This LOAN AGREEMENT, made and entered into by and between:

REMEDIOS B. ARAGON, Filipino, of legal age, married and with residence address at 19
Fatima Street St. Mary Subdivision, Nangka Marikina City, hereinafter referred to as the
JOEY T. EDUARTE, Filipino, of legal age, married and with residence address at Zone 8
Purok 3 Barangay Cupang, Antipolo City, Rizal, Philippines, and office / business address at
7 Zamboanga Street, Barangay Vasra Quezon City Second District NCR Philippines
(J.Eduarte Construction Services) hereinafter referred to as the “BORROWER”:
The Borrower and Lender have agreed that, upon and subject to the terms and conditions
contained herein, the Lender has agreed to lend to the Borrower the principal amount of One
Hundred Thousand Pesos (Php 100,000.00);
NOW, THEREFORE, the parties hereto agree as follows:
Article 1. Loan: The Lender has agreed to advance the sum of One Hundred Thousand Pesos
(Php100, 000.00) by way of loan to the Borrower upon and subject to the conditions contained in
this Loan Agreement.

Article 2. Repayment of Loan: The principal amount of the loan together shall be repayable with
in six (6) months from the date of the signing of this Agreement.
The first of such installment shall be paid on or before __________________ and the
subsequent installments shall be made on or before the same day of each month thereafter until
complete payment.

Article 3. Interest: The loan shall bear interest at the rate of 10% per month payable
monthly commencing from the day after the signing of this Agreement.

Article 4.Security: The payment of the loan will be secured by a real estate mortgage covering
a parcel of land situated in __________ with an area of ________________ duly registered in the name
of the Borrower.

The Borrower shall not, without the written consent of the Lender, create in any manner any
charge, lien or other encumbrance on the security given to the latter or create any
interest in such security in favor of any other party or person.

Article 5. Prepayment: The Borrower has the right to make payment, in full or the remaining
balance thereof, by serving a written notice to the Lender at any time before the maturity date of the loan.

Article 6. Conditions: The Borrower shall settle the principal amount of the loan, within
six (6) months from the date of the signing of this Agreement. In the event that the
Borrower defaulted or failed to settle the principal amount of the loan, the Lender
shall charge a penalty of compounded ten (10%) percent interest per month of the
total amount due until full payment thereof.

Article 7. Non Waiver: Any LENDER’s right, resulting from the Agreement or from the law, the
LENDER does not fully exercise or that the LENDER takes a long time to exercise, should in no
case be considered as a waiver of said right.
Article 8. Guarantees: This Agreement is not secured by any guarantee of any kind. This
information is acknowledged and agreed once and for all by the LENDER, without right to reserve
Article 9. Amendment. This Loan may be amended or modified only by a written agreement
signed by the Borrower and Lender.
Article 10. Venue of Action. The parties agree that all actions under this Agreement shall be
brought before the proper courts of Marikina City, each party hereby waiving any other venue.
Article 11. Governing Law. This Loan shall be governed by and construed in accordance with
the laws of The Republic of the Philippines.

IN WITNESS WHEREOF, the parties have duly affixed their signatures under hand and seal on
