WHAT IS ZONING?

Zoning divides the community into districts and imposes different land use controls on each
district,specifying the allowed uses of land and buildings, the intensity or density of such uses and
the bulk of building on the land.

Zoning Ordinance - A local legal measure which embodies regulations affecting land use

What Does Zoning Regulate?


Land Use
Population Density in a given district
Parking rquirments
Building Height
Setbacks and easements

Ensures implementation of other laws re: privacy, adequacy of air and light, convenience, access,
etc.

Zoning is found in an enacted legislation known as the Zoning Ordinance (ZO).


1. A zoning map forms part of the ordinance.
2. It shows the graphical designations, location and boundaries of the different zones or districts into
which the community is divided.

A Zoning Ordinance (ZO) Contains:


1. Regulations showing how each zone will be used
2. What land use activities are allowed without any condition.
3. Type of development that could take place after certain conditions are complied with.
4. What activities are not allowed.

WHO ENACTS ZONING REGULATIONS?


The functions of enacting zoning belongs to the local legislative councils:
Sangguniang Bayan
Sangguniang Panlungsod

Locational Clearance (prior to other permits, e.g. building permit)
Local Zoning Board of Appeals

Existing Non-Conforming Uses


Implement within 6 months from ratification of ZO by HLURB.

ZA to notify the owners to apply for certificate of Non-Conformance

May be allowed to exist subject to conditions of ZO

May be allowed to exist but:

Shall not be enlarged or extended to occupy greater area or be moved in whole or in part, to any
portion of the land.

Shall not be allowed or revived as non-conforming use once ceased to operate for more than a year.

Idle/vacant structure may not be used for non-conforming activity.

In case damaged, may be allowed to repair but 50% only of its replacement cost; repair or replacement
will not be allowed except in conformity with the ZO.

No non conforming use may be moved to displace any conforming use.

No non-conforming structure may be enlarged or altered in a way which will increase its non-
conformity, but may be altered to decrease its non-conformity.

NOTE: Owner of non-conforming use shall phase out and relocate within ten years from affectivity of the
Zoning Ordinance
