I have been working with Mr. Jimmy on the funding of the below identified projects
with the City of Thibodaux.

I think we need to address a very fundamental problem that even has constitutional
and civil rights implications. I do not think it would be prudent, and would create high
risk of litigation, for the Parish Government to pay any funds to any project that
would support discriminatory treatment toward the citizens and taxpayers of the
Parish. Specifically, I do not think that the Parish can provide any funding where the
City of Thibodaux has a policy and practice of discriminatory additional fees and
charges to the citizens of Lafourche Parish vis-a-vis the citizens of Thibodaux.

Therefore, and threshold requirement for the distribution of any money would require
a Cooperative Endeavor Agreement between the Parish and the City that
guarantees that the City will provide open access to all City recreational activities
and facilities on the same terms and conditions as they provide those activities and
services to their own citizens. That would include no additional charges for
participation by a Lafourche Parish resident over and above the amounts charged to
City residents, or any similar scheme.

Next, we need to be able to respond to any audit inquires and demonstrate sound
accounting practices. In fact, we spent time this morning working on Legislative
Auditor questions, so this is a real issue of great importance. Therefore we will
need the evidence of the bidding, Resolutions or Ordinances for the Contracts,
copies of the Contracts, and all evidence of compliance with State procurement laws
and requirements. I am sure the City can provide that information to us.

Once we have these pre-requisites, we should be able to work out a process for
working with the City on the improvements to these recreation facilities. Obviously,
our funds are limited, but we will, in good faith, do what we can within the
parameters of responsible administration of the Parish funds.

Jennifer: Please coordinate with your counterpart on these points. I will need to do
the CEA so that it meets the requirements of the Legislative Auditor and clearly
specifies the responsibilities of the parties. So, just let me know if we have an
agreement on the guarantees of non-discriminatory treatment of the Citizens that
reside outside of the City of Thibodaux limits.
