AGREEMENT FOR SUBLEASE OF A CONTAINER

This Agreement is made at Dar es Salaam this 25 TH day of March 2019

between

SEBASTIAN FABIAN MLINGWA, of P.O. Box 1968 ,Dar Es Salaam hereinafter

referred to as “sub lessor” (which expression shall include wherever applicable his
heirs, executors, legal representatives and assigns) of the ONE PART
AND
BETTY SHESHE, of Tabata , Dar Es Salaam, hereinafter called “the sub tenant”,
(which expression shall include wherever applicable, legal representatives and
assigns) of the OTHER PART.
WHEREAS the sublessor is the lawful tenant of a THTU container situated at The
College of Business Education in Ilala Municipality, Dar Es Salaam.
AND WHEREAS the sub lessor has offered to sublet the container together with all
exhausted and unexhausted improvements made, carried and the sub tenant has
agreed to occupy and conduct stationery business as terms and conditions stipulated in
the main tenancy agreement between Mr. Sebastian Mlingwa and THTU.

NOW THIS AGREEMENT WITNESSETH AS UNDER:

1. That in pursuance of the said agreement and in consideration of Tanzania

Shillings ……… to be paid by the subtenant to the sub-lessor, the subtenant
shall occupy and conduct stationery business at THTU container situated at the
College of Business Education Dar es salaam as per terms and conditions
stipulated in the main tenancy agreement between THTU CBE Branch and Mr.
Sebastian Mlingwa..

2. That the rental fee herein above stipulated shall be paid in full upon execution of
this agreement and the sub lessor, by signing and execution of this agreement,
acknowledges to have received the full fee herein stipulated and acknowledges
that him, his heirs, assigns, and any other person claiming under him, shall have
no claim whatsoever from and against the sub tenant in respect to this
transaction.

3. The sub lessor doth hereby covenants with the subtenant that he is the lawful
occupier of the container, and he has full powers to conduct stationery business
as per terms and conditions stipulated above.

4. The sub lessor assures the sub tenant that he has received the consent from the
owners of the container (THTU) and all other consents legally required to be
obtained in respect of sublease of the container and that the subtenant may
 quietly enjoy quiet occupancy without any interruption, claims, demands or
disturbances whatsoever from the said sub lessor or any other person or persons
claiming through, under or in trust for him.

5. The sublease agreement will terminate on…………………………………

IN WITNESS WHEREOF the vendor and the purchaser have hereunto set their
respective hands to this indenture of sale on the day, month and year first above herein
written.
