Greetings.

In reference to your request to appeal the foregoing case, please be advised of the
following:

1. Appealing the decision to the Commission will put into issue all claims of the
complainant as stated in the complaint, including salary differentials and the
legality of the dismissal itself. Accordingly, there is a risk that the entire
decision will be reversed by the Commission, in which case we will then be
ordered to pay for salary differentials, backwages and to reinstate the
complainant to his former position or the payment of separation pay in lieu of
reinstatement.

2. As per rules governing appeals, we will be required to put up a cash or surety

bond in the amount of the award. Without such bond, our appeal will be
dismissed by the Commission.

3. Aside from these, the legal costs in pursuing appeal may be more than the
amount of the award in the decision.
