Minutes of the New Hutton Parish Open Meeting on Wednesday 15th May 2019 at the Institute

1. Declarations of Acceptance of Office, Declarations of Financial and Pecuniary Interests and Election
Expenses Returns were received from parish councillors.

2. Martyn Welch was re-elected as Chairman of New Hutton Parish Council for 2019 to 2020 and his Declaration
of Acceptance of Office was received (proposed by Pat Bell, seconded by Henry Robinson)

3. No issues were raised by parishioners.

Minutes of the AGM of New Hutton Parish Council on Wednesday 15th May 2019 following the Open Meeting

3. Election of the Vice-Chairman of New Hutton Parish Council for 2019 to 2020
It was decided that a Vice-Chairman is not needed.
4. Minutes of the last AGM held on the 26th April, 2018
These minutes were confirmed to be a true and accurate record on 20-08-2018.
5. Chairman’s report for 2018/19
The year has been an interesting one for the Parish Council with a few issues being quite noteworthy. A number of
planning applications have been reviewed by the Parish Council during the year. However, the re-application to site a
gas-fired power station adjacent to the existing National Grid Substation in Old Hutton caused much concern amongst
New Hutton parishioners. The Parish Council (amongst others) then spoke against the proposals at the SLDC
Planning Committee meeting and the application was turned down. I believe that the timescale for the applicant to
appeal has now expired.

The condition of road surfaces has been an issue that many parishioners have been concerned about. During the year
there have been a significant number of potholes repaired and a number of roads re-surfaced completely.

The Parish Council has been actively involved in supporting the extension of the B4RN broadband network throughout
the parish by the local B4SW group of volunteers. The main thrust of the project was completed in November 2018
and it is now providing broadband services to most of New Hutton’s residents and businesses.

United Utilities continued their liaison about their replacement of a section of the Haweswater Aqueduct that runs
through our parish. Work started early this year and is very significant indeed resulting in disruption for around two
years whilst it is carried out.

Here’s looking forward to an interesting year ahead.

6. Review and adoption of appropriate standing orders and financial regulations


Revised standing orders were adopted on 20-11-2013; financial regulations were adopted on 04-05-2016.
7. Review of inventory of land and assets
The values of the items on the inventory of assets were reviewed [see the document on the parish website]

8. Review and confirmation of arrangements for insurance cover in respect of all insured risks
a) The parish council currently has the standard policy from Zurich Insurance (premium £257.60) for the period
13-10-2018 to 12-10-2019
b) The replacement values of all items on the assets list were reviewed for insurance cover.

9. Review of the Council’s membership of other bodies


a) These are CALC [current subscription £131.68] and the Upper Kent Local Area Partnership [no subscription].
b) Pat Bell and Henry Robinson agreed to continue as Parish Council representatives on the New Hutton
Lambrigg Wind Farm Funding Committee.
c) Kath Twist agreed to continue as the Parish Council representative on the Armistead Wind Farm Funding
Committee.
d) Martyn Welch agreed to continue as the Parish Council representative at the Upper Kent LAP meeting. SLDC
has reduced funding to LAPs to one meeting per year. However, the parishes in the UKLAP want to continue
to meet, organising themselves, and SLDC has agreed to this.

10. Review of the Council’s procedures for handling requests made under the Freedom of Information Act
2000 and Data Protection Act 1998

None has been received.

190515-3 Acceptance of the minutes of the previous meeting


The chairman signed the minutes of the parish council meeting held on 11-03-2019 as a true and accurate record [see

190515-4 Chairman’s announcements


a) The public inquiry into the disputed right of way at Old Croft was completed on the 1st May. The result will not be
known for two months or more.
b) The annual survey of road problems on all the parish’s roads has been completed and sent to CCC Highways.

190515-5 Declaration of interests


Martyn Welch declared an interest in the planning application SL/2019/0367 in item 7a and left the room during
discussion of it.

190515-6 Open session


a) It was reported that the parish’s notice boards need some maintenance work to be done on them.
b) A parishioner has pointed out that two of BT’s broadband chambers between the Institute and the A684 have
long wires poking out of them which could rip tyres. Also, the installation of the duct has destroyed a tile drain
under the edge of the verge and this has increased flooding of the road and the washing of soil onto it. These
issues will be reported to CCC Highways.

190515-7 Planning applications


a) Applications submitted requiring council comments:
SL/2019/0339 - Single storey extensions to the existing amenity building at Killington Services. The Parish
Council had no objection.
SL/2019/0367 - Demolition of the rear porch and detached garage, erection of a single storey rear extension
and detached two-storey garage/workshop at Paddock View. The Parish Council had no objection.
b) The progress of the following application was noted:
SL/2019/0190 – Removal of a hedgerow near Millriggs. The Parish Council had no objection to this
application.

190515-8 Payment of accounts


Payment of the following amounts was authorised:
£131.68 – to CALC for the 2019/20 annual subscription
£90.00 – to MBE Accountancy Ltd for the 2018/19 internal audit

190515-9 Financial report


a) The Annual Internal Audit Report 2018/19 was approved (proposed by Pat Bell, seconded by Henry
Robinson) [see the website]
b) The Annual Governance Statement 2018/19 was approved (proposed by Henry Robinson, seconded by Hazel
Hodgson) [see the website]
c) The annual accounts including variances and bank reconciliation were approved (proposed by Pat Bell,
seconded by Hazel Hodgson) [see the website]
d) The Annual Accounting Statements 2018/19 were approved (proposed by Pat Bell, seconded by Henry
Robinson) [see the website]
e) The Certificate of Exemption was approved (proposed by Pat Bell, seconded by Hazel Hodgson) [see the
website]
f) It was noted that New Hutton PC was selected randomly to have an intermediate review by the external
auditor but, because its income and expenditure in 2018/19 were below £25,000, the Parish Council is exempt
from the review.
g) The dates of the period for the exercise of public rights (Monday 17th June to Friday 26th July) were approved
(proposed by Pat Bell, seconded by Henry Robinson) [see the website]
h) The Community Account balance on the 1st April 2019 was £1543.40. It is now £2521.72 after the receipt of
the parish precept. A maximum of £305.39 has been authorised to be spent in the broadband project. The
balance of the Business Account remains at £511.69.
i) The Parish Council recorded its thanks to the clerk for his work and the preparation of the annual accounts.

190515-11 Extension of the B4RN broadband network to the parish


Now that the broadband line from the Institute via Greyhound to the Zayo link at the A684/Hayclose Lane junction has
gone live, the broadband project in New Hutton has been completed except from some re-instatement.

The Parish Council recorded its thanks to the landowners who kindly agreed to allow duct to be installed under their
land free of wayleave payment, the many investors in the parish and the numerous volunteers who helped in a variety
of ways. Particular thanks were given to the core team of “Dad’s Army” volunteers – Martyn Welch (New Hutton),
Arthur Robinson (Old Hutton), and Colin Wightman, David Stevenson and David Richardson (all from Preston Patrick).

190515-12 United Utilities Pipeline project


Two representatives from United Utilities/Mott-Macdonald-Bailey gave a report and answered questions. The project is
currently three weeks behind schedule so extra time is being used during the current fine weather to try to catch up.
The first pipes have been laid across Fairthorns Road. This road will re-open for access on Tuesday 28th May. Two
teams are laying four parallel pipes, one working southward and one northward from this central point. The closure of
Reservoir Road to lay pipes across it has been rescheduled to winter 2019/20 to reduce continued disruption for local
people. The wheel wash system is in use at the construction access point and is helping to minimise dirt from the site
getting onto local roads. Mark Thomas is the new representative for UU working with landowners.

Footpaths and Fairthorns Lane are closed for the duration of the project and notices have been posted. However,
walkers and cyclists have been seen on the routes. They are trespassing and CCTV cameras are recording them,
even at night. Ideas were suggested to emphasise that walkers, cyclists and drivers must not disregard the closure
notices.

Inspections of the whole Haweswater Aqueduct in 2013 and 2016 revealed concern about other sections. Ground
investigations are starting along the section from the A684 northwards to the A685 (Tebay road), and southwards from
the M6 through Old Hutton & Holmescales parish to prepare for future work there.

A grant for community use, such as the Institute kitchen, is being considered by UU.

The next Parish Council meeting will be at a date to be agreed in July 2019.
