The Rules of Civil Procedure provides a set of guidelines in how to advance the

parties’ causes of action in an efficient manner and provides a method in ensuring their
right to due process is protected. It is not sufficient that there is a hollow knowledge of
these rules. A lawyer must understand how these concepts interplay with one another in
order to carry out the interest of justice.

In partial fulfillment of the course requirements in Civil Procedure, we were tasked


to observe trial proceedings in court in order for us to fully grasp the processes of a civil
proceeding. Another purpose of such activity is for the students to easily remember and
to have a profound understanding on the different procedures that shall take place albeit
its complexities and technicalities.

On the 10th of April of 2018, our group went to the Hall of Justice, specifically
Branch 10 of the Regional Trial Court, which is presided by the Hon. Retrina E. Fuentes.
The first case is entitled Elde M. Eway et al. v. Anellie V. Valdevieso et al., which involves
an action for the Declaration of Nullity of Transfer Certificate of Title covering a property
found in Tugbok District, Mintal. We have observed the trial at the stage of initial
presentation of witnesses for defendant. Applying section 5 of Rule 30 of the 1997 Rules
of Civil Procedure, the court proceeded with the presentation of evidence in chief where
