NOTIFICATION OF LAWS AND REGULATIONS


UNDER ARTICLES 18.5 AND 32.6 OF THE AGREEMENTS

Supplement

The following communication, dated 26 September 1996, has been received


from the Permanent Mission of Japan.

As a result of a modification, the following provision was added to the


Cabinet Order relating to Anti-Dumping Duty.

Article 17-2 (Security for the import product which is exported or produced by a
new supplier)

1. The Minister of Finance shall notify to the Director-General of Customs the


name of a new supplier and the amount of security to be deposited, in cases
where decisions are made to order the deposit of security for the import product
which is exported or produced by the new supplier (i.e. the new supplier
prescribed in paragraph 12 of Article 8 of the Law, hereinafter referred to as the
same) who is subject to the investigation under paragraph 13 of Article 8 of the
Law. The Director-General of Customs shall, based on the above-mentioned
notification, order the person who intends to import a product which is exported or
produced by the new supplier during the investigation period concerned
(hereinafter in this paragraph referred to as "the importer") to deposit the security,
unless the Director-General of Customs finds it unnecessary, taking into account
the means of the importer.

2. The Director-General of Customs shall promptly enter into the procedure to


release the security deposited in accordance with the provisions of the preceding
paragraph, in cases where (1) the investigation under paragraph 13 of Article 8 of
the Law has been concluded, and (2) decisions are made to terminate, in
accordance with the provisions of paragraph 15 of Article 8 of the Law, the
imposition of the anti-dumping duty under the provisions of paragraph 1 of Article

3. The Director-General of Customs shall promptly enter into the procedure to


release an excess amount of the security deposited in accordance with the
provisions of paragraph 1, in cases where (1) decisions are made to modify,
pursuant to the provisions of paragraph 16 of Article 8 of the Law, the anti-
dumping duty imposed in accordance with the provisions of paragraph 1 of Article
8 of the Law, and (2) the amount of the security deposited in accordance with the
provisions of paragraph 1 exceeds the amount of the anti-dumping duty modified
in accordance with the provisions of paragraph 16 of Article 8 of the Law.
