EXPLAINATION LETTER

(March 29, 2019)


Statement:

At around 5:00PM of February 22, 2019 a turn-over of activities was conducted by Jesus Paton, CLJV
Project Superintendent for Viaduct & Causeway at site to Boljack Entero, Site Engineer for causeway
giving him instruction not to continue the backfilling works because of the debris of trees along the line
of backfilling works. Boljack Entero agrees with the instruction of Jesus Paton not to do backfilling works
that night.

Answer:

At around 5:00Pm of February 22, 2019 a turn-over of activities inside the field office conducted by
Engr. James Polancos together by Jesus Paton sitting at the front table and Engr. Eddie Sabandal sitting
at the last chair with table. Jesus only sitting on the chair and I ask him” How are you?” and He said I’m
fine he was only listening the turn over of works between me and Engr. James Polancos but we are only
discuss about gabion works and backfilling works are not mention. After a few minutes conversation
Jesus Paton, James Polancos and Eddie Sabandal left the room and going to Service boat access.

Statement:

But around 7:39PM that night Eddie Sabandal, Project Superintendent for causeway inform the group
that the team from cordova who are incharge of the clearing of the trees that are along the line of the
carriageway of the project are going back to site that night to remove the debris that they left the other
night when they cut some trees. Eddie Sabandal instructed Boljack Entero who is working that night in
the temporary Cordova Access road to check the area that the group from cordova is going to clear.
Eddie Sabandal reminded Boljack Entero to make sure that the area is clear and free from debris before
proceeding with the backfilling works. I also reiterated to Boljack Entero to make a proper
documentation of the action to be taken prior to proceeding with the backfilling works if the area will be
cleared so that we an evidence if somebody will ask about the status of that area. I mentioned to him to
better take photos first of the area before he proceeds with the back filling works again.

Answer:

Around 8:50pm Engr. Eddie Sabandal calling from phone that the group team of clearing will arrived
at site and he told me to look for the best option to solve the issue of mangroves debris and used your
initiative if necessary. Immediately I will proceed to embankment area to meet the clearing team, when
we meet their team leader I was instructed him to removed the debris out the embankment way but I
saw them they cannot removed the debris because of heavy and full of thorn and I ask to BNR their
excavator to help removing the debris but they refuse because of uneven seabed and afraid of
breakdown at seabed area. Because of too much delayed in embankment and I was being worried about
the cost of delayed per day I admit I give the instruction to BNR to proceed the embankment in order to
make forward the embankment works since the mangroves already cut, there is no point for me to stop
the work. I admit I will make my own initiative to help the company to move forward in fact we are not
receiving any complain from the consultant and to all stake holder regarding what I did, not even
Incident report or damage property or loss of money even a single cent to our side.
I was very disappointed for this incident report made by our own team despite of my loyalty and effort
to help the company to fast track the project implementation.

But anyway whatever the decision of the company I will heartily accept for the good all of us.

I wanted to thank for taken my side for this issue and I have learned a lot from this and I will not do it
again.
