. Blocking release ofCentral funds received in Government of Puducherry.

2L. Blocking the release of ?L36 Crore funds by Water Resources Ministry of
Government of India for Yanam flood bank work. With this our Government has
lost L00% Grant from the Government of India.

22. Writing letters and talking over telephone to Government of India Ministers and
Secretaries for stopping release of Central funds and Grants to puducherrv.

23. Ordering for vigilance enquiries suo-moto without getting any feedback or
reports from the departments concerned and without the knowledge of the
M in isters.

24. Interfering in the works of Police department in a daily basis and giving suo-
moto directions upto Police Station levels.

25. Delaying the reply to be sent to MHA regarding transfer of land back to PIPDIC
in Sedarapet. Industrial promotion activities are held up in Puducherry because
of the disruptive stand of Hon'ble Lt. Governor.

26. Inspections and unilateral sealing of commercial buildings without following any
due process of law.

27. Forcing Government departments to prepare various 'Policies' and stipulating

time-lines without the knowledge of the Ministers concerned.

28. Hon'ble Lt. Governor conducting herself as if there is no elected Government in

Puducherry and there is only a'Governor's rule'.

29. Hon'ble Lt. Governor Launching various schemes such as 'Puducherry Water
Mission' etc., suo-moto, from Raj Nivas without proper approvals (Cabinet,
Finance, etc), administrative orders and fund allocation.

30. Visiting Government of India offices in Delhi and pleading to take action against
Ministers and officers, unilaterally without following any due process of law.

31. Jumping to conclusions on issues without due process of discussions in the

ad min istrative h iera rchv.

32. Self-promotion in Raj Nivas at the cost of Government exchequer (release of

daily videos, etc through 'Raj Nivas Productions'- purportedly a media company
is Raj Nivas).

33. Obtaining the services of private companies and individuals (who have business
interests in Puducherry) by Raj Nivas for various social works in an unstructured
manner and organising such functions in Raj Nivas. There were occasions when
companies and people who are at odds with the government have found their
ways to Raj Nivas.

34. Stopped or adopted dilatory tactics for distribution of flood relief victims in
Yanam region, despite Cabinet decision.

35. Affectin8 the youth of Puducherry, in the matter of recruitment of police, the
matter has been delayed, despite repeated decision of Chief Minister to relax

36. Recruitment of teachers was also delayed because of your goodself

intervention.

In summary, I would like to point out that there are clear provisions in the
Constitution of India, Union Territories Act, Rules of Business of Government of
Puducherry which are being subverted by your goodself, disregarding the elected
Government, overruling the decisions of Cabinet / Chief Minister / Ministers, thereby not
allowing to implement the welfare schemes to poor and SC / BC people and payment of
salaries to the employees of public sector undertakings and co-operative institutions and
forcing the employees to go for agitation, thereby creating law and order problems in the
UT of Puducherry.

The above actions by your goodself are clear cases which are unconstitution al,
illegal and wanton acts to stop development works in Puducherry to bring disrepute to
the democratically elected Congress and DMK alliance Government in Puducherry.

Therefore, I request your goodself to take corrective measures immediately to set

right your unconstitutiona I and illegal way of functioning and respond to my letter in
respect of the anomalies / illegalities created by you and thereby creating anarchic
situation in th is State.
