DEED OF CONDITIONAL SALE WITH TRANSFER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

This instrument, made and executed by and between:

JEANNETTE S. ORTIZ, Filipino, of legal age and a resident of 45


Mahogany St., Nova Tierra Village, Lanang, Davao City, Philippines,
hereinafter called as the VENDOR

-and-

ENGR. HARRY LOPEZ, of legal age and a resident of Ladislawa Village,


Buhangin, Davao City.

WITNESSETH:

THAT the VENDOR is the lawful owner of that certain parcel of land,
situated at Barrio of Maduao Callawa, Buhangin District, described as
follows:

“A specified parcel of land, being Transfer Certificate of Title No. T-


412280 Lot A, Psd-112315-039821 being a portion of plan H-134714. Bounded
on the NE., along line 4-5 by public land on the E., along lines 5-6-1 by property
of Anatalio Banguera; on the SW., along line 1-2 by lot B; on the W., along line
2-3 by Lot C; along line is registered in accordance with the provision of section
103 of the property registration decree in the name of JEANNETTE S. ORTIZ, of
legal age, Filipino and a resident of 45 Mahogany St., Nova Tierra Village,
Lanang, Davao City, containing an area of FIFTY TWO THOUSAND ONE
HUNDRED TWENTY NINE SQUARE METERS (52,129 sq.m.)

That the VENDOR is the absolute lawful owner of the above-described


parcel of land, which is now affected by the DPWH widening by pass-road
project. Please see attached DPWH approved parcellary survey.

That the VENDOR hereby sells, conveys and transfer to the VENDEE is
heirs and assigns, the above-described portion of these parcel of land:

1. That the VENDOR sell 13, 423 sq.m. as portion of this described parcel of
land;
2. That the consideration of the sale, is Five hundred pesos per square meter or
a total of SIX MILLION SEVEN HUNDRED ELEVEN THOUSAND FIVE
HUNDRED PESOS (P6,711,500.00), Philippine Currency only;
3. That the VENDOR shall give the VENDEE the absolute and complete control
and possession of the subject property and allow the introduction of
improvements thereon upon receipt of the agreed payment; and
4. The VENDOR hereby waives and renounces in full and absolute manner her
rights, title and interest to the subject property in favor of the VENDEE.

IN WITNESS WHEREOF, the parties have hereunto set their hands this
