CHAPTERI
INTRODUCTION
1. Short title and commencement.-(1) Theserulesmay be citedas the
PunjabLandUse (Classification, Reclassification
and Redevelopment) Rule
2008.
(2) Theseshallcomeintoforceat once.
2. Definitions.-In theserules:
(i) "agricultural area" means land outsidethe peri-urbanarea
which is predominantly used for the cultivationof crops ard
includescropland,pastureland,orchards,nurseries,dairy
farms;
(ii) "approved scheme" means a scheme approved by the
Government, a localgovernment or any otherpublicauthority;
(iii) "bettermentfee" meansthe fee leviedby a local government
as a consequenceof a scheme,re-development schemeor
provisionof infrastructure;
(iv) "buildingline"meansthe line beyondwhichthe outerface of a
building may not project in the directionof an existingor
proposedroadexceptthe compoundwall;
(v) "buildingbyelaws"meanthe buiHingand zoningbyelawsof a
localgovernment;
(vi) "commercialarea" means an area which is designatedfor
commercialuse as per approvedschemeor a masterplan,or
I is beingusedas suchin the established builtup area;

(vii) "commercial use" means land use which is predominantly
connectedwithsaleand distribution of goodsand services;
(viii). "competent authority" means the authority competent to
approvelandclassification, reclassification
or redevelopment;
(ix) "commercialcorrido/'meansa road or a segmentof a road,
with not lessthansixtyfeet rightof way and specifieddepthof
area, which has been reclassifiedas commercialby a
competentauthority;
{x) "DistrictPlanningand DesignCommittee"means a District
Planning and Design Committee constituted by the
Government underrule53;
(xi) "educational institution"
includesa school,college,university,
researchor trainingcenter,libraryor a madrassah;
(xii) "established builtup area"meansbuiltup areaotherthanthe
builtup areain an approvedscheme;
(x,,,) "environmentafly sensitivearea"includesa naturalpark,wild
life park, forest, mountainousterrain, mining arca or a
watershedarea;

(xiv) "Government" meansthe Government of the Punjabhousedin


the Local Government and Community Development
Department;
(xv) "healthcareinstitution"includesa hospital,health centre,
dispensary,clinic, polyclinic,clinical laboratory,mediral
trainingcenter,nursinghome,dentalcentre,homeopathic or
acupuncturecenter,recognizedas such by any law for the
timebting in force;
(xvi) 'historicallysignificantarea"meansan areadesignated under
any law foi the time being in force as historically, ;
or archeolog
a,rchitecturally icaIly significant area;
{xvii) "industrialarea" means an area which is designatedfor
industrialuse as per approvedschemeor a masterplan,or is
beingusedas suchin the establishedbuiltup area;
{xviii) "lndustrialArea ScrutinyCommittee"means the lndustrial
Area Scrutiny Commifteeconstitutedby the Government
underrule54;
(xix) "industrialuse" means land use which is predominantly
connected with manufacti.rring,assembling, processing or
storageof goods;
(xx) "industrialconidgr"meansa roadOra Segmentof a road,with
not less than sixty feet right of way and has been reclassified
as such by a comPetentauthority;
(xxi) "industrialplof'meansan industrialplot in an industrialestate,
approvedschemeor masterplan;
(xxii) 'intercity service area"means an area designatedby a City
District Govemmentor a Tehsil MunicipalAdministrationas
servi@ area along the intercity road outside the peri-urban
.area;
(xxiii) "katchiabadi"meansan areadeclaredby the Governmentas
a katchiabadiunderthe PunjabKatchiAbadisAct 1992(Vlll
of 1992);
(xxiv) "land use plan" means a plan approved by a competent
authorityfor reclassification, development or redevelopment of
an area;
(xxv) "masterplan"meansa landuse planof an areaand includesa
structureplan, an outlinedevelopmentplan, a spatial plan,
peri-urbanstructureplanand a metropolitan plan;
(xxvi) "non-conforming use"meansthe use that does not conformto
the permitted of permissible landuse but is existingat site;
(xxvii) "notified grea" means an area in which special restrictions
regarding its developmentor redevelopmenthave been
imposedunderany lawfor the time beingin force;
(xxviii) "other restrictedarea" means an area in which the Federal
Government,the Government,or a local governmenthas
imposedcertainbuildingor areadevelopment restrictions.
(xxix) "Ordinance"meansthe PunjabLocalGovernmentOrdinance
2001(Xlll ot 2001);
(xxx)
' "peri-urbanarea" means an area that spans the landscape
betweencontiguousurbandevelopmentand ruralcountryside
with low populationdensityand is predominantly being used
for agriculturalactivityand is likelyto be urbanizedin the next
twentYYears;
(xxxi) "publicsectorinstitutionalarea" meansan area reservedfor
Federal,Government,Government,loCalgovernmentOr any
otherPublicbodY;

(xxxii) "redevelopment"means renewar, reconstruction or up


gradationof infrastructure
and buildingsin an area;
(xxxiii) "residentialarea" means an area which is designatedfor
residentialuse in accordancewith an approvedschemeor
masterplan,or is beingused as such in an establishedbuitt
up area;
(xxxiv) "residentialuse" means land use which is predominanfly
connected withhousing;
(xxxv) "rightof way" meansthe width of road or streetbetweentwo
oppositeproperties;
(xxxvi) "Table"meansa tableappendedto the rules;and
(xxxvii) "valuationtable" means a valuationtabre notifiedunder the
StampAct 1899(ll of 1899).
3. Terms not defined.- A word or term used in theserutesbut not defined
shallhavethe samemeaningas in the Ordinance.

CHAPTERII
LANDUSECLASSIFICATION
4. Land use classes.- (1) A City DistrictGovernmentor a TehsilMunicipal
Administrationshall,withinone year of the notificationof these rules,classify
landfallingwithinits geographical
limitsintothe followingland use classes:
(a) residential;
(b) commercial (includinginstitutional);
(c) industrial;
(d) peri-urban;
(e) agricultural; and
(f) notifiedarea.
(2, A City DistrictGovernmentor a Tehsil MunicipalAdministration
shall sub-classifythe land use classesaccordingto the characteristics as
providedin the TableA.
5. Residential area.- A City District Governmentor a Tehsil Municipal
Administration shallsub-classify a residentiatareaas follows:
(a) approvedscheme.
(i) RA1:meansa residentialareawith size of plots beingmore
than two kanal and right of way of roads rangingfrom fifty
feet t9 two hundredand twentyfeet and a typicalrightof way
of sixtyfeet;
(ii) RA2: meansa residentialarea with size of plots beingone
kanal to two kanarand right o{ way of roads ranging-fiom
thirty feet to one hundredand eighly feet and a typicdlright
of way of thirtyfeet; :
(iii) RA3: meansa residentialarea with size of plots beingten
marla to one kanaland right of .wayof road-sranging-from
tlirty feet to one hundredand twentyfeet and a typicaldght
of way of thirtyfeet;and
(iv) RA4: meansa residentialarea with size of plots being less
than ten marlaand rightof way of roadstnjing from,frrcnty
feet to eightyfeet and a typicatr'right
of way of tnirtyfeet:
(b) establishedbuiltup area:
(i) RE1: meansa residentialareawith size of plgtsbeingmore
than one kanatand right of way of roads ringing iioii.forty

(iv) RE4: meansa residentialatea with size of plots being less
than five marlaand rightof way of roadsup to fortyfeet anti
a typicalrightof way of twentyfeet

6. Land use of residential area.- A City District Government or a
Municipal Adminishation shall ensure that the following land use provisions
under permitted, permissible and prohiliited uses are strictly followed in a
residentialarea:
(a) permifteduses:
a City DistrictGovernmentor a TehsilMunicipalAdministration
shallpermitfollowingusesin a residentialarea:
(i) detachedhouse;
(ii) semi-detachedhouse;
(iii) town house;
(iv) residentialapartment;
(v) neighborhood levelparkand playground;
(vii placeof rvorshipor pnyer;
(vii) placeof burialor cremation;and
(viii) horticultural nursery:
(b) permissibleuses:
subjeCto.rule 15, a competentauthoritynlay grani permission
for any of the fcllowinguses:
(i) daycafecentreor preschoot;
(ii) primaryschool;
(iii, secondaryschool:
(iv) dispensarywith no bed and laboratoryfacilities;
(v) library;
(vi) guesthousehavingnot nroretharrten rooms;
(vii) smallsize cornershopat the gioundfloor;and
(viii) office of a professionalnot exceecfingtwenty five percentof
the floor ,-area, as office associateci qrith resident
professional;this facility shall be availableto a resideirt
. holding both a professionaiCegree,diploma or ceilificste
anJ a registrationwith a statutorybody establishedunderar
iaw for the tlme beingin force:
(c) prohibiteduses:

than ten marlaand rightof way of road rangingfrom twenty
feet to eightyfeet and a typicatright of way ol tfrirtyfeet:
(b) establishedbuiltup area:
(i) cEl: meanscommercialareawith size of plots being more
than one kanaland right of way of road rangingrroir torty
feet to two hundredand twentyfeet and a typicalrightof way
of forty feet;
(ii) CE2: means commercialarea with size of plots being ten
marfato one kanal and right of way of road rangingfrom
thirtyfeet to one hundredand twentyfeet and a tyficil rigrrt
of way of thirtyfeet;
(iii) cE3: meanscommercialarea with size of plots being five
marla to ten marla and right of way of road rangingfrom
twenty feet to sixty feet and a typicaf right of way oi thirty
feet;and
(iv) CE4: meanscommercialarea with size of plots being less
than five marlaand right of way of road rangingupto forty
feet and a typicalrightof way of twentyfeet
(c) commercialcorridors:
(i) cc1: means commercialcorridorwith size of plots being
morethan six kanaland rightof way of roadsmorethan one
hundredand twentyfeet;
(ii) ccZ: meanscommercial corridorwith size of plotsbeingfour
kanalto six kanaland rightof way of roadsrangingfrom one
hundredfeetto one hundredand twentyfeet;
(iii) CC3:meanscommercial corridorwith size of plotsbeingtwo
kanal to less than four kanal and right of way of roads
rangingfromeightyfeetto one hundredfeet;and
(iv) CC4:meanscommercial corridorwithsizeof plotsbeingone
kanal to less than two kanal and right of way of ioads
rangingfromsixtyfeetto eightyfeet.
8. Land use of commercial area.- A City DistrictGovernmentor a Tehsil
MunicipalAdministration shallensurethat the followingtand use provisions
under permitted,permissibleand prohibiteduses are stricflyfollowedin a
commercial area:
(a) permitteduses:
a City DistrictGovernment or a TehsilMunicipalAdministration
shallpermitfollowingusesin a commercialarea:
(i) muftistoreybuilding;
(ii) apartment;
(iii) plaza;
(iv) residential flat on upperfloor;
(v) market,shoppingmall,departmental store;
(vi) businessfacility;
(vii) privateoffice;

(ix) courtor tribunal;

(xiv) showroomand shop;
(xv) boutique;
(xvi) restaurant;
(xvii) social welfare institutionsuch as comrnunitycentre, arr
gallery& museum;
(xviii) parkingplaza;
(xix) taxistandand bus halt;
(xx) policestation,postoffice,firestation;and
(xxi) pfaceof worshipor prayer:
(b)permissible uses:
subjectto rule 15, a competentauthoritymay grantpermission
for any of the followinguses: r
(i) educational institution;
(ii) researchinstitution witha minimumplotsizeof fourkanal;
(iii) marliageor banquethall with a minimumprot size of four
kanal,
(iv) cinema;
(v) theater,auditorium,concerthall or exhibitionhall with a
minimumplotsizeof fourkanal;
(vi) seasonalcommercial faresite;
(vii) stadiumor playland;
(viii) petrolpumpor gasstation;
(ix) busor truckterminal;
(x) loadingand unloading requirements of afl uses;
(xi) weighbridge;
(xii) privatehospital;
(xiii) hotelthreestaror above;
(xiv) television or otherstudio;
(xv) autoworkshop;
(xvi) wholesalestoragepface;
(xvii) printingpress;
(xviii) athleticclub, gymnasium,fitness centre or indoor sport
facility;and
(xix) basetransreceiverstationor communication tower:
(c) prohibited uses:
a City DistrictGovernment or a TehsilMunicipalAdministration
shallnot allowa personto use landor buildingin a commerciall
areafor any purposewhichis neitherpermittednor permissible.
9. Industrial area.- A City DistrictGovernmentor a Tehsil Municipal
Administration shallsub-classify an industrialareaas follows:
(a) approvedscheme:
(i) tA1:meansindustrialareawith size of plotsbeing1ve acre
and aboveand rightof way of road rangingfrom eightyfeet
to two hundredfeet:

(ii) lA2: meansindustrial areawith size of plotsbeingone acre


to less than five acre and rightof way of road rangingfrom
sixtyfeet to one hundredfortyfeet;
(iii) lA3: meansindustrial areawithsizeof plotsbeingfourkanal
to less than one acre and rightof way of road rangingfrom
fiftyfeet to one hundredand twentyfeet;and
(iv) lA4: meansindustrial areawith size of plotsbeinglessthan
four kanaland rightof wayof roadup to eightyfeet:
I (b) established builtup area:
I (i) lE1.meansindustrial areawithsizeof plotsbeingabovefour
kanal and right.of way of road rangingfrom forty feet to
eightyfeet witha typicalrightof way of fortyfeet;
(ii) lE2: meansindustrial areawithsizeof plotsbeingtwo kanal
to four kanaland rightof way of roadrangingfromthirtyfeet
to sixtyfeet witha typicalrightof way of thirtyfeet;
(iii) lE3:meansindustrial areawithsizeof plotsbeingone kanal
to lessthantwo kanaland rightof way of roadrangingfrom
twentyfeet to sixty feet with a typicafright of way of thirty
feet;and
(iv) lE4: meansindustrial areawith size of plotsbeinglessthan
one kanal and right of way of road up to forty feet with a
typicalrightof way of twentyfeet:
(c) industrial corridor:
(i) lC1: meansindustrialcorridorwith size of plotsbeingmore
than two kanal locatedalong the provincialhigh ways
outsidethe peri-urban areas;and
(ii) lC2: meansindustrialcorridorwith size of plots beingone
kanalto one acrelocatedalongthe intercityroadin sidethe
peri-urban area.
10.Land use of industrial area.- A City DistrictGovernmentor a Tehsil
MunicipalAdministration shallensurethat the followingland use provisions
underpermitted,permissible and prohibiteduses are strictlyfollowedin an
industrialarea:
(1) approvedindustrial area:
the permitted,permissible and prohibitedland usesshallbe in
accordancewiththe approvedschemeof an industrialarea;
(2) established built-upareaand industrial coridor(lC2)
(a) permitteduses:
a City District Government or a Tehsil Municipal
Administration shall permitfollowinguses in a established
builtup areaand lC2 area:
(i) cottageor lightindustry;
(ii) construction equipment;
(iii) warehouse,storageor distribution centre;
(iv) buildingmaterialstore;
(v) firbstation;and
(vi) loadingandunloading place:
(b) permissible uses:
subject to rule 15, a competent authority may grant
permission for anyof the followinguses:
(i) mediumindustry;
(ii) petrofpumpor gas station;

(iii) essentialresidential, commercialor educationalfacility


for laborersor employees; and
(iv) policestation,postoffice:
(c) prohibited uses:
a person shall not do any of the followingacts in an
established builtup areaandlC2:
(i) storing, packing, pursing, cleaning,preparing,and
manufacturingof blasting powder, ammunition,fire
works, gun powder, sulphur, mercury,gases, nitro-
compounds, phosphorous, dynamite;
(ii) storing explosives,petrol, oil, lubricants,and other
inflammable materialsincludingcoal,chemicals, liquids
or otherwise cleaningdying,preparingand manufacturing
of clothor yarnin indigoor othercolour;
(iii) storing, processing, cleaning, crushing, melting,
preparing or manufacturing and dealingin bombs,tallow,
offal,fat blood,soap,raw or dry hideor skin,washingor
dyingwoolor hair;and
(iv) castingof heavymetals,electroplating,welding,marble
cuttingand polishing,manufacturing of cementor pipes,
burning or grinding of lime stone,metal or use of any
otherobnoxious or hazardous material;
(3) industrial corridor (lC1)
(a) permitteduses:
a CityDistrictGovernment or a TehsilMunicipat
Administration shallpermit followingusesin an industrial
corridor:
(i) light,mediumor heavyindustryincludingmanufacturing,
' production, processing, cleaning,servicingand repairof
materials, goodsor products;
(ii) ancillaryofficeor placefor industry;
(i i i ) petrolpumpor gasstation;
(iv) essentiafresidential,commercialor educationalfacility
for employees;
(v) poficestation,postofficeor fire station;
(vi) loadingandunloading place;
(vii) construction equipments;
(viii) warehouse, storageor distribution
center;and
(ix) buildingmaterialstore:
(b) permissible use:
subject to rule 15, a competentauthoritymay grant
permission for anyof thefollowinguses:
(i) storing, packing, pursing, cleaning,preparing,and

(c) prohibiteduse:
a City District Government or a Tehsil Municipal
Administrationshall not allow a personto use a propertyin a
industrialarea for a purposewhich is neither permittednor
p e rmi ssi b l e.
11.Land use in peri-urban area.- A City DistrictGovernmentor a Tehsil
MunicipalAdministration shallensurethat land use in a peri-urbanarea is in
accordancewith the peri-urbanarea structureplan.
12.Land use in agricultural area.- A City DistrictGovernmentor a Tehsil
MunicipalAdministration shall ensurethat the followingland use provisions
under permitted,permissibleand prohibiteduses are strictlyfollowedin an
area:
agricultural
(a) permitteduse:
a City District Government or a Tehsil Municipal
Administration shall permit following land use in an
agriculturalarea:
(i) crop;
(ii) orchard;
(iii) pastureland;
(iv) livestocksuch as dairy or poultryfarm;
(v) forest;
(vi) nurseryor a greenhouse;and
(vii) tube well:
(b) permissibleuse:
subject to rule 15, a competent authority may grant
permissionfor any of the followinguses:
(i) ruralsettlement, hamletor village;
(ii) placeof worshiPor Prayer;
(iii) placeof burialor cremation;
(iv) cornershoP;
(v) agricultural machineryworkshop;
(vi ) b ri ckki l n;
(vii) basichealthunit;
(viii) animalhusbandryclinic;
(ix) countryclub;
(x) farm house;
(xi) publicor privaterecreationalpark; and
(xii) zoo or wildlifepark:
(c) prohibiteduse:
a City District Government or a Tehsil Municipal
Administrationshall not allow a personto use a propertyin a

l4.Clarifications.- (1) ,t a City District Governmentor a Tehsil Municipal
Administrationfinds any ambiguity in the classificationof land use or its
permissibility(permitted,permissibleor prohibiteduse), the local government
shall referthe same to the Government.
(2) The Governmentshall,withinthirty days, decide the referenceand
the decisionof the Governmenton such referenceshall be final.
(3) The Government may permita land use in any areawhichis not
providedin any of the classificationsbut such land use shallbe nearto the
landusepermitted or permissiblein the area.
(4) Subjectto theserules,variousclassifiedland usesare summarized
in theTableB.
15. Approval of permissibleuse.- A City DistrictGovernmentor a Tehsil
Municipaladministration shall not grant permissionto a person for a
permissiblelanduse unlessthe DistrictPlanningand DesignCommitteehas
examinedand recommended suchpermission.

CHAPTERIII
PROCEDURE FORLANDUSECLASSIFICATION
16.Landuse classificationmap.- A City DistrictGovernmentor a Tehsil
MunicipalAdministration
shall,withinone year from the notificationof these
rules:
(a) preparea landuse classification
map of the approvedschemes
and established
builtup areain a districtor tehsilin accordance
withthe landuse classification
and sub-classification underrule

(b) preparea land use classificationmap using satelliteimageryof


the area;and
(c) digitizethe satelliteimageryof the area and use it as a base

17. Preparationof the map.- (1) A City DistrictGovernmentor a Tehsil
Municipal Administration shallpreparethe landuse classificationmap for an
approvedschemebY:
(a) collectingthe approved scheme plans from the relevant
authoritY;
(b) dividingthe schemeareaintovariousclassesand sub classes
of landuseunderrule4;
(c) markingthe plotwhichhas beenconverted land
from residential
useunderanylaw;
(d) markingthe plotwhichhas beenconverted land
from residential
use withoutapprovalof the competent authorityand declaringit
as non-conforming use;and
(e) marking the plot which has been temporarilyconvertedto
commercialuse with the approvalof competentauthorityand
declaringit as non-conforming use.
(2) A City DistrictGovernmentor a Tehsil MunicipalAdministration
shailpreparethe landuse classification mapfor an established builtup area
by dividingan established builtup area,fallingoutsidean approved scheme:
(a) intourbanblocksby adoptingthe followingcriteria:
(i) an urban block shall not cross boundaryof a Union
Council;
- (ii) areaof a UnionCouncilshallbe dividedintourbanblocks
in sucha waythatthe blockareafallswithinthe rangeof
one hundredand fifty acresto three hundredacresof
predominantlY area;
residential
(iii) an existingcompactcommercialor industrial shall
be considered as an urban block;
(iv) an urban block shall be bounded by existing road
network,naturalor manmadebarriers;
(v) data on variousland uses and size of plots for an urban
block shall be collectedand compiled as prescribedin
rule 4;
(vi) urban blocks shall be redefined on the basis of
predominant landuse and Plotsize;
(vii) land use survey and the latest populationcensus blocks
shallbe takenintoconsideration;
(viii) an urban block shall not be bisected by railway line,
primary road or irrigationchannels such as canal, river
and storm water drains more than forty feet wide;
(ix) an existingmohallamay not be divided;and
(x) notwithstandingclause (viii), a notified Katchi Abadi shall
be treatedas a singleurbanblock:
(b) markingthe plot which has been convertedfrom residentialland
use underanYlaw;
(c) markingthe plot which has been convertedfrom residentialland
use withoutapprovalof the competentauthorityand declaringit
as non-conforminguse;
converted to

estabiished builtup area on the satellite imageryof the areawhichshallbe
knownas consolidated landuseclassification map.
(4) The DistrictOfficer(SpatialPlanning)in case of a City District,or
theTehsilOfficer(Planning & Coordination) shallprepare, signandstampthe
consolidated landuseclassification map.
(5) The ExecutiveDistrictOfficerMunicipalServicesor the Tehsil
MunicipalOfficershall check and countersighthe consolidatedland use
classificationmap.
18.Scrutiny.-The ExecutiveDistrictOfficerMunicipalServicesor the Tehsil
MunicipalOfficershallsubmitthe consolidated landuse classification mapto
the DistrictPlanningand DesignCommittee for scrutiny.
19.Approval.-Afterthe scrutinyof the consolidated land use classification
map, a DistrictCoordination Officerof a City Districtor a TehsilMunicipal
Officershall submitthe map and the minutesof meetingof the District
Planningand DesignCommittee to the TehsilCouncilor the Zila Councilfor
approval.
20.Notification.-(1) A DistrictCoordination Officerof a City Districtor a
TehsilMunicipalOfficershallsignand certifythe approvedconsolidated land
useclassification map,in triplicate.
(2) The CityDistrictGovernment or the TehsilMunicipal Administration
shail, within seven days from the date of approval, notify the approved
consolidated landuseclassification map.
21.Circutatio,.n.- (1) The DistrictCoordination Officeror the TehsilMunicipal
Officer shall' retain two copies of the notified consolidatedland use
classification map in an officeof the City DistrictGovernmentor the Tehsil
MunicipalAdministration for recordanddisplayon the noticeboard.
(2) The DistrictCoordination Officeror the Tehsil MunicipalOfficer
shailfonryard the thirdcopyof the notifiedconsolidated landuse classification
mapto the Government.
(3) The CityDistrictGovernment or the TehsilMunicipal Administration
shail publishthe notifiedconsolidated land use classification map on its
website.
(4) A personmay,subjectto paymentof fee, obtaina certifiedcopyof
the notifiedconsolidatedland use classificationmap from the City District
Government or theTehsilMunicipal Administration.
22.Peri-urbanstructure ptan.- A City DistrictGovernmentor a Tehsil
Municipal Administration shall,withintwo yearsfrom the notification of these
rules,preparea structureplan for the peri-urbanareaof the districtor the
tehsil.
23.Preparationof the peri-urban structure plan.- (1) A City District
Government or a TehsilMunicipal Administration shallpreparea peri-urban
structureplanby:
(a)usingthe satellite imagery as basemap;
(b)conducting fieldsurveY; and
(c) markingb.oundaries of the established builtup areaon the base
map.
(2) A City DistrictGovernmentor a Tehsil MunicipalAdministration
shallmarkexf.ernal boundaryof the peri-urban areaon the basisof:
(a) directionandtrendof the urbansprawl;
(b) population growthrate;and
(c) requirements of urbandevelopment for the nexttwentyyears.

(3) The peri-urban structure planshallinclude:


(a) the proposedroadnetworks;
(b)the urbanblocks;
'
(c) the proposedlandusesfor variousblocks;and
(d)the permissible sizeof plotsin a block.
(4) lf the builtup areaof two or moreadjoiningTehsilsis contiguous,
the DistrictCoordination Officermayconstitute a jointcommittee of the Tehsil
MunicipalAdministrations to preparea consolidated peri-urban structureplan.
Z4.Publicconsultation.-(1) A City District Government or a Tehsil
Municipal Administration shall:
(a) inviteobjections or suggestion by givingpublicnoticeindicating
salient features of the draft peri-urban structureplan on its
websiteand in at leasttwo leadingnationaland one localnews
papers.
. (b) arrangepublichearingon a specifieddate,timeand place.
(c) maintainrecordof the proceedings for a minimumperiodof five
yearsafterthe approvalof peri-urban.structure plan.
(2) The ExecutiveDistrictOfficerMunicipalServicesor the Tehsil
MunicipalOfficershall sign and stampthe draft peri-urbanstructureplan
prepared after taking in to considerationsthe public objectionsand
suggestions.
25.Scrutiny.-The ExecutiveDistrictOfficerMunicipalServicesor the Tehsil
MunicipalOfficershall submitthe peri-urbanstructureplan to the District
Planningand DesignCommittee for scrutiny.
26.Approval.-After the scrutinyof the peri-urbanstructureplan,a Distr:ict
Coordination Officerof a CityDistrictor a TehsilMunicipalOfficershallsubrnit
the plan and the minutesof meetingof the DistrictPlanningand Design
Committee to theTehsilCouncilor theZilaCouncilforapproval.
2T.Notification.-(1) A DistrictCoordination Officerof a City Districtor a
Tehsil MunicipalOtficer shall sign and certify the approvedperi-urban
structure plan,in triplicate.
(2) The CityDistrictGovernment or the TehsilMunicipal Administration
shall,withinsevendaysfrom the dateof approval,notifythe approvedperi*
urbanstructureplan.
2S.Circulation.- (1) The DistrictCoordination Officeror the TehsilMunicipal
Officershall retain two copies of the notified peri-urban structureplan in an
officeof the City DistrictGovernment or the TehsilMunicipalAdministration
for record and display on the notice board.
(2) The DistrictCoordination Officeror the Tehsil MunicipalOfficer
shall forwardthe third copy of the notifiedperi-urbanstructureplan to the
Government.
(3) The CityDistrictGovernment qr the TehsilMunicipal Administration
shall publishthe notifiedperi-urban structure plan on its website.
(4') A personmay,subjectto paymentof fee, obtaina certifiedcopyof
the notifiedperi-urban structureplanfromthe CityDistrictGovernment or the
TehsilMunicipal Administration.
29.Preparationof a planningmap.- A City DistrictGovernment or a Tehsil
Municipal Administration shallprepare a planning mapby combining:
(a)the notifiedconsolidated landuseclassification map;
(b)the notifiedperi-urban structureplan;and
(c) the agricultural area.
30.Scrutiny.-The Executive DistrictOfficerMunicipal Servicesor the Tehsil

MunicipalOfficershall submitthe planningmap to the DistrictPlanningand


DesignCommitteefor scrutiny.
31.Approval.-Afterthe scrutinyof the planningmap,a DistrictCoordination
Officerof a City Districtor a TehsilMunicipalOfficershallsubmitthe planning
map and the minutes of meeting of the District Planning and Design
Committee to the TehsilCouncilor the ZilaCouncilforapproval.
32.Notification.- (1) A DistrictCoordinationOfficerof a City Districtor a
TehsilMunicipalOfficershall sign and certifythe approvedplanningmap, in
triplicate.
(2\ The City DistrictGovernmentor the TehsilMunicipalAdministration
shall, within seven days from the date of approval, notfy the approved
planning map.
33.Circulation.-(1) The DistrictCoordination Officeror the TehsilMunicipal
Officershall retaintwo copiesof the notifiedplanningmap in an officeof the
City DistrictGovernmentor the TehsilMunicipalAdministration for recordand
displayon the noticeboard.
(2| The District CoordinationOfficer or the Tehsif Municipal Officer
shallfonrardthe thirdcopyof the notifiedplanningmapto the Government.
(3) The City DistrictGovernmentor the TehsilMunicipalAdministration
shallpublishthe notifiedplanningmapon its website.
(4) A personmay, subjectto paymentof fee, obtaina certifiedcopy of
the notifiedplanningmap from the City DistrictGovernmentor the Tehsil
Municipal Administration.
34.Preparationof district planning map.- A District Governmentshall
preparea districtplanningmap by combiningthe notifiedplanningmaps of
the Tehsilsof the district.
35.Periodic review.- Subject to a general or a special order of the
Government, a City DistrictGovernment,a TehsilMunicipatAdministration or
a District Government shall periodicaflyreview and revise the notified
consolidatedland use classificationmap, notifiedperi-urbanstructureplan,
notifiedplanningmap and districtplanningmap at leastonceeveryfive years.

CHAPTERIV
LAND USE RE.CLASSIFIGATION
36.Land use re-classification.- A City DistrictGovernmentor a Tehsil
MunicipalAdministrationshall preparea land use reclassification scheme
afterthe notification of consolidatedlanduse classificationmap.
3T.Selectionof project area.- (1) A City DistrictGovernmentor a Tehsil
MunicipalAdministration shallselectthe projectareaby:
(a) reclassiflringthe land use of an urbanblockin accordancewith
the TableC; and
(b) identifyingand prioritizingan urban block or group of urban
blocks proposed for reclassificationin accordance with the
followingcriteria:
(i) trendof changesin the existinglanduses;
(ii) marketdemandfor the changeof landuse in the area;
(iii) compatibility
withadjoininguses;
(iv) potentialfor up-gradationof seruingroad network;and
(v) prospectsfor redevelopment.
(2) The urban block or blocks proposedfor land use re-classification
schemeshallbe knownas the projectarea.
(3) Notwithstandinganythingcontainedin these rufes, a City District
Governmentor a Tehsil MunicipalAdministration shall not selec'ta planned

industrialarea as a project area unless the same is scrutinizedand


recommended by the IndustrialAreaScrutinyCommittee.
38. Scrutiny.- The ExecutiveDistrictOfficerMunicipalServicesor the Tehsil
Municipal Ofifioershall submit the proposed project area to the District
Planningand DesignCommitteefor scrutiny.
39.Approval.- After the scrutiny of the proposed project area, a District
Coordination Officerof a CityDistrictor a TehsilMunicipalOfficershallsubmit
the proposedprojectareaand the minutesof meetingof the DistrictPlanning
and DesignCommittee to the TehsilCouncilorthe ZilaGouncilforapproval.
40.Preparationof re-classificationscheme.- (1) After the approvalof the
projectarea,a City DistrictGovernmentor a TehsilMunicipalAdministration
shallpreparea re-classification schemeby:
(a) demarcatingthe boundaries of the projectarea;
(b) undertakingsurveyof the projectareaincluding:
(i) a topographicsurveyto preparea cadastralmap;
(ii) land use surveyof the projectarea;
(iii) documentation of the existinginfrastructureand design
capacities;
(iv) assessmeni of existing traffic volumes and design
capacityof the roadnetwork;
(v) enlistment of key stakeholders,including local non
government organizations, community based-
organizations, public representatives, traders
associations;and
(vD collectionof secondarydata:
(c) compilingand analyzingthe collecteddata;
{d) proposingdifferentoptionsof land use recfassification;
(e) comparingand evaluatingthe land use re-classification options;
and
(f) selectingthe preferredoption.
(2) A proposedlanduse reclassification schemeshallinclude:
(a) focationplan of the projectarea;
(b) site plan,givingall the detailsof the projectarea;
(c) notifiedland use classificationmap of the proiectarea;
(d) proposalsfor landuse re-classification of the projectarea;and
(e) proposafsfor improvementin the projectareafor:
(i) utility service such as electricity,gas, communication
networks, solid waste management, water supply,
sewerale and drainage;
(iD trafficand transportation;
(iiD landscapeand streetfurniture;
(iv) publicbuildingrequiringfacadeimprovements;
(v) katchiabadiandslumarea;and
(vi) open spaceand park.
4l.Public consultation.- (1) A city District Govemment or a Tehsil
MunicipalAdministration shall:
(a) inviteobjectionsor suggestionby givingpublicnoticeindicating
salientfeaturesof the draft land use re-classification schemeof
a project area on its website,to the key stakehofdersof the area
and in at leasttwo leadingnationaland one local newspapers.
(b) arrangepublichearingon a specifieddate,time and pl3ce.

(c) maintainrecordof the proceedings for a nrinimumperiodof five


yearsafter the approvalof draft re-classificationscheme.

MunicipalOfficer shalt sign and stamp the drait land use re-cfassificatitrn
schemepreparedafter takingin to considerations the pr,lbticoUleciionsanO
suggestions.
42.Scrutiny.- The ExecutiveDistrictOfficerMunicipafServicesor the Tehsil
MunicipalOfficershall submitthe draft land use re-classification schemeto
the DistrictPlanningand Designcommitteefor scrutiny.
43.Approval.- After the scrutiny of the draft land use re-classification
scheme,a DistrictCoordination Offigerof a City Districtor a TehsilMunicipal
Officershall submit the draft schemeand the minutesof meetingof ifre
DishictPlanningand DesignCommitteeto the Tehsil Councilor -the Zla
Councilfor approval.
44.Notification.- (1) A DistrictCoordinationOfficerof a City Districtor a
r9ns1l Municipalofficer shall sign and certify the approvedland use re
classificationscheme,in triplicate.
(2) The City DistrictGovernmentor the TehsilMunicipafAdministration
shall,withinsevendays from the date of approval,notifotire apprweo tano
use re-classification scheme.
45.Circulation.-(1) The DistrictCoordination Officeror the TehsilMunicipal
Officershallretaintwo copiesof the notifiedlanduse re-ctassification schene
in an office of the City District Governmentor the Tehsil Municipal
Administration for recordand displayon the noticeboard.
(2) The DistrictCoordinationOfficer or the Tehsil MunicipalOfficer
shallforwardthe thirdcopyof the notifiedtanduse re-classification schemeto
the Government.
. (9) Ih" City DistrictGovernmentor the TehsilMunicipalAdministration
shaffpublishthe notifiedlanduse re-ctassification schemeon its website.
(4) A personmay,subjectto paymentof fee, obtaina certifiedcopyof
the notified land use re-ctassificationscheme from the City Oisiri6
Government or the TehsilMunicipal Administration.
46. Recfassificationprohibition.- Notwithstanding any thing containedin
thisChapter,a City DistrictGovernment or a TehsiiUunicipat-nOministration
shallnot recfassify:
(a) a land use in an approvedschemeor industrialestatefor a
periodof twentyyearsfrom the date of its approval;
(b) commercial or residential
areato industrial use;
(c) plot reservedfor educationalinstitution,healthcareinstitution,
policestation,post office,place of worship,placefor burialor
cremation,publicparkandopenspacein an approvedscheme;
(d) placeof worship,placefor burialor cremationand publicpark
in an established buiftup areaor peri-urban area;and
(e) plots allottedby the FederarGovernment,the Government,a
focalgovernmentor any otherpublicauthorityon reservedprice
for a specificuse.

CHAPTERV
REDEVELOPMENT PLAN
!7.. Rgdevelopmentplan.- A City DistrictGovernmentor a TehsilMunicipaf
Administrationshall prepare apd implementa redevelopmentplan foi a
notifiedlanduse reclassification
scheme.
43.Preparationof redevelopmentptan.- (1) After the notificationof land
use reclassification
scheme,a City DistrictGovernmentor a TehsilMunicipal
Administrationshall prepare a- redevelopmentplan on the basis of

proceedingsundertakenduringthe preparationof land use reclassification


sc;heme.
(2) A redeveloprnent planshallinclude:
(a) environmentalimpact assessment or initial environmental

(i) improving and upgrading the road network, to
accommodatethe increaseddemand of the proposed
landuse withinthe availablerightof way;
(ii) traffic managernentwith detailedassessmentand option
analysis including traffic signats and intersection
irnprovements;
(iii) rnodificationand additionof publictransportroutes;
{iv) parkingfacilities;
(v) pedestrianand cyclingfacilities;and
(vi) bus,taxi,rikshawand tongaparking:
{c) streetfumitureplanfor:
(i) streetlighting;
(ii) landscapeimprovements;
(iii) architecturalimprovements; and
(iv) publicspaces,openareasand plantation:
(d) utilityservicesplanfor:
0 up-gradation of electricity, gas and communication
networks;
(ii) upgradationof water supply,sewerageand storm water
drainagefacilities;
{iii) storagespacesfor solidwaste;
(iv) publictoilets;
(v) upgradationof fire fightinganangements;
(e) financialassessmentplan includingdetailedcosts estimates;
t0 land consolidationplan includinglandownershippatternsand
proposalfor landreadjustment or landpooling;and
(g) implementation frameworkincluding:
(i) timeschedule;
(ii) monitoring mechanism;
(iii) feedbackmechanism; and
(iv) completionreport.
49.Scrutiny.- The ExecutiveDistrictOfficerMunicipalServicesor the Tehsil
MunicipalOfficershall submit the draft redevelopmentplan to the District
Planningand DesignCommitteefor scrutiny.
50.Approval.- After the scrutinyof the draft redevelopment plan, a District
Coordination Officerof a City Districtor a TehsilMunicipalOfficershallsubmit
the draft redevelopmentplan and the minutesof meeting of the District
Planningand DesignCommitteeto the TehsilCouncilor the Zila Councilfor
approval.

(3) One third of the total membershipof a Committeeshall constitute

(4) A defectin the constitution or composition of a Committee shallnot

CHAPTERVII
APPEAL
56.Appeal.-(1) An aggrievedpersonmay,withinthirtydaysof issuanceof a
notificationunder these rules by a City DistrictGovernmentor a Tehsil
MunicipalAdministration, filean appealbeforethe Government.
(2) An appealundertheserulesmay be addressedto the Secretaryto
the Government, Local Government and Community Development
Department.
(3) The Secretary to the Government, Local Government and
CommunityDevelopment Department or any otherofficernominatedby the
Governmentfor hearingof the appealshall,withinninetydaysfrom the date
of filingof the appeal,decidethe samewhosedecisionon such appealshall
be final.
(4) An appealundertheserulesshallinclude:
(a) an applicationsignedby the appellant;
(b) a copyof the nationalidentitycardof the appellant;
and
(c) a copyof the impugnednotificatiort;
(d) any otherdocumentrelevantto the appeal.
(5) The appellateauthoritymay pass an interimorder during the
pendency of an appeal.

CHAPTERVIII
CONVERSION AND BETTERMENT FEE
57.Feefor conversionof land use.- (1) A City DistrictGovernmentor a
shalllevy followingfee for conversion

(a)the conversionfee for the conversionof residential,
peri-urbanareaor intercityserviceareato commercialuse shall
be ten percentof the value of the commercialland as per

precedingtwelvemonthsof commercialland in the vicinity,if
valuation tableis notavailable;
(b) ihe conversionfee for the conversionof industrialarea to
residentialuse shall be five percent of the value of the
commercialland as per valuationtable or five percentof the
averagesale priceof precedingtwelvemonthsof commercial
landin thevicinity,if valuationtableis notavailable;
(c) the conversionfee for the conversionof peri-urbanarea or
intercityserviceareato residential use shallbe one percentof
the valueof the commercial landas per valuationtableor one
percentof the averagesalepriceof preceding twelvemonthsof
commercial landin the if
vicinity, valuationtable is not available;
and
(d)the conversionfee for the conversionof peri-urbanarea or
intercityserviceareato industrial useshallbe five percentof the
value of the commercialland as per valuationtable or five
percentof the averagesalepriceof preceding twelvemonthsof
commercial landin the vicinity,if valuationtableis notavailable.
(2) A City DistrictGovernmentor a Tehsil MunicipalAdministration
shailnot levyconversion fee for the conversion of landuse to educational or
healthcare institutionaluse.
58.Feefor temporaryconversionof land use.- A CityDistrictGovernment
or a TehsilMunicipalAdministration shall levy followingfee for temporary
conversion of landuse permission granted:
(a) in accordancewith the List C at the rate of three percentper
annumof the conversion fee;and
(b)for an educational or healthcareinstitutionin accordance with
List C at the rateof threepercentper annumof the conversion
fee.
59.Betterment fee.- A City DistrictGovernmentor a Tehsil Municipal
Administrationmay, with the prior approval of the Government,levy
betterment fee in an areain which:
(a) redevelopment planfor up gradationof existinginfrastructure is
beingimplemented without change of land use;and
(b) a schemeor a redevetopment planis beingimplemented dueto
whichthe valueof propertyis likelyto increase.

MISCELLANEOUS

60.paymentof conversionfee.- (1) A City DistrictGovernment or a Tehsil


Municipal Administration shalldeema building, plotor landin a notifiedland
schemeas convertedto the use in accordance
use reclassification with the
schemefromthe notification of the scheme.
(2) Subjectto any legalrestrictions imposedunderany lawforthe time
being'inforce,an occupantof a building, plotor landmay use the building,
plot6r land,withoutany structural change,for a purposepermittedunderthe
schemewithoutpaymentof conversion
notifiedlanduse re-classification fee.
(3) Subjectto sub-rule(4),a personshallapplyto a localgovernment
for construction,alterationor reconstruction of a building,plot or land in
accordance with notifiedlandusere-classificationscheme.
(4) A local governmentshall not entertain an applicationfor
reconstiuction
construction, of a building,plotor landin a notified
or alteration
land use re-classification scheme unless the applicant has paid the

conversion fee in accordance with theserulesas applicableon the date of


submission of the application.
61.lncomefrom conversion.- A City DistrictGovernmentor a Tehsil
MunicipalAdministration shallkeepincomefrom conversionof land use in a
separateheadand shall spend the incomeon the provisionor development of
infrastructure.
62.Building line.- A City DistrictGovernmentor a Tehsil Municipal
Administration shallfix a buildingline in a land use reclassification scheme
whichshallnot be lessthan:
(a)the buildinglinespecified in the buildingbyelaws;
(b)thirty feet along a road with right of way of eightyfeet and
above;and
(c) ten feetalonganyotherroad.
63.Masterplan.- A localgovernment shallpreparea masterplan or zoning
planin accordance withtheserules.
64.Conversionof cinema site.- A City DistrictGovernmentor a Tehsil
MunicipalAdministration mayallowconversion of a cinemasite:
(a) in an approvedschemeor on land allottedon reservedprice
subjectto the followingconditions:
(i) conversionfee shall be charged as applicableto
conversion of a residentialplotto commercialuse;and
(ii) a cinemaor a projectiontheaterwith at leastone third
seatingcapacityof the existingcinemashallbe provided
in the newbuilding:
(b) on privateland otherthan the site on land specifiedin clause
(a),subjectto the followingconditions:
(i) if the cinema is locatedin an area which is not a
commercialarea than it shall not be allowedto be
converted to anyotheruse;
(ii) if the cinemais locatedin an established built up area
which is classifiedas commercial,on paymentof the
conversion fee;and
(iii) if the cinemasite is locatedin a peri-urbanarea,whichis
classifiedas commercial, on paymentof the conversion
fee.
6s.Administrationand enforcement.-The variousprovisions of theserules
shallbe administered andenforcedin accordance withthe TableD.
66.Relaxationof rules.- No provisionof theserulesshallbe relaxedin any
circumstances.
67.Repeal.-The PunjabLocalGovernment (Commercialization)Rules2004
are herebyrepealed.

CHAPTERX
INTERIMARRANGEMENTS
6S.Enlistment and survey of declared roads.- (1) A City District
Government or a TehsilMunicipalAdministration shall,withinthirtydays from
the notificationof these rules, preparea list of roads or segmentof roads
declaredas commercialby the City DistrictGovernmentor the Tehsil
Municipal Administration underany lawfor the timebeingin force.
(2) A City DistrictGovernmentor a Tehsil MunicipalAdministration
shallconductsurveyof the listedroadsand preparelistA and list B of such
roadsin the followingmanner:

(a) list A on Form 41 or A2: where more than fifty percent plots
facing the road have been converted on PaYment of
commercialization fee; and
(b) list B on Form 81 or 82: where less than fifty percentof plots
facing the road have been converted on payment of
commercialization fee.
69.Scrutiny.-The ExecutiveDistrictOfficerMunicipalServicesor the Tehsil
MunicipalOffiCershall submitthe lists to the DistrictPlanningand Design
Committeefor scrutiny.
ZO.Approval.-Afterthe scrutinyof the lists,the DistrictCoordinationOfficer
ot a bity Districtor the TehsilMunicipalOfficershallsubmitthe listsand the
minutesof meetingof the DistrictPlanningand Design Committeeto the
TehsilCouncilor the ZilaCouncilforapproval.
Tl.Notification.- (1) A DistrictCoordinationOfficerof a City Districtor a
TehsilMunicipal Officershallsignandcertifythe approvedlists,in triplicate.
(2) The CityDistrictGovernment or the TehsilMunicipal Administration
shali,withinsevendaysfromthe dateof approval,notifythe approvedlists.
T2.Circulation.-(1) The DistrictCoordination Officeror the TehsilMunicipal
Officershall retain trivocopies of the notifiedlists in an office of the City
DistrictGovernmentor the TehsilMunicipalAdministration for recordand
displayon the noticeboard.
(2) The DistrictCoordination Officeror the Tehsil MunicipalOfficer
snaitiorwardthe thirdcopyof the notifiedliststo the Government.
(3) The C1y DistrictGovernment or the TehsilMunicipalAdministration
shallpublishthe notifiedlistson its website
(4\ A personniay, subjectto paymentof fee, obtaina certifiedcopyof

being'in force, an occupint of a building,plot or land facing the road
men{ionedin a notifiedlist A, may use the building,plot or land,withoutany
structuralchange,for a commercial purposewithoutpaymentof conversion
fee.
(3) Subjectto sub-rule(4),a personshallapp.lyto a localgovernment
for construction, alterationor reconstruction of a building,plot or land facing
the roadmentioned in a notifiedlistA, for commercial use.
. (4) A local governmentshall not entertain an applicationfor
construction, reconsiuctionor alteration of a building,plot or landfacingthe
road mentionedin a notifiedlist A, unless the applicanthas paid the
conversionfee in accordancewith these rules as applicableon the date of
submission of the application.
(S) A City DistrictGovernmentor a Tehsil MunicipalAdministrdtion
shallnotentertainany application for conversion of landuseof a building,plot
or landfacingthe roadmentionedin the list B.
(6) Nothingin these rulesshall affectthe statusof a building,plot or
landwhichhas b-eenconvertedon paymentof conversionfee underany law
for the time beingin force.
T4.Prohibition.- A City District Governmentor a Tehsil Municipal
Administration shallnot a-llowconversion of a building,plot or land.reserved
for educationalinstitution,healthcareinstitution,post office, police station,
pl"r" of worshipor any otherplot sold by a publicauthorityat reserveprice
for a specificuse.

commercialization fee has been depositedprior to th;

of theserules;and
(b) list D on . Form D1 or D2: where the temporary
commercialization fee was due but the same has not been
deposited priorto thenotification
of theserules.
76.Scrutiny.- The ExecutiveDistrictOfficerMunicipalServicesor the Tehsil
MunicipafOfficershall submitthe lists to the DistrictPtanningand Design
Committeefor scrutiny.
77.Approval.- After the scrutinyof the lists,the DistrictCoordinationOfficer
of a City Districtor the TehsilMunicipafOfficershall submitthe lists and the
minutesof meetingof the DistrictPlanningand DesignCommitteeto the
TehsifCouncilor the ZilaCouncilforapproval.
TS.Notification.-(1) A DistrictCoordination Officerof a City Districtor a
TehsilMunicipal Officershallsignandcertifythe approvedlists,in triplicate.
(2) The CityDistrictGovernment or the TehsilMunicipalAdministration
shall,withinsevendaysfromthe dateof approval,notifythe approvedlists.
T9.Circulation.-(1) The DistrictCoordination Officeror the TehsilMunicipal
Officershafl retain two copies of the notifiedlists in an office of the City
DistrictGovernmentor the TehsilMunicipalAdministration for recordand
displayon the noticeboard.
(2) The DistrictCoordinationOfficer or the Tehsil MunicipalOfficer
shallforward the thirdcopyof the notifiedliststo the Government.
(3) The CityDistrictGovernment or the TehsilMunicipal Administratisn
shallpublishthe notifiedlistson itswebsite.
(4) A personmay,subjectto paymentof fee, obtaina certifiedcopyof
a notified list from the City DistrictGovernmentor the Tehsil Municipal
Administration.
80.:Gonversion status.- (1) Subjectto the landuse classification of an area,
a City DistrictGovernment or a TehsilMunicipalAdministration shall,within
ten years from the notificationof these rules, phase out temporary
commerdalization of a buildingmentionedin list C.
(2) A City DistrictGovernmentor a Tehsil MunicipalAdministration
shall,withintwo monthsfrom the notification of the list D, issue demand
noticeto all the defaultersfor paymentof outstandingdues oi temporary
commercialization.
(3) In casea defaulterfailsto depositthe outstandingdueswithinthirty
days from the date of issuanceof the demand notice,the City DistriCt
Governmentor the Tehsif MunicipalAdministrationshall cancel the
permissionfor temporary commercialization and shall take action in
accordance withthe law.
(41 Subjectto any legalrestrictions imposedunderany'lawfor thetime
beingin force,an occupantof a buildingmay use the building,withoutany
strqctural change, for a purpose permitted under the temporary
commercialization.
