Is the Sri Sathya Sai University for Human Excellence at Gulbarga a Legal entity?

In today’s world of competition when education is becoming important to build a

career , the student community is facing many a hardship to get admission into
academic programs from a certified, accredited University. Bogus colleges, online
programs doling out College degrees are in plenty on the internet. The public
notice issued by the Sri Sathya Sai Central Trust, Prasanthi Nilayam issued on July
15th, 2018, that the Sri Sathya Sai University of Human Excellence floated at
Gulbarga by Prasanthi Balmandira Trust is not a part of the Sathya Sai Institute of
Higher Learning of Prasanthi Nilayam is creating concerns to the parents as well as
the students. The notice cautioned that it would be a great risk for the students to
seek admission into this University, has now taken a different turn! Is this
University coming into existence not true? Why is the Sri Sathya Sai Central Trust
raising an alarm about this? Upon investigating it has come to light that the
Promoters of this University have used some unwarranted and fraudulent means to
get a clearance from the Government of Karnataka. Here are some details that
have been obtained as to why the Sri Satya Sai Central Trust of Prasanthi Nilayam
has raised a red flag!
In an age when Man is moving forward to pursue Human Excellence, the
establishing of a University for Human Excellence should have been a welcome
note. In normal terms, Human excellence is defined as those human qualities that
make a person outstanding, exceptional, and superior. It is synonymously used
with the word virtue, narrowly meaning moral excellence. The concern is not
about the establishing of the University but the way it is being established. The
procedures followed by the Government of Karnataka are being questioned as it
seems that there is absolutely no iota of truth or virtues seen in the process of
setting up of this University.
According to the Sri Sathya Sai Central Trust , the promoters of the Prasanthi
Balmandira Trust of Karnataka in principal have no connection to Bhagawan Sri
Sathya Sai Baba of Prasanthi Nilayam . It has come to light, that this, Prasanthi
Balamandira Trust has submitted a proposal to the Government of Karnataka to
start this University of Human Excellence. Like any other institution, the Prasanthi
Balamandira Trust too filed an application to fulfil the requisite eligibility criterion.
The proposal has been submitted in association with several other Trusts
including Sri Sathya Sai Lok Seva Trust which is also a registered Trust in
Karnataka.
The Public Notice released by the Sri Sathya Sai Central Trust on July 15th, 2018
categorically mentions that the Sri Sathya Sai Loka Seva Trust was constituted by
Bhagawan Sri Sathya Sai Baba in the year 1978. However, after Bhagawan Sri
Sathya Sai Baba shed his mortal coil and attained Mahasamadhi, there arose various
disputes amongst the then Trustees of Sri Sathya Sai Loka Seva Trust, which was
due to illegal actions of few present Trustees of Prasanthi Balamandira Trust. The
disputes the arose are pending before the Courts of Law and are sub-judice.
In this context, it has been stated that the Trustees of the said Prasanthi
Balamandira Trust are well aware of the same and inspite of the legal awareness,
the Prasanthi Balamandira Trust has sought to show Sri Sathya Sai Lok Seva Trust
as a group of Institutions and have submitted the Application and Proposal to float
this University of Excellence on the credibility of the Sri Sathya Sai Lok Seva
Trust. Upon enquiry, it has come to light that the Trustees of the Sri Sathya Sai
Lok Seva Trust members have neither approved this nor are aware of any such
involvement in the formation of the University. In fact, it has also been revealed
that there is no relationship between the Sri Sathya Sai Lok Seva Trust and
Prasanthi Balamandira Trust or the other Trusts. In the application process, the Sri
Sathya Sai Lok Seva Trust is not an Applicant for establishing any University too.
Now, it is being questioned that when there is an existence of Disputes in Sri
Sathya Sai Lok Seva Trust, how is it that the representations of its credentials are
being relied upon to get the approval from the Statutory Authorities and the State.
For what purpose is this being done is the question that still stands unanswered.
From sources known , it has also come to light that the Application and Proposal
to set up this University in the name of Sathya Sai is a first deviation, as the use
and name of Sathya Sai and the logo are protected for Sri Sathya Sai Central Trust,
Prasanthi Nilayam under the Emblems and Names (Prevention of Improper Use
(Act, 1950 of the Government of India which seems to be a big concern for the Sri
Sathya Sai Central Trust, Prasanthi Nilayam as devotees may get carried away by
seeing the logo and picture of Bhagawan Sri Sathya Sai Baba that this institution is
a part of the Sri Sathya Sai Institute of Higher Learning, Puttaparthi.
The question revolves round this aspect as to what right does the Prasanthi
Balamandira Trust have to use these credentials? Who is the person/s behind this
and what was the need to use these fraudulent means? . Our enquiry has revealed
that the following details used by the promoters to seek permission to establish
the Sri Sathya Sai University of Human Excellence is a gross deviation in legal
terms :
• While describing the applicants, the Sri Sathya Sai Lok Seva Trust has been
mentioned as the first Institution/ Trust in the application.
• The details of Campuses, Schools and Colleges, provided are run by Sri
Sathya Sai Lok Seva Trust are given in the application.
• The proficiency of Teachers, Faculty and Awards of Sri Sathya Sai Lok Seva
Trust are exhibited for proficiency in the application
• The Sri Sathya Sai Lok Seva Health Centre and its credentials are highlighted
in the application which is again run by Sri Sathya Sai Lok Seva Trust
• Various photos of the institutions run by Sri Sathya Sai Lok Seva Trust are
depicted in the application to give credibility.
• The Financial Capability of Sri Sathya Sai Lok Seva Trust is incorporated in
the Application and Proposal when the Applicant has no power to utilise
the funds.
 • The Income and Expenditure Account as well as Balance Sheet of the Year
ended at 31.03.2016 is depicted of the Sri Sathya Sai Lok Seva Trust is
furnished.

With these deviations done in the establishment of the Sri Sathya Sai University of
Human Excellence, the basic core of Human Excellence seems to be totally
missing giving doubt to the society at large. In this context, it is mandatory that the
application and the proposal need to be enquired and scrutinised in depth and the
Sri Sathya Sai Central Trust has sought the State Government of Karnataka and
the University Grants Commission to forthwith withdraw and rescind all
permissions and approvals, if any, granted as they are guilty of mis-interpreting
facts and deviating from said procedures of establishing a University. If this is true
upon enquiry, this might also lead to a situation wherein the Government of
Karnataka may also withdraw financial and other grants of land, building etc., if
any, made to the said institution and further repeal Sri Sathya Sai University for
Human Excellence Act, 2018 and may initiate criminal action against the Appellant
and Proposer and the Trustees as it tantamounts to cheating the general public, the
State Government of Karnataka and the Government of India.
The student community is advised to wait and watch the development and
discriminate before taking the right step ahead. With regards to the Sri Sathya Sai
Institute of Higher Learning, our research has revealed that it is a deemed to be
University at Puttaparthi and is ranked Institute by the National Institutional
Ranking Framework, Ministry of Human Resource Development Government of
India with ID: IR-1-O-O-U-0035 established in the year 1981 by Bhagawan Sri
Sathya Sai Baba Himself when in Physical form and has been the Chancellor of the
University till the date he attained His Maha Samadhi .
