INFORMATION ACT, 2009 WITH RESPECT TO
DEPARTMENT OF RURAL DEVELOPMENT & PANCHAYATI RAJ

INTRODUCTION

The J&K Right to Information Act, 2009 is a historic


legislation enacted by the Jammu and Kashmir State Legislature
when it received the assent of the Hon’ble Governor on 20th March,
2009. The Act ushered in an era of accessibility to information
which hitherto lied under the safe custody of Public Authorities and
has empowered the common man in a real sense. The Act has
totally changed the procedures adopted for decision making and
policy formulation thereof by the Government or Government
affiliated agencies. A new era of accountability and transparency
has dawned upon the State of Jammu and Kashmir. Under the Act,
the State Information Commission has been constituted which
ensures the smooth flow of information in a time bound manner
from Public Authorities to a “common man”.

The objective of this handbook is to provide information to the


intended users regarding different functions being performed by the
Department of Rural Development and Panchayati Raj. Besides,
this handbook also includes Directory of officers/officials of this
department.

BRIEF INTRODUCTION OF
DEPARTMENT OF RURAL DEVELOPMENT AND PANCHAYATI RAJ

The Department of Rural Development & Panchayati Rajin fact


attains the present stature courtesy Panchayati Raj Institutions (PRIs) in
Jammu and Kashmir State. Initially during the regime of Maharaja Hari Singh,
PRIs in a modest way were introduced in the State and several powers also
bestowed on them for raising of taxes and non-taxes besides funding for
addressing the infrastructural needs of the rural community. With the country
having attained independence and a democratic order ushered in, PRIs in the
State of Jammu and Kashmir came to the fore front for shouldering the
massive responsibility of building rural infrastructure by way of funds
apportioned to them by the State Government as also on the basis of the
various taxes and revenues raised for replenishment of the State’s own
resources for creating durable community infrastructure. Synergy between
different departments also was working for the upliftment through this
medium under the aegis of Panchayati Raj and extension work also massively
carried out through Panchayats in conjunction with different line
Departments for popularising various technologies and scientific tools for
bringing about socio-economic transformation of the rural society.
J&K Panchayati Raj Act 1989 was brought in place by which three
tier Panchayati Raj system at Halqa, Block and District level, was prescribed as
a step forward for de-centralisation of the planning process and carrying out
various developmental activities for rural upliftment through participatory
management process. Panchayats Adalats were also set up for resolution of
local disputes of criminal and civil character by compromise, consensus and
reconciliation. In spite of the prevalence of adverse security scenario in
Jammu and Kashmir State, elections for the PRIs were held in the year 2001

and tangible steps taken for empowering the Panchayats for their
involvement on wholesome basis in the entire development process as also
for looking after various subjects transferred to them charged with the
responsibility of rendering services to the rural society. Rural Development
Department in Jammu and Kashmir State infact has come of age through the
Panchayati Raj route and has, for last more than two decades, been involved
in the implementation of the various Centrally sponsored schemes and the
schemes having been carved out by the State government for upliftment of
the rural society.
National Rural Employment Guarantee Scheme (NREGS),
Sampooran Gramin Rozgar Yojna (SGRY), Swaranjayanti Gram Swarozgar
Yojna (SGSY), Indira Awas Yojna (IAY), Integrated Watershed Development
Programme (IWDP –Haryali) and host of other Centrally sponsored schemes
are presently being looked after through Department of Rural Development
and Panchayati Raj by which rural infrastructure has been greatly
strengthened and wage employment to poor and down-trodden strata of the
society afforded at their doorstep. Efforts on sustained basis have been made
to eradicate poverty from rural life and provide means of livelihood o the
rural poor masses.
Total Sanitation Campaign has also been launched by
Department of Rural Development and Panchayati Raj in the pursuit to bring
about a real revolution in village life providing unpolluted living environment.
Provision of individual household latrines, community latrines, institutional
latrines, women complexes and Rural Sanitation Marts are being attempted
through this programme, which is being implemented in a mission mode
manner and aims at to lift the society to the new heights of the glory.

Rural Development Department further has been encompassing
various other development programmes like BADP, MPLAD and CDF to ensure
providing durable infrastructure with better quality at a low cost to the public
besides providing wage employment.
With a view to give boost to the various activities in the
Panchayati Raj, halqa Panchayats are being re-organised by which the number
of Panchayats is likely to go up to 4000 from 2700. This would provide
homogeneous, viable and easily manageable units of governance to the
Panchayats ensuring better dividends to public.
The community empowerment is another area which has been
gaining considerable attention. A massive programme on this account has
been chalked out which besides uplifting the level of comprehension of PRIs
would sensitise the officials of Department of Rural Development and
Panchayati Raj and other line Departments for raising their level of
commitment, understanding, skill and technology for more positive
application of the schemes with rich dividends.
The all India pattern of DRDA Administration has also been
launched in the State so as to provide skill and know-how to the PRIs enabling
them to shoulder various responsibilities gainfully with utmost public interest
and better output insight.
The Department of Rural Development and Panchayati Raj in
Jammu and Kashmir State thus in the present context emerges to be the sole
movement destined to change the face of the rural society.
The Department of Rural Development and Panchayati Raj is the
Nodal department responsible for implementation of following Rural
Development programmes aimed at improving socio-economic conditions of
the rural population of the State.

1. MGNREGS:
The MGNREGA Section implements the programme under
Central Act MGNREGA according to which 100 days of guaranteed unskilled
manual work is provided to all those rural households who get themselves
registered and obtain jobcards.
The primary objective of the schemes implemented under this
Act by the MGNREGA Section is to enhance livelihood security in rural areas
by providing at least 100 days of job employment in a financial year to every
household whose adult members volunteer to do unskilled manual work. Its
auxiliary objective is to strengthen the natural resource management through
works that address causes of chronic poverty like drought, deforestation and
soil erosion and so encourage sustainable development. The process
outcomes include strengthening grass root processes of democracy and
infusing transparency and accountability in governance.

2. Indira Awaas Yojana (IAY):


This Centrally scheme is being implemented by the Department
of Rural Development and Panchayati Raj J&K which aims at providing a
reasonable and hygienic house to the BPL households of rural areas in the
State.
There is also a provision of upgradation of dilapidated houses of
the BPL families. Besides that a 5% of the annual allocation of a district under
this scheme is kept reserved for providing assistance to the BPL households
whose houses get damaged due to natural calamities like floods, earthquakes,
fire, landslides and storms etc.
An amount of Rs. 75000/- is given to BPL households for
construction of new IAY house plus Rs. 10000/- (Rs. 5500/- out of MGNREGS

and Rs. 4500/- out of NBA) for construction of household toilets in every IAY
house.

3. Rural Sanitation (Nirmal Bharat Abhiyan)


Department under this Centrally sponsored Rural Sanitation
programme motivates all rural households through IEC/awareness campaigns
to construct individual household latrines and stop open defecation. Under
this programme namely Nirmal Bharat Abhiyan rural BPL households are
provided a financial assistance of Rs. 10000/- (Rs. 5500/- out of MGNREGS and
Rs. 4500/- out of NBA) for construction of individual household latrines.
Besides that financial assistance of Rs. 35000/- for construction of institutional
toilets in schools and Rs. 200000/- for construction of community toilets.
The aim of the department under Niraml Bharat Abhiyan is to
make rural areas defecation free.

4. Integrated Watershed Management Programme (IWMP)


This Centrally sponsored programme of Department of Land
Resources, Ministry of Rural Development, Government of India is being
implemented by the State Department of Rural Development and Panchayati
Raj which aims at treating the degraded lands/areas identified through
satellite imagery on watershed development approach and also through
multifarious interventions of livelihood generation to develop the identified
watershed areas in an integrated manner to uplift the socio-economic
condition of the rural population of these areas.

5. National Rural Livelihood Mission (UMEED)
This Central sponsored programme of Ministry of Rural
Development, Government of India is being implemented by the State
Department of Rural Development and Panchayati Raj through State Rural
Livelihood Mission (a Society registered under the Societies Act.) which aims
at mobilizing the rural poor, especially rural women to begin with into Self
Help Groups and to make them learn how to save their meagre earnings
together in a group to help each other (group members) in the time of need
and subsequently linking them with financial institutions/banks and taking up
viable economic ventures as per their skills and interest by availing loans. In
the process this programme aims at lifting the rural poor households out of
the shackles of poverty and to galvanize themselves in a cooperative culture
to take up bigger economic ventures and not only make them self sustainable
but also to bring them at a position where they can contribute positively
towards the society.

6. Rajeev Gandhi Panchayat Sashaktikaran Abhiyan (RGPSA)


Rajeev Gandhi Panchayat Sashaktikaran Abhiyan (RGPSA) and the
proposed instruments thereof is expected to be a watershed in strengthening
Panchayati Raj system as the State is at the threshold of establishing vigorous
rural local self government institutions. The main objectives of the scheme are
as under:
 Enhance capacities and effectiveness of Panchayats and Gram Sabhas
 Enable democratic decision-making and accountability in Panchayats
and promote people’s participation.
 Strengthen institutional structure for knowledge creation and capacity
building of Panchayats

 Promote devolution
 Specially strengthen Gram Sabhas in PESA areas
 Create and strengthen democratic local self-government in areas where
Panchayats do not exist.
 Strengthen the framework on which Panchayats are founded.
The scope of the Abhiyan shall lend a helping hand in
strengthening the PRIs under the following fields:
1. Administrative and Technical Support.
2. Construction and Repair of Panchayat Buildings
3. Capacity Building and Training
4. e-enablement of Panchayats.
5. Support to Panchayat Processes.
6. Information, Education and Communication
7. Strengthening of State Election Commissions
8. Programme Management
7. Backward Region Grant Fund (BRGF)
Local-Self Government Institutions in general and the Panchayati
Raj Institutions in particular have assumed greater significance under the
recent development philosophy wherein democratic decentralization has
emerged as a catchword. Panchayat Raj is, as such, considered to be a
concomitant of reordering power equations, a supplement to the conscious
strategy to relocate power and complete the process of devolution for speedy
development process in rural areas.
The most important challenge faced in the successful functioning
of these democratic institutions is capacity building and training of all the
elected and official functionaries placed at the three tiers of Panchayati Raj
Institutions. The Backward Region Grant Fund (BRGF) is such a centrally

sponsored scheme being implemented by the Ministry of Panchayati Raj with
the objective of assisting efforts of the State Governments for training and
capacity building of elected representatives of Panchayati Raj Institutions.
Funding of the scheme under BRGF is applicable to BRGF districts. The
schemes focus primarily on providing financial assistance to the States/UTs for
Training & Capacity Building of elected representatives (ERs) and functionaries
of Panchayati Raj Institutions (PRIs).

8. e-Panchayat Mission Mode Project


With vision to strengthen the credibility of Panchayats as
institutions of local government, MoPR embarked upon introduction of e-
Governance in PRIs to bring about efficiency, transparency and accountability
in PRIs under the ambit of e-Panchayat Mission Mode Project under the
National e-Governance Plan. e-Panchayat MMP is a large scale e-Governance
initiative planned to be rolled out in 2.5 lakh Panchayats across the country
simultaneously.

PARTICULARS OF ORGANIZATION, FUNCTIONS AND DUTIES

The business of the Government of Jammu and Kashmir is


transacted in accordance with the Jammu and Kashmir Business Rules. These
rules have been framed under section 43 and sub-section 2 of Section 45 of
the Constitution of the State. The Council of Ministers headed by the Chief
Minister is the highest executive authority of the State under the
Constitution. Each Minister is In-charge of one or more Administrative
Departments. At the Secretariat level, the business of the Government is
transacted through various Departments, each one or more Department(s)
headed by an Administrative Secretary.
The Administrative Secretary of the Department is assisted by a
team of officers of the rank of Special Secretaries/Director Panchayats/
Director Finance/Joint Director Planning and Under Secretaries. Down-below
the Under Secretary there is an established non-Gazetted administrative
hierarchy headed by the Section Officer. The procedures for dealing with the
cases and the functions of the non-Gazetted staff have been defined in
Secretariat Manual. As per the Secretariat Manual, the Section Officer is
empowered to dispose certain issues at his own level or seek information
from the concerned offices which he feels would be relevant for decision
making.
With a view to dealing with the different issues pertaining to the
Department of Rural Development and Panchayati Raj, different Sections
have been set up. The brief description is as under:-

I. HRM Branch:-

The HRM Branch was primarily assigned following functions:-


➢ To deal with personnel matters of State cadre employees insofar as
they relate to promotions, seniority lists, APRs, departmental enquiries/
vigilance cases;

➢ To ensure timely referral of vacancies (both under direct recruitment
and promotion quotas) to the designated recruiting agencies/ Departmental
Promotion Committees, for which administrative department is responsible;

➢ In addition to above, the officer heading the branch is to be nominated


as the Vigilance Officer for the department as an interim measure until
personnel records are fully streamlined.

II. Accounts Section:-


The Accounts Section is performing the prominent role of
financial watchdog of the department. The following functions are
performed by the section;
➢ Preparation of Budget Estimates,
➢ To deal with matters related to Public Accounts Committee and
Committee on Public Undertakings,
➢ To settle the cases relating to stepping-up of pay,
➢ To furnish opinion/comments viz a viz matters involving financial
implications
➢ Maintenance of office equipment /stock register, and maintenance of
leave accounts of employees of the department;
➢ To provide with opinion/ advice on service related issues of
Administrative Department as well as subordinate departments of PW(R&B)
department;
➢ To accord financial concurrence whenever required after fulfilling all
the codal formalities;
In addition to above Director Finance acts as Drawing and
Disbursing Officer of the Department.
IV. Planning Section: -
Planning section has assume da pivotal role in the overall
functioning of the department. Following functions have been assigned to
Plan Section of this department.
➢ Preparation of Annual Plan,

➢ Preparation of Result Framework Document (RFD) and to review it to
evaluate the progress of targets achieved from time to time;
➢ Release of funds under various developmental programmes/ schemes,
➢ To accord of administrative approval prior to execution of works;
➢ Monitoring of Physical and financial progress of developmental works
as per specific formats.

V. MGNREGA Section:-

VI. Legal Section: -


There is a full-fledged Legal Section in the Department of Rural
Development and Panchayati Raj which deals with the legal issues like
providing opinion/advise on legal matters pertaining to the department and
also on the issues referred to by various subordinate Departments. The
Section attends to the litigation in the cases wherever Department of Rural
Development and Panchayati Raj is involved. This Section also provides
advice on the important decisions of the department which become subject
matter of litigation(s) before any Competent Court(s) of the Country.

VII. The Public Information Officer (PIO): -

Any citizen can seek information pertaining to Department of


Rural Development and Panchayati Raj in terms of the relevant provisions of
J&K Right to Information Act-2009 and Rules notified there under vide SRO
199 of 2010 dated 29.04.2010 amended from time to time.
The Public Information Officer (PIO) in case of issues pertaining
to Department of Rural Development and Panchayati Raj is Mr. Kuldeep
Kumar Gupta, Under Secretary to Government, Department of Rural
Development and Panchayati Raj.
The Special Secretary to Government PW(R&B) Department, Ms.
Nisar Ahmad Wani (KAS) is the First Appellate Authority (FAA).
The officers of the Department of Rural Development and
Panchayati Raj are available for public hearing on every working day between
1 p.m. to 5 p.m. Any person can approach the officers for redressal of
grievances/enquire about the status of pending case, if any, in the
Department of Rural Development and Panchayati Raj.
