AGREEMENT

KNOW ALL MEN BY THESE PRESENTS :

This AGREEMENT, made and executed by and between: FELIX M. BALNIG, JR.,
of legal age, single, Filipino and a resident of Sta. Catalina, Zamboanga City, hereinafter
called the FIRST PARTY, and RODRIGO Y. TRUITA, of legal age, married, Filipino
and a resident of Zone 6, Boalan, Zamboanga City, hereinafter called the SECOND PARTY ;

WITNESSETH:

WHEREAS, the FIRST PARTY is the owner of that parcel of land, identified as Lot
366-H-2-D, covered by Transfer Certificate of Title No. T-198,695, situated in the Barangay
of Mercedes, Zamboanga City ;

WHEREAS, the SECOND PARTY requested the FIRST PARTY to allow him to plant
some vegetables in that portion of the latter’s Lot 366-H-2-D ;

WHEREFORE, premises considered, the parties have agreed to the following :

1. The Second Party is hereby permitted, free of any charge, to plant some vegetables
in a portion of the said lot of the First Party and for this purpose the Second Party is permitted
to construct a shelter, made of light materials only that can be easily removed;

2. That when the First Party shall use the area being occupied by the Second Party,
then the Second Party shall demolish his temporary shelter and shall vacate therefrom within
a period of one (1) month from notice, to allow him to harvest his planted vegetables.

IN WITNESS WHEREOF, we have hereunto set our hands on the date and place
hereinafter mentioned.
