RUFINO UMANITO
G.R. No. 172607, April 16, 2009

FACTS:
The accused RufinoUmanito was found guilty for the crime of rape and was sentenced to suffer the
penalty of reclusion perpetua. the alleged 1989 rape of the privatecomplainant, AAA, had resulted in
her pregnancy and the birth of a child, a girl hereinafteridentified as BBB. In view of that fact, a well as
the defense of alibi raised by Umanito, theCourt deemed uncovering of whether or not Umanito is the
father of BBB greatlydeterminative of the resolution of the appeal. Thus, AAA, BBB and Umanito were
ordered subjected to DNA testing. The result of DNA testing was there was 99.99% probability that
Umanito is the father of BBB.

ISSUE:
WON disputable presumptions such as findings of DNA testing are satisfactory to support a conviction if
not contradicted by other evidence.

HELD:
YES. The SC held that disputable presumptions are satisfactory if uncontradicted but may be
contradicted andovercome by other evidence. The disputable presumption that was established as a
result of the DNA testing was notcontradicted and overcome by other evidence considering that the
accused did not object to theadmission of the results of the DNA testing norpresented evidence to rebut
the same.
