TERMS & CONDITIONS
1. During and after any given function, the number of cover is determined by an employee of the HOTEL and his/her count
will be accepted as final. The CLIENT may, however, appoint a representative of his/her own choice which shall be made
known to the HOTEL’S employee. In case of discrepancy, the count of the HOTEL’S employee and that of the CLIENT’S
representative shall be reconciled and agreed upon by them. Failure on the part of the CLIENT to appoint such
representative shall constitute a waiver on his/her part to question/contest the number of cover as determined by the
HOTEL’S employee.

2. The CLIENT binds himself/herself to pay the minimum cover as relayed by him/her to the HOTEL. The CLIENT likewise
agrees to pay the actual number of covers served in excess of the guaranteed minimum cover.

3. Any requests for changes on the number of covers and menu to be served must be received by the HOTEL at least seven
(7) days before the date of function so as to allow the HOTEL to effect the changes requested. Failure to make such
request shall not bind the HOTEL to make any changes to what has been originally agreed upon except when the change
pertains only to additional covers over and above the minimum cover, the HOTEL, at its sole discretion, may provide
additional cover or other options, depending on the function menu, venue, capacity, and time available to make the
adjustments. All costs relating to such adjustments will be paid by the CLIENT.
4. The CLIENT agrees to pay a blocking fee of P5,000.00 upon reservation of function. Notice of cancellation of function
must be made in writing at least 45 days prior to scheduled function. In such case, the blocking fee is forfeited. Notice of
cancellation received within 45 days prior to the function date shall not be accepted and the CLIENT shall pay the
guaranteed minimum cover for the function. Notice of postponement shall also be made in writing 30 days prior to original
date of function subject to availability of function room/hall. The CLIENT hereby agrees to pay another P5,000.00 blocking
fee of the new date of function.
5. All Food and Beverage items shall be purchased exclusively from the HOTEL and the CLIENT is prohibited to bring food
and beverage into the hotel premises unless previously negotiated and agreed with the HOTEL.
6. The CLIENT assumes full responsibility for any damage and/or loss to HOTEL properties used during the function caused
by participants and guests.
7. The HOTEL reserves the absolute right to change, with or without prior notice to the CLIENT, the venue/room of function
which can accommodate the minimum cover.
8. The CLIENT agrees to have his/her/its guests/participants vacate the function room at the agreed closing hour and to pay
the HOTEL for any overtime wages and additional operational expenses incurred for services extended beyond the
agreed number of hours, in case of an extension with or without the CLIENT’S request.

9 .The CLIENT agrees to make a cash deposit of 50% of the contract price upon signing of this contract 45 days prior to the
scheduled function date. In the event that no contract is signed within the said period without fault on the part of the
HOTEL, the reservation shall be cancelled.

10. For reservations made less than forty-five (45) days prior to function date, the CLIENT undertakes to pay the FULL
AMOUNT and minimum cover of the contract price as well as sign the contract. Absent any of these, the reservation shall
not be confirmed.
11. If an outstanding account is referred to a lawyer for collection, the CLIENT agrees to pay 25% of the unpaid amount as
attorney’s fees and further agrees to shoulder all costs and expenses of litigation, if case(s) is/are filed before our courts of
law. It is likewise expressly agreed upon by the parties that venue for any litigation shall exclusively be in the City of
Tagbilaran.
12. It is hereby agreed that the HOTEL shall not be liable for failure on its part to comply with terms and conditions herein in
case of labor dispute, fortuitous events, or other causes beyond the HOTEL management’s control.
13. The CLIENT undertakes that all information he/she provided herein are all true and correct and/or he/she is duly
authorized to represent the corporation/institution/partnership/entity he/she is representing in this contract. Any
misrepresentation on the CLIENT’S part shall be sufficient ground for cancellation of this contract with forfeiture of the
deposit and/or blocking fee.
14. Function rates are subject to change without prior notice to the CLIENT. In such events the CLIENT binds himself to pay
for the said increase.

15. In events of force majeure or Acts of God, the blocking fee shall no longer be refunded while down payment or full
payment will be converted into room accommodation if feasible.
