United Nations Human Rights Council,

Deeply concerned with the deprived rights of Kurdistan in their respective state,

Deeply conscious with any prejudice and negative stigmatization toward Kurdistan in
their respective states,

Deeply convinced with collective actions resulted in UNHRC based on R.E.P.E.A.T.


approach,

Reaffirming the Universal Declaration of Human Rights and the International Covenant
on Civil and Political Rights,

Recalling The International Covenant on Civil and Political Rights and, in particular,
article 27 inspired the contents of the United Nations Minorities Declaration, which
stipulates an obligation from states in which ethnic, religious or linguistic minorities
exist, persons belonging to such minorities shall not be denied the right, in community
with the other members of their group, to enjoy their own culture, to profess and practice
their own religion, or to use their own language, followed by The Human Rights
Committee’s general comment No. 23 (1994) on the rights of minorities provides an
authoritative interpretation of article 27,

Recalling the International Covenant on Economic, Social and Cultural Rights mentions
explicitly in article 2 (2) that “the States Parties to the present Covenant undertake to
guarantee that the rights enunciated in the present Covenant will be exercised without
discrimination of any kind as to race, color, sex, language, religion, political or other
opinion, national or social origin, property, birth or other status.” Followed by General
comment No. 14 (2000) of the Committee on Economic, Social and Cultural Rights on
the right to the highest attainable standard of health states that health facilities, goods and
services must be within safe physical reach for all sections of the population, especially
vulnerable or marginalized groups, including ethnic minorities,

Taking notes the existence of conflict within the territory of Kirkuk, and 79.000
displaced Kurdish in Kirkuk,

Noting with deep concern the number of casualties of Kurdistan in their respective states,

1. Affirms the principle of non-discrimination. Prohibiting any distinction, exclusion,


restriction or preference which has the purpose or effect of impairing or nullifying
the recognition, enjoyment or exercise by all persons, on an equal footing, of all
rights and freedoms;
2. Requests cooperation with UNSC for Iraq and Kurdish to perform peace talks or
dialogue in order to reduce tense between both parties and ensuring an adequate
solution for Iraq and Kurdish. The approaches to perform peace talks or dialogue
are:
a. Both parties shall appoint one representative to perform peace talks;
b. Peace talks or dialogue shall be performed one week after a resolution is
being resulted;
c. The location to conduct peace talks or dialogue shall be agreed by both
parties;
d. Peace talks or dialogue shall be performed in good faith;
e. Other than peace talks, Iraq and Kurdish might be perform mediation or
conciliation;
f. Mediation shall be proceeded with the involvement of third party (states or
international organization representative) that being decided by both
parties consent;
g. In order to perform conciliation, third party shall provide their “good
office” in order to ensure the negotiation goes well;
h. Subject matters for the peace talks shall be include but not limited to:
i. Integration of Kurdish in Iraq;
ii. Peace agreement; and
iii. Hope to find a well-defined federal structure or confederation;
iv. Win-win solution for both parties;
3. Encourages states to perform raise awareness action in order to fulfill several
objectives such as:
a. Rebranding Kurdish in their respective states with the fact that they consider
as the vulnerable groups that need to be protected;
b. Raise awareness also useful to encourage NGOs, civil society organizations,
private sectors to cooperate with UNHRC to help UN implement the solution;
4. Further encourages remove any negative stigmatization toward Kurdistan in their
respective states which includes several actions but not limited to:
a. Campaign;
b. Seminar;
c. Socialization; and
d. Social media influence;
5. Emphasizes for a basic tool for empowerment, targeted awareness-raising
activities could make a difference in the promotion and protection of the rights of
minorities. A wide variety of innovative approaches can draw public attention to
their situation. To this end, it might be useful to consider:
a. Preparing informational materials, including in different languages, and
disseminating them widely;
b. Developing campaigns using international days, such as 10 December,
which is Human Rights Day; and
c. Supporting activities for training/capacity-building and outreach,
including for representatives of minorities;
6. Proclaims Cooperate with UNHCR to address and allocate the marginalized
people of Kurdish that is being displaced. Also to give humanitarian assistances
such as but not limited to:
a. Allocating Kurdista to the safer area, which will be decided by UNHCR in
accordance with their mandates as the short term solution;
b. Giving Kurdistan medical assistance as the short term solution;
c. Strengthening the framework and the implementation on the law of
protection on the refugees as the long term solution;
d. Strengthening the law enforcer in upholding human rights in the Kurdish
destination states;
e. Providing education, health care, security, and sustainable place to live to
the Kurdish;
f. Cooperate with other UN specialized organs and INGO who addresses the
issue of Kurdish;
7. Expresses its hope for the United Nations of Human Rights Council shall
sustenance the effective participation of Kurdish people by ensuring:
a. The promotion of their participation in decision-making through inclusion
in public and political life, at the national, regional or local level,
particularly through advisory or consultative bodies;
b. Participation in electoral processes;
c. The promotion of their participation in cultural decision-making bodies or
religious advisory bodies;
d. Their participation in the sharing of the benefits of development and
economic progress on an equal footing with the rest of society;
e. Affirmative action programmes are in place to increase access for persons
belonging to minorities to jobs and internships or fellowship programmes.
8. Affirms This council shall conduct numerous efforts that should be made, such as
but not limited to:
a. Ensure access to the United Nations Human Rights Council work by
minority groups, including by making information available in minority
languages;
b. Ensure the participation of persons belonging to non-dominant groups in
programme planning and analysis of situations of Kurdistan;
c. Assess the efficiency of existing consultation mechanisms before
establishing new ones;
d. Promote joint initiatives with minority organizations, when possible;
e. Facilitate collaborative efforts and better coordination as much as
possible;
9. Trusts fund raising for the fulfillment of the implementation of the solutions, this
council shall cooperate with UN Specialized Organs such as World Bank, UNDP,
and IMF. And the fund that is allocated shall be informed to an annual report of
United Nations Human Rights Council;
10. Further trusts involving the local NGOs to ensure the fund allocated well. In
order to ensure the funds will be allocated well, United Nations Human Rights
Council shall perform monitoring assistance to the states that being funded. Local
NGO also need to inform their activities and contribution to the Kurdish monthly;
11. Recommends Iraq to allow UN Office of High-Commissioner for Human Rights
to access the affected area such as Iraq to deliver humanitarian assistance. The
Humanitarian assistance are such as and limited to:
a. Rebuilding facilities such as: School, hospital, building, and houses;
b. Cooperating with local NGOs that has a consent which upholding the rights of
Kurdish.
