AGREEMENT OF EASEMENT OF RIGHT OF WAY

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT OF EASEMENT OF RIGHT OF WAY, entered into this _____


day of March 2019, by and among:

BRENDA LABAO VALLES, of legal, Filipino, single and a resident of


Barangay Balugo, Sibulan, Negros Oriental Philippines, hereinafter called the
FIRST PARTY/SERVIENT ESTATE,

and

OFELIA D. PALMA, of legal age, Filipino, single and a resident of


Barangay Magatas, Sibulan, Negros Oriental, Philippines, hereinafter called
the SECOND PARTY/DOMINANT ESTATE,

WITNESSETH:

Whereas, the FIRST PARTY and the SECOND PARTY are the lawful co-owners of
Lot No. 944-B-6, Psd – 07-74848, situated at Barangay Agan-an, Sibulan, Negros Oriental,
consisting of an area of 1,200, covered by Transfer Certificate of Title No. 103-2019000174;

Whereas, the SECOND PARTY in order to have access to and from their respective
undivided shares of the above-mentioned parcel of land, known as Lot No. 944-B-6, the
FIRST PARTY agreed to allocate a width of 2.0 meters and the length of 3.0 meters of the
said lot as road lot and hereby guarantee its free and unimpeded use by the SECOND
PARTY, now and until the SECOND PARTY will sell her portion of the land;

Whereas, the FIRST PARTY and the SECOND PARTY in order to have access to
and from their above-described parcel of land (Lot No. 944-B-6, Psd – 07-74848) and so as
to have an outlet to the National Highway, which is the nearest public road and least
burdensome to the SERVIENT ESTATE and to the public it would be necessary for the
owners of the DOMINANT ESTATE to pass through the SERVIENT ESTATE and for this
purpose, there is a need to create and subject the SERVIENT ESTATE, in a limited time, to
an easement of right of way for the use of the SECOND PARTY;

Whereas, the FIRST PARTY by these presents in consideration of their love and
affection to the SECOND PARTY, covenant to grant, as in fact hereby grant a width of
width of 2.0 meters and the length of 3.0 meters (road lot) and all throughout the length from
the undivided share of the SECOND PARTY to the nearest public road (National Highway).

This agreement shall be binding between the FIRST PARTY and the SECOND
PARTY and until such date the FIRST PARTY will sell the said portion of land.

IN WITNESS WHEREOF, the parties have hereunto set their hands this ____ day of
March 2019, in Dumaguete City, Philippines.
