Whereas, the First Party/Researcher as Ph.D Language Studies student,

in fulfillment of her course requirement came up with a dissertation proposal to
conduct study entitled "A Study on the Structure of Agusanon Manobo Folk
Narratives;

Whereas, it is a recognized belief that language represents the unique

identity and ethnicity of indigenous people, the practice and preservation thereof
is part of cultural heritage and pride of the state;

Whereas, the Manobo history, folklore and other literature is threatened to

be forgotten brought by technology and social modernity, its dissemination to the
present and coming generations is necessary to commemorate the cultural
identity;

Whereas, the Manobo literature, culture and historical account, with

Bisaya and English translations, in an easy to understand narratives will serve as
reference and a guide for any person who will be interested to use and study;

Whereas, in coordination and with consent of the Second Party, the First
Party/Researcher intended to conduct the research activity in a culture-rich
Manobo tribe of Municipality of Rosario, Agusan del Sur;

Whereas, the study would necessarily involve activities such as

research, interview, group discussion and study pertaining to the
“Indigenous Knowledge Systems & Practices” (IKSPs), “Customary Laws”
(CLs), Indigenous Cultures, and Customs & Traditions of the Manobo Tribe
CADT-078 in the Municipality of Rosario;

Whereas, under NCIP Administrative Order No. 1, Series of 2012

(The Indigenous Systems and Customary Laws Research and Documentation Guidelines
of 2012), in relation to the pertinent provisions of Republic Act. No. 8371, the
said IKSPs, CLs and Customs and Traditions are owned by the said IP
Community as their collective property and are inherent part of their
cultural patrimony;

Whereas, under NCIP Administrative Order No. 1, Series of 2012, a

Free and Prior Informed Consent (FPIC) process is required before any
research activity affecting the IP community may commence. This is in
recognition to their intellectual contribution in the development of
knowledge, and their rights over these knowledge and resources. Thus,
their voluntary consent should be based on informed opinion, which means
that they should be fully informed what activity/research is all about, what
are the resources that will be gathered and the aspects of benefit-sharing
among other concerns;

Whereas, the NCIP is the government agency primarily responsible for the
formulation and implementation of policies, plans and programs to promote and
protect the rights and well-being of the Indigenous Cultural
Communities/Indigenous Peoples (ICCs/IPs);

Whereas, after being fully informed of their rights as ICCs/IPs and the
details of the proposed activities of the First Party/Researcher via the FPIC
conducted pursuant to the provisions of NCIP Administrative Order No. 1, Series
of 2012, the concerned ICCs/IPs freely and voluntarily offer no objection to it.
They even issued a resolution of consent to the proposed activity of the First
Party/Researcher;

Whereas, the parties hereto have full authority to sign and execute this
Memorandum of Agreement;

NOW THEREFORE, for and in consideration of the foregoing premises,

the Parties hereto stipulate the following:

1. INCLUSIVE DATES/DURATION OF THE AGREEMENT:

GIDUGAYON NIINING MAONG KASABUTAN:

1.1. This Memorandum of Agreement shall be for a period of six

(6) months counted from the time of the actual signing hereof
by all the parties. Extension of time shall be governed in
accordance with Section 8.13 of NCIP Administrative Order
No. 1, Series of 2012.

2. RIGHTS AND RESPONSIBILITIES OF THE PARTIES:

2.1. RESPONSIBILITIES OF THE FIRST PARTY/RESEARCHER;

a. Comply Faithfully with the provisions of the MOA duly

entered into between the parties;

b. Subject to the ritual of the tribe prior to the start of the

research process;

c. Consider and respect cultural sensitivities of the concerned

community;

 d. Observe transparency to the community in the presentation
of the proposed research and the conduct of all activities
related thereto;

e. Submit a copy of the research output to the community and

the NCIP; and

f. Comply with the provisions of NCIP Administrative Order

No. 1 Series of 2012.

2.2. RESPONSIBILITIES OF THE SECOND PARTY;

a. Establish a registry of completed research output;

b. Conduct Ritual prior the start of the research process.

b. Inform and/or orient the researchers of the cultural sensitivities

c. Ensure that all concerned sectors in the community are properly

represented in the consensus building.

2.3 RESPONSIBILITIES OF THE THIRD PARTY, THE NCIP;

a. Ensure compliance with the provisions of NCIP Administrative

Order No. 1, Series of 2012;

b. Facilitate and coordinate the whole activities;

e. Monitor compliance of the terms and conditions of agreements

entered into;

the research output are properly respected and enforced;

g. Come up with a registry of researchers and research

organizations with complete profile for monitoring and evaluation
purposes;

h. Assist the ICCs/IPs in establishing a registry of research or

documentation outputs.

3. EXTENT OF THE INFORMATION THAT MAYBE DISCLOSED TO THE

FIRST PARTY/RESEARCHER, RESTRICTIONS, AND OTHER TERMS &
CONDITIONS:

a. The First Party/Researcher, in seeking information relative to the

Second Party’s IKSPs, CLs and other customs & traditions, shall be
confined to the following matters –

 Their life cycle, agricultural cycle, cultural

practices and/or processes.

Ilang life cycle, agricultural cycle, kulturanhong pama-

 Specific Indigenous knowledge, Skills and

Practices.

Tumbok nga Lumadnong kahibalo, kahanas ug mga

pama-agi.

 Indigenous Political Systems, Structures &

Institutions.

institusyon.

 Names and descriptions of Traditional

Ceremonies, Rituals, & Religious Beliefs and Practices.

pagtuo ug mga pama-agi.

 Traditional Songs, Dances & Arts.

Tradisyonal nga mga awit ug sayaw ug mga arte.

 Extent and situation of their Ancestral Domain,

including boundaries, names of places, rivers and
mountains, plants & animals, and other natural
resources within the domain.

b. The Second Party reserves the right to withheld information, or to

refuse to answer to questions propounded when in the opinion
and/or personal belief of the knowledge-holders/living masters, or
the interviewees, that it is considered taboo, forbidden, or is a
closely guarded secret.

Ang ikaduhang partido mahimo nga dili mohatag ug tubag sa mga

pangutana kung sa iyang opinion o personal nga pagtuo, ang tubag
sa pangutana gi-ila nga usa ka sagrado, taboo, ginadili o usa ka
ginabantayan nga sikreto.

4. RESEARCH OUTPUT & PUBLICATION:

RESULTA SA PAGDUKIDUKI OG PUBLIKASYON

a. The First Party hereby agrees to use the research output exclusively in
fulfillment of her course requirement in Ph.D Language Studies (Ph.D
LS) at Mindanao State University- Iligan Institute of Technology;

gamiton lamang para sa katumanan sa iyang kurso nga Ph.D
Language Studies (Ph.D LS) at Mindanao State University- Iligan
Institute of Technology;

b. Copies of the research output shall be given to the mini-library of

CAMMPACAMM, the indigenous political organization of the Second
Party, to serve as reference for teachers using mother-tongue as
method and practice of teaching for academic or theoretical concepts,
and in any related studies in the future;

c. Use of the research output or any of its derivative for commercial

purpose/s is strictly prohibited;

unsa nga naggumikan niini para sa bisan unsang negosyo o komersyo
nga katuyoan;

d. Without the permission of the Second Party secured by community

assembly, the research output shall not be copied, communicated or
published in any manner. If permission is secured, the community shall

 have the sole and exclusive right to determine the extent, content or
manner of presentation or knowledge that maybe published of
communicated if the research output pertains to their religious, cultural
beliefs, ceremonial paraphernalia or sites.

presentar, kung ang research output mahitungod sa ilang relihiyoso,
kulturahnong pagtuo, mga serimonyas, kagamitan ug lugar.

5. DISPUTE RESOLUTION:

RESOLUSYON SA PANAGBANGI

a. In case of any dispute arising from this Memorandum of Agreement,

the Parties hereto hereby submit to the jurisdiction of the NCIP, the
latter being the Government Agency charged with the regulatory
power over Indigenous Peoples.

hurisdiksyon sa NCIP, isip mao ang ahensya sa gobierno nga
adunay regulatory power sa mga Indigenous Peoples.

b. In case of conflict in the interpretation of this Memorandum of

Agreement, the Visayan Version must prevail over the English
version.

Kung adunay konplikto sa interpretasyon niining maong Kasulatan

sa Panagsabot, ang Visayan Version maoy mopatigbabaw kay sa
English version.

c. In case of violation or breach of the Memorandum of Agreement,

the SECOND PARTY shall file written complaint to the Regional
Hearing Office though the Provincial Legal Officer in accordance
with the Implementing Rules and regulations of R. A. 8371.

d. No complaint shall be filed to the Regional Hearing Officer by either

party, unless a mediation conference shall have been facilitated at
the level of the Provincial Legal Officer.

conference nga ipahigayon sa level sa Provincial Legal Officer.

IN WITNESS WHEREOF, the parties have hereunto set their hands this ___
