Description
The Chemical Engineering Law of 2004 is a policy for the supervision and
regulation of the chemical engineering practice as stated in Article I Section 2 of
RA 9297. It aims to ensure that our chemical engineers are at par with the best
in the world through facilitating advancement on chemical engineering
education since it is an essential part on the overall national development.
Article I Section 4 of RA 9297 focuses on the scope of practice of chemical
engineering profession. It shows a wide array of options on what field a
chemical engineer can work in the industry. It’s interesting to know these fields
such as in design, research and development, planning, supervision, and many
more because these fields show a wide opportunity for chemical engineers to
focus and work on.
Article II Section 5 imposes the composition of the board. The board has the
administrative control and supervision of the professional regulation
commission. These appointed people must be nominees of the duly integrated
and accredited organization of chemical engineers.
Article III Section 15 of RA 9297 imposes the scope of topics for the board
examination in order to become a licensed engineer. It is essential to know the
distribution of topics in order to know what topics are needed to focus on
during review.
Article III section 19 sets the standards on the issuance of certificate of
registration and professional identification card. This section sets a qualification
grade with a general average of no less than 70% and a rating of no less than
50% in any examination subject in order to officially become a licensed
chemical engineer.
Article III Section 22 is somehow a special section discussion on the exemptions
for registration. It regulates the registration restrictions for foreign chemical
engineer aspect. This is somehow a regulation on the importation of chemical
engineers and on their right to be excepted on the boards given that they are
heavily investigated by the Board for granting the exceptions.
Article III section 15 of RA 9297 emphases on the possibility of suspension or
revocation of Certificate of Registration and certificate of compliance of
chemical engineers. This section applies to chemical engineers who violated
misrepresentation, inimical acts, and gross immorality wherein they can be
suspended or worst, their license may be revoked upon investigation of the
board.
Article IV Section 27 stresses on the prohibitions in the practice of chemical
engineering. People who are in the Chemical Engineering practice shall have a
license to operate. Conduction chemical engineering services without a valid
certificate of registration, impersonation, and fabrication of false documents
may be charged guilty of misdemeanor.
Article IV Section 30 is an interesting section since it encourages foreign
reciprocity. No foreign shall be granted rights under this act unless the country
offers the same to Filipino chemical engineers.
Article IV Section 29 is a regulation on the submission of designs and
specifications for government approval wherein necessary documents for an
industrial plant design and construction must be signed and verified by a
registered chemical engineer before they can be granted approval.
