[eng] Currently, the long working hours deprive workers of leisure time,
family life and professional development, essential factors to the mental
integrity, right constitutionally guaranteed to all people. Thus, the problem
of the possibility of the employer’s liability for existential damage, arising
from the employee’s inability to live together in society and develop their
personal projects. The purpose is to discuss the nature of the existential
damage resulting from the violation of the right to disconnect worker and
point the current stage of development institute in doctrine and labor law.
Finally, it is argued that the violation of the right to employee
compensation involves disconnection.
