APPLICATION FOR PROBATION

COMES NOW, accused, by the undersigned counsel and unto this


Honorable Court, most respectfully applies for Probation under the
provisions of Presidential Decree No. 968, as amended, and states that:

1. That, on ______________________ the accused pleaded GUILTY to the lesser


offense defined and penalized under ______________________________________;

2. That, by virtue of such guilty plea, a Decision was promulgated by this


Honorable Court in the presence of the accused on the same date,
sentencing her to suffer the ________________________________________________;

3. That, the accused desires that she be on temporary liberty under


the strength of her original bond while the __________________Probation
Office is conducting post investigation;

4. That, the accused was not sentenced to serve a maximum term of


imprisonment of more than six (6) years;

5. That, the accused has not been convicted of any crime against the
national security;

6. That, the accused has not been previously convicted by final judgment
of an offense punished by imprisonment of more than six (6) months
and one (1) day and/or a fine of more than one thousand pesos
(P1,000.00);
7. That, she has not been once on probation under the provisions of PD
No. 968;

8. That, she is not serving sentence at the time the substantive provisions
of PD No. 968 became applicable pursuant to Section 33 thereof;

9. That, accused has all the qualifications and none of the disqualifications
to avail of the benefits of the Probation Law.

WHEREFORE, premises considered, it is most respectfully prayed of


this Honorable Court, that an Order be issued granting the accused’s
Application for Probation upon such terms and conditions that may be
deemed just, proper and she be allowed provisional liberty under the same
bail she posted pending application for her probation.

Other reliefs, just and equitable under the premises, are likewise
prayed for.
