Arbitration Clause 17.

3 of Section 6: GCC

1) Disputes in which amicable settlement has not been reached shall be settled in accordance with the
Indian Arbitration Act, 1996.
2) The arbitral tribunal shall consist of 3 arbitrators.
3) Out of 5 arbitrators forwarded by employer, contractor shall choose one of them as arbitrator.
Employer will decide the second arbitrator and the third shall be chosen by the two arbitrators
appointed by the parties and shall act as presiding officer.
4) One member shall be a working or retired officer of Indian Railway Accounts service, One member a
technical person of any engineering service of Indian railways or equivalent service in RVNL, The
presiding shall be a serving railway/RVNL officer.
5) Proceedings shall be held at New Delhi, India in English.
6) The decision of majority of the arbitrators shall be final and binding upon both parties.
7) The expenses shall be equally shared by Employer and Contractor.
