Chapter 1: Introduction

Chartered City of Dagupan

Location and Boundaries

Dagupan city officially covers a total land area of 4,008 hectares or about

40,079,278.93 square meters.1 It falls under the latitude 160 01’ to 160 07’ north and

longitude 1200 18’ to 1200 23’ east. It is bounded by the Lingayen Gulf in the north,

Municipality of San Fabian in the northeast, Municipality of Mangaldan in the East,

Municipality of Calasiao in the South and Municipality of Binmaley in the West. However,

the digitized cadastral maps, show that the digitized cadastral maps reveal a different

perspective; that the boundary of Dagupan City is equivalent to 4,447.10 hectares.2

From Dagupan city to Manila, the country’s capital, is 212 kilometers which could

be traveled for about 4 to 5 hours by any land transportation. From Dagupan to the summer

Capital of the Philippines, Baguio, the distance is 70 kilometers. It could be reached in

about 2 hours by any land transportation.

Physical Divisions and Map

Today, Dagupan city is politically subdivided into 31 Barangays. The largest

Barangay is Brgy, Bonuan Boquig while the smallest is the Barangay I. However, having

the biggest land area does not necessarily mean that they would have the biggest

population. The most populous barangay is Brgy. Bonuan Gueset while the least is

Barangay I.

35.98% of its land use is basically for farming, while 22.88% are reserved for the

fishing industry. While the rest is used for businesses, infrastructures, institutional,

governmental, recreational, and streets. The city has 4 open markets. Some business

foundations include 1.) general stock markets, exchanging and nourishment house, 2.) land

administrations or lessor, 3.) sari-sari stores, and 4.) protection or loaning speculators and

banking. 3

Dagupan city is considered to be the region’s center point. It is the business,

commercial and banking center of the North. It is the retail and wholesale capital of Region

I. Dagupan alone has over 50 banks. It also has the most number of schools; many other

localities stay in Dagupan to acquire quality education. Currently, it houses 2 of the major

schools namely the University of Pangasinan-PHINMA and the University of Luzon.

Every generation, the graduates being produced by these schools play a major role on

protecting Dagupan city’s status quo and sustaining its development.

The city also has the major hospitals like the Region I, Nazareth General Hospital

and others. Many other localities go over to Dagupan city and seek treatment in the

hospitals of Dagupan because they have high quality service. This is another proof that

Dagupan city is considered to be the center of Region I, even in the delivery of services.

Recently, after 40 years, the Comprehensive Land Use Plan has also been drafted

and updated in accordance to the current stance of Dagupan city. This is an action to

determine the different land divisions or purposes of the land area of Dagupan. This is to

determine which part is for recreational purposes like parks, which land is for

transportations or roads, which part is attributed to agricultural or farming, which part is

the most ideal Residential areas, and which parts are strategic places or locations for

businesses and commercial areas. Additionally, it is also another way to attract the

different investors. Aside from attracting potential investors, it also aims to strategically

protect its citizens away from hazardous locations while maximizing the land area of the

city. 4

Dagupan city is also blessed with 2 beaches namely Tondaligan Beach and Pugaro

Beach. The former has been polluted years before the current executive assumed the

position. However, upon being elected, being an advocate of a cleaner and safer

environment, the beach has been rehabilitated and restored to its natural and beautiful state.

As of today, it has many recreational activities like Banana boats and Jet skis. Most

importantly, this is an act of the government to protect and preserve the environment,

especially the Bonuan, Tondaligan Beach. Because this is the main source of the “Bangus”

or Milkfish, which is considered to be a precious gem in Dagupan city. Hence, it would be

such a huge lost if it would not be sustained and protected today.

The milk fish (scientific name: Chano Chanos) has a proportioned streamlined

appearance, and has a fork sized caudal fin which feeds on algae and invertebrates due to

its absence of teeth; in the market, usually, the readily available size is of 14 inches. 5

However, Bangus is not only the only sea creature being offered by Dagupan city.

It also exports Small, tasty oysters, Malaga, Tilapia, Sugpo,

History

Dagupan City’s early settlers are believed to have originated from Flores Islands in

Indonesia because of the strong resemblance of Pangasinan dialect. Fishing and salt making

are two of the most well-known occupations of the aforementioned settlers. Even today,

this livelihood is considered to be one of the major sources of income among the coastal

residents of Dagupan City.6

Before the Spaniards came, it is believed that Kings, Queens and Princesses ruled

the people of Pangasinan. The last known King was King Ari Kasikis. His kingdom was

believed to have been located in an are now popularly known as the City of San Carlos. In

addition, it is also believed that the had a religion of their own. Women are to perform the

religious worships in a god they called “Ana-Gaoley”.7

Moreover, Dagupan City was originally named by the Augustinian missionaries as

Bacnotan, this was a few years after 1583, when the Spanish encomienda in Pangasinan

was first founded. During this time, Dagupan has long been known as the market place not

only to Pangasinan but to the whole Region I. Andres Malong, a local chieftain, led a revolt

against the Spaniards for imposing forced labor in 1660. In commemoration for the forces

under Malong’s leadership, the place was rebuilt after the revolution and renamed

“Nandaragupan” which means, where people meet.8

In 1780, Nandaragupan was simplified to Dagupan, which was followed by the

end of Spanish rule on June 23 1898 when the Spanish troops surrendered the Katipunan

which was then being led by General Francisco Makabulos. 9The arrival of 45th Infantry

Battalion, headed by Gen. Douglas MacArthur at the shores of Bonuan completely

liberated Dagupan from the Spanish rule. The first election was held through a viva voce

which was later on followed by the establishment of the first civil government on February

16, 1901. In addition, the fall of Bataan also posed a serious effect on the site in that the

Japanese Army invaded Dagupan which lasted until 1945.

Two years after the liberation, Dagupan became a city on June 20, 1947 by virtue

of Republic Act 170, a law known as the City Charter of Dagupan. This Charter governs

the operations of the city as an independent component city.10

Even today, Dagupan city still embodies its history being the center of market and

being the “Dagupan na aray to tuo” which translates to meeting place of the people. Being

region I’s most competitive city, it resembles its identity being the marketplace of not only

in Pangasinan but also in the whole Region I, but in a more urbanized and more developed

one.

Bangus Festival

Dagupan city has various festivals but its main festival is the Bangus festival. It has

been recognized by the Association of Tourism Officers of the Philippines and the

Department of Tourism as one of the three best festivals celebrated in the Philippines.

The Dagupan Bangus Festival is a yearly celebration in Dagupan city which has

been started on 2002 under the administration of the Former Hon. Benjie Saplan Lim11. It

is a successful effort to promote the growing Bangus and industry, increase the sales and

production of the local milkfish and at the same time, promote the City of Dagupan. In

addition, this is also a successful effort to lay emphasis on the uniquene taste of the

Dagupan Bangus.

Since then, it has been an annual month-long event. It has also claimed the longest

running festival in the country. This festivity highlights the local industry of Bangus or

milkfish. This annual event has also been the best advertisement for the world’s tastiest

milkfish. It promotes Dagupan city as the well-known “Bangus Capital of the World”.

The Bangus Festival has various diverse programs all month long. Example of

which is the most awaited part, the "Gilon Gilon ed dalan” Street Dancing competition.

Gilon Gilon ed dalan roughly translates catching of fish. It is an inter-barangay street

dancing competition involves creatively demonstrates ways of catching bangus or milkfish

through its choreography, movements, costumes, and props.

All of the 31 barangays of Dagupan compete with one another during this street

dancing. Legend says that they do this as an offering and way of thanks for the successful

harvest until it became a tradition. These dancers depict the fishermen catching the bangus.

They could be as creative as they can. The props are not only limited with bangus and

fishermen. Sometimes, they could use mermaids or merman as props or it could be as grand

as them making a beautiful giant pearl and connect it with the theme. Usually, each group

is accompanied by a band with diverse instruments. They walk around the streets and then

give the people a 5-minute exhibition. Then they march towards the city plaza, where their

full performance can be seen.

The winner in this competition will compete in the “festivals of the north, which

will be hosted by the Dagupan city usually during the 27th of April. It will be contested by

various diverse festivals in not only Pangasinan but the whole region I, including Ilocos

sur, Ilocos norte and Baguio. Sometimes, there are visitors who travel there just to exhibit

their own festivals through street dancing.

Another major program is the historic “Kalutan ed dalan” which occurs every 30th

of April which signifies the last day of the Dagupan Bangus Festival. This was started on

May 3, 2003 by the former mayor Benjie Saplan Lim in an effort to endorse not only the

bangus but also the city of Dagupan. In addition, it has also been a successful attempt to
claim the guiness book of world record title of having the “longest bangus barbecue” which

measured slightly over 1 kilometer which broke the November 1999, long-standing world

record of Peru.12 However, the victory was shortlived but later reclaimed the same world

title for having 2.006 kilometers of bangus barbecue, grilling more that 8000 kilograms of

Bangus.

The Environment

The city’s climate falls under climate Type I which could be characterized with two

seasons; the wet and the dry. The coldest month is the month of January. Rainfall usually

starts at June; however, heavy rainfall usually starts to be experienced on July and ends on

the month of August. Dry season starts in November and usually ends during the month of

May or First week of June.13

Near death incident of the river

Alarming as it was, the river of Dagupan city nearly died. This is really crucial

because Dagupan city is well-known for being the top producer of The Bangus or Milkfish

in the whole world because of its unique and delicious taste. When the current Mayor Belen

T. Fernandez visited the river together with the Dagupan city Bureau of Fisheries and

Aquatic Resources (BFAR) Director Wesley Rosario visited the river, they saw that the

river was colored black, the oysters were gone and the water stinks.14

A major factor of this is because of the 900 plus fish pens that was present; it was

also discovered that majority of which are not owned by the locals, it was owned by the

wealthy businessmen outside Dagupan city. Although it would be a political suicide,

considering the fact that is a main source of livelihood, the chief executive insisted the

removal of all fish pens in an attempt to revive the river.15

The Government today is also working hand in hand and coordinating with various

organizations to preserve its environment especially its water for it is one of the sources of

livelihood and it is the main investment of the “Bangus” or Milkfish and oysters which are

being exported. So, they are looking for ways on how to protect and sustain the industry

without sacrificing the environment.

During this time, because of this action, the water has been cleaner. The oysters are

also back, which is a sign of a safer river. In addition, the localities are also allowed to put

fish pen; with a maximum of 7x10m. With the condition that the permits shall be given to

them personally to avoid re selling of permits to other wealthy businessmen.

Anti-Drug Campaign

A safe environment would not only mean preservation of natural resources but also

preservation of the people. Even before the current president launched its anti-drug

campaign, the chief executive has already been pushing for a drug-free city. The Chief

executive has already been coordinating with the Philippine National Police (PNP) to push

for the Sagip User project. This aims to rehabilitate the surrenders with the help of other

religious organizations. In her first three years, they were able to jail about 700+ people.16

After the rehabilitation process, the city has the duty to help them get back and start

their lives, so they help them find jobs and livelihood for them. As a result, those who

recovered have been embracing their drug-free lives and are continually encouraging others

to stop or not enter into illegal drugs. In addition, as of today, all 31 barangays are declared

drug-free. 17

The Executive has also been active in various diverse recreational activities in

support for the ant-drug campaign like Swimming, Taekwondo, Karate, Music, Journalism,

Archery, Basketball, Volleyball, Gymnastics and many more. In line with this, the

government has also been financially supporting the trainings that the children of the

contestants would have to undergo, months before the official Region I Athletic

Association.18

Additionally, these activities have also been coordinated with various agencies or

partners of the city. One example is in swimming, they have tapped the Bert Lozada

swimming school to train the young athletes. Another one, in order to encourage children,

the University of Santo Tomas, College of Music taught the kids on various instruments

such as guitars, cello, keyboard, violin, ukulele, and other instruments.

Scholarships are also given in support for the anti-drug campaign. The budgets of

which are being increased. In order to help the students and pull them away from illegal

drugs. Because if he or she does not have a thing to do, it might be because of curiosity

that the child will succumb to illegal drugs. And in the future, if he or she has not finished

his or her studies, he or she will not be able to or find it hard to acquire decent jobs. Which

would result to them being dependent on illegal drugs.19

Education is the key. Supporting education hits 2 birds in one stone. It ensures the

future of the child to be successful and at the same time, it pulls the child away from doing

or being involved with the illegal drugs.

Political Profile

Political History

Dagupan city has started of with appointed Captains of Dagupan. Before,

Captains were equivalent with mayors today. The First Captain was Don Francisco

Arzadon.20 Dagupan city like any others have used to be a municipality. It was only on

1947 that Republic Act 170, also known as the city charter of Dagupan, which was signed

by President Roxas, mandated Dagupan city to be an independent component city. That is

why from Hon. Jovellanos up to Hon. Fernandez Sr., they were called not as a city mayor

but as a municipal president and also, vice mayors were then called as municipal vice

mayors.

List of Presiding Officers

The Presiding officers are usually the vice mayors. During his or her absence,

someone from the Sanggunian will take over. If the Vice mayor is on leave, or not within

the jurisdiction of the Republic of the Philippines, automatically, the first councilor will

take over. However, if he or she is just absent and still within the bounds of the territory

of the Republic of the Philippines, the sanggunian will vote on who will be the presiding

officer of the day. His or her job is to make sure that everything is in order, that the laws

are being followed and that in case of a tie, he or she is supposed to break it.

In the case of Dagupan city, they have a Pro tempore officer and an assistant pro

tempore so that their errands will not be distracted and they would not waste time. The

Pro tempore is being elected every first meeting along with their different positions in the
council21. They elect in in order for them to not have a problem anymore when it comes

to the presiding officer not being present. However, if all of them, the presiding officer,

pro tempore and the assistant pro tempore is absent, then that is the time that the council

really needs to vote on who presides for the day.

As stated above, any of these councilors can be the temporary Presiding officer if all the

vice mayor, Pro tempore and deputy pro tempore are absent.

Notable Executive Issuances

The city of Dagupan has initiated various programs which aimed at enhancing the

City. Most of these are created to become a competitive city. Additionally, some of which
are created to keep up with the rapid modernization that the world continually experiences.

Some notable executive issuances are as follows.

Removal of fish pen

Dagupan city’s main industry is fishing. It has 2 main beaches, Pugaro Beach and

Tondaligan Beach. It has 4 main rivers including Agno, Toboy, Dawel and Tanap. The

problem is that majority of over 900 plus fish cages of fish pens are not owned by the

Daguenos. They are owned by the wealthy businessmen from other localities. This is the

number one pollutant of the river. In addition, if the river dies, it might be hard for Dagupan

city to get back up and earn its title as the “Bangus Capital of the World”. 22

Although it is a political suicide, the chief executive insisted for the removal of all

of the fish pens and removal of its debris until the river recovers. Today, because they did

not want these small fishermen to be deprived of their own livelihood, they are permitted

to build a 7x10 M fish pen. But the permits are given to them personally so as to avoid the

selling of permits.

There is also the “bantay ilog” which makes sure that the waters are clean. Within

the Pollution Officer’s jurisdiction is the bantay ilog which is supposed to keep and sustain

the river from being free of trash, free form illegal fishponds. Additionally, by feeding the

fish so much, it kind of saturated the water. This is the reason why the government has

mandated to limit the number of fishponds in the river.23

Waste to worth

Dagupan city has come up with its own Pollution officer which is in charge of

taping the barangay officials when he sees some problematic areas in the barangay’s

jurisdiction. He will be working with them hand in hand and sit down with the barangay

council and address the pollution; on determining what should be done. Aside from which,

there is also an appointed task force which takes cares of the garbage. They are also called

the “basura patrol” wherein they let the barangay take care of their own trash.

This program aims to know where the trash will go or what happens to the trash

after.24 Aside from the congestion of plastic into its smallest sizes, Dagupan city has

entered into a partnership with the Sure Global Corporation; this will help the city recycle

the trash. The city entered a joint venture with the aforementioned company in order to

recycle the trash more efficiently and more useful.

What will happen is that, every day, the city needs to collect at least 30 tons of

trash. As soon as the facility arrives in Dagupan city, the facility will recycle these items.

By feeding the facility with trash. In return, the converted trash or waste by the facility will

come out as a diesel. It does not only help solve the “Basura problem”, it will also help the

city be more profitable using their trash collections. This aims to end the 50-year old

problem dumpsite problem which the government has continually been finding solutions

on.

The city mayor, as soon as she sat down and assumed the position, has prioritized

to find ways to solve the 50-year dumpsite problem25. On 2013, she has started to work

and establish the waste facility which aims to recycle the long overdue problem of the

dumpsite. Since her invitation to Chile, United Nations and Asia- Pacific Economic

Cooperation, she has persevered to find long-term solution to the city’s waste problem.

Part of the plan was to address the city’s waste problem in relocating 30 families living in

the dumpsite along with the construction if a Day care center and a health center in the

area.

Notable Legislative Ordinances

The Comprehensive Land Use Plan

After 40 years, the comprehensive land use plan has finally been updated. It has

strategically subdivided the land area into uses which perfectly fit the location. This is in

order to identify the safe and hazardous areas. Nowadays, diverse investors come in

Dagupan like the Filinvest. We need to identify what use would best fit the land area in

Dagupan. We should identify the most strategic location for housing or residential areas

and what areas are not advisable in building homes. The residents must be as far away from

the beach as possible to avoid the impact of tsunamis or storm surges. Yes, having a

beachfront is beautiful but we need to take into account the safety of the residents first.

And in the beach areas, in order to lessen the impact, various trees must be planted like

coconut trees.

In the case of Dagupan, the one of the most utilized land area is the commercial

area in downtown26. However, recently, they have identified that the Land at the Judge Jose

De Venecia Extension is a strategic commercial area. Now, they will transfer the city hall

away from the downtown. It is headed to the Judge Jose De Venecia Extension in order to

acquire more space for businesses. Soon, that place will be the commercial area of Dagupan

because it provides more space for the businesses.27 Hence, the economy of Dagupan will

have nowhere to go but up.

However, as soon as this news broke out, the citizens got mad and they bashed the

city mayor because it will be away from the civilization. And, additional information, there

are no Public Utility Jeepney that directly passes by or have the route towards that place.

However, the government stood by its decision and are set to transfer the city hall in order

to solve the congestion of the downtown.

Every land area counts. Another importance of this land use plan is to discover

hidden land areas which could potentially be new roads. Every land area should be

maximized. Who knows, that hidden road might open new routes that would be a solution

to the traffic problem or it could provide shortcuts towards other localities. But one thing

is for sure, no land area has no significant use.

Moreover, because of this, it could open new schools or hospitals which would be

of great benefit of not only the Dagupenos but also with the whole Region I. This could

house new social services which Dagupan city would surely be proud of. Lastly, Dagupan

city is near many places. It’s strategic location and what it has to offer has attracted many

visitors.

Furthermore, Dagupan city becomes a stop over to the visitors travelling to, for

example, Baguio city. Many people are there but not for the purpose of touring the town

but for entering businesses or transactions. It has one major city plaza, which was not

rehabilitated for years. Accordingly, Dagupan city must first have its own project for

recreational purpose which would advertise the city. The city should have parks like the

burnhum park of Baguio city and not a nearly abandoned plaza. Although, the city has

been rapidly evolving or developing, these concerns must also be addressed. Because,

people come back to places where they left or shared memory with someone. So as to

attract the visitors, the city must plan and sustain more recreational places.

Traffic lights Code

Dagupan city has long operated its traffic system without traffic lights. This is

installed in order to catch up with the modernizing world ahead of the city. In addition, if

studied carefully, this would have a long-term effect on the city28. It will be a sustainable

development. It is not only there to serve as an accessory to the city. It actually decongests

the traffic problem. It provides a long-term solution and not a short term one.

In line with the installation of traffic lights, the citizens have again burst out their

sentiments to the mayor. Especially those of the Public Utility Vehicle drivers who are not

used to with the traffic lights. At first, it was really hard because these drivers did not know

the basic know hows of the implementation of the traffic rules. They also complain because

these traffic lights are the ones causing traffic jams. However, as time goes by, and because

of the continuous study and supervision of the government, the people or the citizens have

adapted with the new traffic light system.

Additionally, because of Dagupan city’s growing industry and businesses, it will

not be long until the streets would be as busy as in metro manila. So, this traffic code

already solved the problem that Dagupan city would be having. Without it, the roads would

be prone to accidents because there are no rules to be followed; they could do whatever

they want in the streets including them racing with one another and at the same time,

corruption among the POSO will be unavoidable because there are no concrete rules to be

followed.

Main Political Concerns

The Preservation of Water

Dagupan city is a first class, independent component city which has been the

business center of the Region I. Although there have been various ways to help preserve

the environment and sustain development, it is kind of alarming that the city has been

dumping land on the water for the purposes of modernizing and reserving spaces for future

investors.
However, the concern is that the bodies of water is slowly disappearing and

becoming a part of the land area. In the future, this might have an unforeseen damage,

which might result to drought.

Political Parties

Upon assuming the position, it is duly assumed that the political parties will not be

that much of an issue anymore. Upon being elected, it is assumed that they will turn their

backs and serve the people. It is assumed that their priorities would be the service for the

people. However, this is not the case for some politicians. Not just in Dagupan city but also

in other Local Government Units. The elected officials sometimes prioritize the political

parties’ general interests and compromise the cities’ needs29.

One case raised is that when one, take for example, one councilor steps down at the

end on his or her term. Assuming that he or she has a really good and sustainable project

or advocacy, the tendency is that the next councilor who would replace him or her, no

matter how novel his or her programs or advocacies are, will not continue the project just

because they have different political parties. The citizen’s or city’s welfare must come first

as their top priority among anyone or anything else.

Another case is that sometimes, when the incumbent councilor or vice president is

not in the same political party than that of the mayor, the tendency is that they will not

support the projects of one another. Or in worst cases, tend to make effort on how to bar

the project from continuing. This is really wrong because they are there, on that position to

serve the people and not their political parties or their own personal goals. They have to

scratch their own political parties and make ends meet with the one another in order to

achieve the goals for the betterment of the city.

More Education for the Electorate

The electorate today has been so used with the system of corruption. Most of them

just simply do not care about the city’s welfare. Despite the figures shown to them; on how

little their values will be once the candidate assumes position. No matter how much experts

persuade them using facts, they just wont listen and still opt to vote for the candidate who

practices “Vote Buying” or in pangasinan “pakurong”.

They got so used to the system in that they will only comply once they have been

paid. Most of the politicians are pushed to do corruption because they have nowhere else

to get the money to give to the people.30

Another practice of the people is that no matter how the candidate tries to explain

his or her platform, no matter how much he or she tries to instill to the people that he or

she genuinely wants to serve, the people would not remember his or her name, unless he

or she gives a compensation for their votes. Because of this costly price of having the

chance to serve, there is a very seldom chance that you would see a person who wants to

serve without receiving or putting his or her general interests first.

ECONOMIC PROFILE

MAIN SOURCES OF REVENUE

Dagupan city, being the business, financial, banking and training center of the north

mostly gets revenues from various businesses. In Dagupan City alone, there are more than

50 banks. All media outlets, radio stations, TV Programs are housed in Dagupan city.

For the government, their main sources of revenue come from private businesses’

tax collection and market collection. Internal Revenue Allotment (IRA) comes from the

national government. Another is retail and wholesale market because Dagupan city is the

Retail and wholesale capital of region I. That is why many people from different localities

travel and go to Dagupan to sustain their businesses in their own places. Additionally, the

government also profits from the Overseas Filipino Workers and the Employees based in

or are currently residing in Dagupan City.

It could be inferred from the table above that although there was the absence of

the business tax, it is not solely dependent on IRA. IRA is not the main source of

revenue.

MAIN INDUSTRIES

Being the Bangus capital of the world, Dagupan city is well known for its unique

bangus or milkfish taste. It has been known to produce delicious bangus in volumes as well

as export in in other countries. Although, it is not only limited with bangus production.

Dagupan city also produced Baguong, Malaga, Prawn, Oysters, Tilapia and others. This

proves that the main industry of Dagupan city is in the fisheries.

MAIN ECONOMIC CHALLENGES

The main economic challenge would be keeping Dagupan as a competitive business

friendly city. Dagupan city has already established its name in the industry. And when it

comes to maintenance, when it comes to sustaining development and keeping Dagupan

city’s current stance, it would require money. Currently, from number 54 or 57, Dagupan

city is now number 11 in over all competitiveness in the whole Philippines. 31

Making sure that the business partners do not go would mean that Dagupan city be

maintained. And maintenance requires a lot of money. Especially because the government

is maintaining a competitive and urbanized city. From time tto time, the infrastructures and

roads must be improved.

Moreover, Dagupan city is also awarded the Seal of Good Local Governance

(SGLS). This is when local government units pass some certain standards and be given

some incentives or additional funding from the national government. In line with this, the

government needs to maintain the city this way because it is already making its way to the

top and it would be such a shame if it would go back to how it was before. In this case, it

needs more funding to sustain and improve the delivery of services and infrastructure.

Additionally, the government to business transactions must be fast. It must avoid

any delays. Plus, the investment and development board, where various departments are

put together when an investor or businessmen applies to the city. This is when all the

departments will have a meeting in one sitting in order to avoid one department being

corrupt. This is an effort to avoid the red tape or corruption. So that when one department

wants to be corrupt or wants to do something suspicious, he or she will do it in front of all

the other departments. In return, he or she will be reprimanded by the administrator.


Chapter 4

Meeting the Chief executive

How does the chief executive use the provisions of local government code to the

advantage of the Local Government Unit?

The Chief executive ensures to maximize the local autonomy vested upon the Local

government unit. With this, they create ordinances and issuances that is beneficial for the

localities of Dagupan City. They use their power of local autonomy as a tool that empowers

them to serve the people and deliver social services. The local Government code directs

and at the same time limits what they can and cannot do as a local government official.

They also use some specific provisions made in the local government especially regarding

the fiscal powers devolved to them. 32

What is the most advantageous provision the LGC to spur and sustain development

in the locality?

The most advantageous provision is the decentralization if powers vested by the

local government code to the local government units. Because of that provision, they are

able to act on matters concerning them. They are able to fix or find solutions on their own

without the need to go to the national government. The local government code clearly laid

out the specific functions of each officials in order to avoid overlapping of duties and

responsibilities.33

Another most advantageous provision of the local government code is their taxing

powers. Nowadays, the government, no matter how good it performs, cannot act without a

designated budget. Projects, infrastructures and rehabilitations innovate the cities. With

that being said, the taxing powers of the government plays a crucial role. The IRA share of

each Dagupan city is not sufficient enough to fund all of the projects and infrastructures

which make Dagupan city what it is today. Because of this taxing powers, considering how

lucky it is that Dagupan city is the business center of the north, they were able to collect

more fund which is to be used on rehabilitation and sustaining development in Dagupan

city.34

What are the short comings of the code insofar as:

Peace and order

The mayor mentioned she was appointed by the former President Benigno

“Noynoy” S. Aquino III as the Regional director for peace and order. Although in a city,

Automatically, the mayor would be the chairman for Local peace and order. During this

time, Gov. Aimee Marcos is appointed by the current President Rodrigo Duterte; she was

also endorsed by the Region I local chairmen.

She mentioned that she does not seem to have any problem with regard to

provisions of the local government code in o far as peace and order is concerned. Whenever

confronted by a problem, she sees to it that she always finds a way or a solution without

trampling what has been stated on the local government code. Although sometimes, there

is a problem with regard to coordination with the local government and the national

government because of the intricate process. There is a slow coordination with national

and local government units.

She mentioned as well that the big problem really lies beneath the implementation.

The problem is with the designated people who are mandated to implement such programs.

Because if one lays down ten good ordinances, but the implementation stage is not efficient

enough, then everything is useless. Moreover, the mayor stands firm that the success or

failure of a program lies within or will be determined during the most crucial

implementation stage of a program. 35

Moreover, one needs to sustain peace and order in order to attract the investors and

at the same time make them stay in your place.

Economic stability

So far, the economy of Dagupan city is stable because of the ample amount of funds

being collected in taxes and other revenues. Additionally, there is the IRA share of every

local government unit. Not only does those cater to the needs of the people. They also

bridge the way towards modernization and development in Dagupan city. Dagupan city

being an independent component city, means that it has the capacity to stand on its own

and at the same time, spur economic growth, with the help of it being the business and

commercial center of the north.

Although, she mentioned that the slow issuance of permits also sometimes hinders

the economic stability. Because of the lack of coordination within the people behind the

issuance of permits, the investor might back out because of the long and intricate process.

The mayor cited a scenario wherein the city must be thankful of the investor but instead,

the people responsible for obtaining permits repays him or her with long waiting time and

lack of coordination. If one is an investor, who experiences these kinds of trouble, one

might re consider investing on other locations.

One instance of delay cited by the mayor is when she called for a meeting on all

the NGOs. She asked them if there are ways in which she could help. The all raised their

grievances on the slow coordination of the Fire Department, as a result, all of their errands

and businesses have been delayed. Because before the people could go and obtain permits

on the one stop shop, they must first obtain clearance from the fire department as a result,

the person was extracted due to delay of services.36

Sustaining economic development

To make this sustainable it sustainable, the administration help and at the same

time support them for the nets and bamboos. This is somehow connected with above

mentioned peace and order. One needs to sustain peace and order in order for investors to

come in. From fishermen, to vendors, to students, to health care, everything must be in

order.

Although another problem is that in sustaining all of these, from peace and order

up to economic stability and development, one needs budget. The funds sometimes are not

adequate enough to pave way for all of these advancements and maintenance of

developments. Right now, Every Dagupeno enjoys the right and advantage to free medical

assistance including free CT Scans and free ECGs. When one is economically challenged,

the mayor stated that she will personally pay for it.

Additionally, the Chief executive said that with all of these efforts, she believes and

at the same time experiences that the investors are on the way. Because when one is an

investor, the top priority is the peace and order and sustainability of all the developments

present.37

Allowing local governments to decide matters affecting them

One time, she had a problem with an appointed officer because it seems that he

does not respect her and at the same time, seems that he had an agenda which is different

from hers. She did not have any power which would allow her to remove that official

because he has been appointed by the national government. So, she sought help from the

Regional Director of Peace and order, Gov, Aimee Marcos to help her find a solution for

this problem.

What happened there was that she had a hard time on working with the official,

which made it difficult for her, delivering proper services. In connection, one still needs

the help of national government. Although they only have been vested the supervisory

powers, they could somehow influence the decision of other people or, in this case, the

local government unit38.

Delivery of Social Services

The mayor said that she did not see any problem because the Dagupan city alone is

empowered when it comes to delivery of Social Services. Other localities might have but

it is the least concern of Dagupan city. However, sometimes, the problem with

empowerment is that you need financing in order to empower.

Sometimes, the allotted budget is simply not enough to cater the needs of people or

the development. This empowerment needs to be backed up by ample amount of budget.

Recommendations for the local government code:

In her part, whenever she is not able to do something, she always sees to it that she

would find ways in order for some project or conflict to be resolved or pushed through.

The local government code is just there to supervise or to guide the Local government unit

on matters which concern the LGU. The very crucial part really is the implementation stage

because it will determine whether or not the project or program is a success. The Local

government code is actually a good law. The mayor contends that it is up to the chief

executive to make his or her platforms effective. It is up to him or her how he or she will

handle the situation in case there is an unforeseen circumstance. Because in her office, they

always make the work done, no matter what; they think of possible solutions or

alternatives. 39

How do they cope up with the short comings of the law?

As what have been stated above, they do every means possible. They maximize

their tax collections and get the work done efficiently in Dagupan city. When an officer or

an official is not doing his or her job, then they need to remove him or her because they

cannot afford to delay the process because it would be a domino effect on the part of

businessmen or investors.

The mayor’s office, whenever confronted by an unforeseen circumstance seeks to

find ways on how to solve the problems, in accordance still with the local government

code. With regard to coordination with the national and local government units, they need

to follow up their request every time. However, in times of crisis, they seek to for help on

the higher authority like in the case of seeking the help of Gov. Aimee Marcos.40

MEETING THE PRESIDING OFFICER

How does the chief sanggunian use the provisions of the local government code to the

advantage of the LGU?

Every ordinances or laws crafted are in accordance with the local government code.

Aside from the fact the Vice mayor, together with the sanggunian are given the power to

craft their own laws, they also get to regulate things within their jurisdiction.

There are several ways in which an ordinance is crafted. The priority of the

executive is the immediate concerns of the people or the city. This is usually the general

agenda of the meeting when an ordinance is to be crafted. This is the standard agenda of

the sanggunian and the presiding officer. Another is that whenever an issue arises which

needs immediate action. This is not originally a part of the agenda but it could be once it is

a pressing issue and needs to be addressed immediately. Next is the needs of the executive.

All of these three makes the list of the agenda whenever there is a meeting for the crafting

of new laws. 41

What is the most advantageous provision the LGC to spur and sustain development

in the locality?

The freedom to legislate is the most advantageous provision of the LGC to spur,

sustain and allow for the development. According to the presiding officer, the Local

Government code is a good law. It provides local and territorial autonomy.

The local government because of the power vested upon them to collect taxes may

increase their collection which could be their own budget or funds. Some sources of which

are income, revenues and taxes. Also provides a system of checks and balances with the

executive and legislative.42

It also provides for a system of checks and balances within the executive and

legislative. This will further avoid corruption and at the same time, the two branches can

recommend ideas with each other for the betterment of the policy or program. In addition,

the approval of budget is up to both branches. The Legislative body will check every cent

of the budget passed by the executive for approval. However, the legislative body only has

the power to reduce or completely remove a portion but not add. They have no power to

add more budget on a certain project but they can remove or completely delete a provision

on the budget.43

What are the short comings of the code insofar as:

Peace and order

One problem seen by the presiding officer is that as much as they wanted to add more

penalties to the violators, they cannot. There is a certain amount or rather maximum amount of

fine for violators. The maximum penalty is P5000. So, if one violator can afford the P5000 fine,

then he or she would continue to violate rules. And as for imprisonment, the maximum is 6

months. So, how will they learn? People think that it will be okay to do such for the provisions are

too low. The penal provisions are too low for the councils to approve.44

Economic stability

The presiding officer contended that they would be able to do more if they had

more fund. They can be more efficient if they had more budget.

The presiding officer also argued that the IRA being collected comes only from the

BIR. What about from other agencies that remit their collection directly to the national?

Take for example the LTO, they impose fines on the violators and directly remit it to the

national government. The Local Government Code has set the IRA sharing too low. She

added that the shares of the national government are too big but their functions are merely

oversite functions for the local government units. 45

She also mentioned that she became the president of the Philippine Councilors

League and that they were lobbying for higher IRA shares. Because it was really set too

low. The maintenance or the rehabilitation of the area would make sure that the

businessmen or investors would not go anywhere and continue being a business partner.

With that being said, then the government needs more funding. So, it would really help if

they would give the LGU a share on the other revenues being collected. Take for example,

Boracay, the share they remit is bigger than that of the share that they receive from the

national government.

Sustaining economic development

It depends on those who sit. Because no matter how much one would implement

projects and encourage people to establish businesses in the city or encourage investors to

enter, if the people there just sit and put the money on their pockets, then there will be no

improvements.46

Allowing local governments to decide matters affecting them

The presiding officer reiterated on the fact that they have no subpoena powers.

They have no power over the person if he or she does not go to the hearing when they

call him or her to ask some questions. So, basically, the person has the liberty to decide

whether or not to go to the hearing because the council cannot do anything about it. He or

she could delay everything that the council has planned for the day.47

Delivery of social services

It stresses the power of LGUs to create laws and ordinances for marginalized

sectors. It is clearly stated what is for the people and what is for the LGU. However, the

problem is that sometimes, the intricate processes delays the task that could be done within

a day.48 In addition, the people in charge there would tend to be slow. So everything is a

domino effect.

How do they cope up with shortcomings of the code?

They simply make the most out of what is given to them. Since the Local

Government code has delineated their specific tasks, it would be easier for them to

determine whether or not they are doing their jobs. In addition, they also make the most of

what has been given to them as an additional source of income and revenue. 49

What are their recommendations for improvement of the LGC?

The Presiding officer contends that it is about time to amend the LGC. Because it

is the changing time and the LGC is too outdated. They need to include those suggested

powers in order for them to be more efficient. In addition, to be more efficient, the DPWH

should devolve their powers to the LGC because the process is too long and it delays

everything. Lastly, they must amend the IRA share computation. The LGU must have

bigger shares and the other sources of revenue being directly transmitted to the national

government must include shares on LGU.50

How does the Local Government Code ensure professionalism of the bureaucracy?

They follow the standards that are stated in the LGC as to who should be appointed

in this particular position and what specific years of experience must this person have. They

also need to be civil service eligible. They also look at other laws like the anti-red tape law

and civil service laws to complement the LGC in order to ensure professionalism in the

city government. 51

Are these requirements somehow elitist? No. They are being paid by the people and

we cannot afford mediocrity. In fact, these requirements are not even sufficient enough.

Some requirements must be added because the people deserve the best. They deserve the

best because they pay for their salaries.

What are the strengths of the Local Government Code insofar as it ensures the

delivery of services to the people?

The central government gives incentives to good performers. To those cities who

have reached the benchmark of their standards. They are awarded with the SGLG or the

seal of good local governance which is coupled with incentives, financial incentives.

How does the supervision of the central government help or burden their locality in

the delivery of social services?

According to her, so far as incentives are concerned, it does not burden the local

government. However, when the approval of specific projects is concerned, then yes, they

hinder and make the process too long. They delay the process. Instead of accomplishing

one thing, the government is stuck because the permits. The fact that you still require

permission for a very relatively small value then that shows that there is a problem with

regard to coordination. 52

FINDINGS AND ANALYSIS

Is the Local Government Code sufficient in catering to the needs of the specific LGU?

Yes. However, this answer depends on who is at the seat of power. Because in the

case of Dagupan, as mentioned above, they find every means just to for the sake of the

project to push through.

Biggest Advantage of the present LGC

The catch all phrase as stated by the City administrator is the section 16, general

welfare of the local government code is the biggest advantage for the City administrator’s

office because with that, they have the ability and chance to craft different laws and

ordinances especially in providing basic social services for the people

For the mayor, the local autonomy and fiscal decentralization is the biggest

advantage of the LGC to the LGU. Because, without these, the LGU and the would be

paralyzed. No matter how good the crafted ordinances or laws are, if there are no budget,

then the LGU cannot maintain its economic development and at the same time, it will be

chaotic. It will not be able to maintain peace and order.

The presiding officer has contended that the most advantageous provision is that

the LGU has the Local autonomy to decide on matters on their own as long as it is in

accordance with the local development code. However, among all of them, the presiding

officer stands firm that the Local government code is out dated and that it needs to be

amended for the betterment of the society with regard to delivering services and with what

powers must the LGU have in order to be more efficient.

CONCLUSIONS AND RECOMMENDATIONS

Conclusions:

Basically, Dagupan city has made its way to the top. It can stand alone and at the

same time prosper. The current administration is doing well. In fact, as a resident, the writer

has experienced the changes with regard to the environment as well as the development of

infrastructures. It can also be inferred that Dagupan city is a competitive city because from

57, it is now number 11 nationwide from being a competitive city. Dagupan city, being an

independent component city in Pangasinan is the banking, commercial and training center

of the north.

Major schools are located inside Dagupan. It also houses major health care services.

It also is the retail and wholesale capital of Region I. So, it does not mean that Dagupan

city has a high cost of living just because it is an urbanized city. That place is ideal for it is

an urbanized city and at the same time, it still embraces its culture of being a conservative.

Moreover, one can receive high quality services even when the standard of living is not

that costly.

Recommendation:

The writer recommends that the current administration continue to build

infrastructures as it is a pre-requisite of a city being a business friendly and competitive

city. However, the environment, even with all of these modernizations must not be

compromised. They must always take into account the future of Dagupan city. On how

they could sustain these developments up even when they step down from the position.
