Petitioner :- Smt. Rita Mahali (Aunt i.e. father’s sister ) W/O Sri. Vairab Mahali
of Moinagarh T.E. Cachar for the victim girl Smt. Smriti Teli.
In the matter of;
A petition for taking Zimma
(custody) of the victim girl Smt. Smriti
Teli who is presently under the care &
custody of Ujjawala Home.
Most respectfully submit;
1. That, the petitioner is the Aunt i.e. father’s sister of the victim girl Smt.
Smriti Teli who was recovered from the custody of the above accused
(in custody) after long period and the concerned police produced before
the Hon’ble court for recording statements U/S-164 Cr.P.C. on 08-04-
2019 and she refused to go at her matrimonial house nor to the parental
house and since then she is under the care & custody of Ujjawala Home.

2. That, the Causin sister of the petitioner namely Smt. Smriti Teli(victim)
is appeared in the examination of H.S.L.C.2019 and accordingly passed
the said exam. but due to non-received by her, the concerned school
authority did not supply Markssheet and Pass Certificate to the parents
as wellas to the petitioner except issued a Provisional H.SL.C. Pass
Certificate in favour of her on 24-05-2019 on request by the petitioner
on behalf of parents for admission of her brighter career and life as the
time of admission is going to be expired. Contd…P/2

3. That, on perusal of her ADMIT CARD of examination of H.SL.C.2019 , she
is major and her date of birth is 14-11-2000 and presently aged about-
18 years six months.

4. That, now the parents are desired to take custody of their said
daughter as “Zimma” but they are old aged ailing persons and mother of
the victim namely Anita Teli empowered their sister -in-law namely
Smt. Rita Mahali i.e. petitioner by executing and sworn an affidavit to
file petition for taking Zimma of their said daughter namely Smirti Teli
aged about- 18 years six months from the Ho’nble Court of S.D.J.M(M)
Lakhipur, Cachar as the parents of the victim have no sons and only two
daughters namely Smirti Teli aged about- 18 years six months
(victim)and Priti Teli aged about- 12 years except their only female
sister -in-law namely Smt. Rita Mahali W/O Sri. Vairab Mahali of
Moinagarh T.E. Cachar i.e. petitioner.

5. That, the facts is that affidavit executant’s( mother of the victim)
brother in-law’s daughter namely Smti. Anju Teli aged about- 19 years
marriage was fixed for solemnized with Sri. Diren Teli i.e. the informant
of Lalang T.E. on 12th March, 2019 but she was fled away with his lover
and get married with him and the parents of the Smti. Anju Teli i.e.
brother in-law no other alternative requested her to give marriage the
said elder daughter namely Smirti Teli i.e. victim with Sri. Diren Teli i.e.
the informant of Lalang T.E. on 12th March, 2019 and accordingly given
marriage with him on the said fixed date .

6. That, the victim mother’s have no knowledge that there was a lover
boy of her said elder daughter namely Rahul Teli and after her
marriage with Sri. Diren Teli i.e. the informant of Lalang T.E. , she also
fled away with her lover boy namely Rahul Teli i.e. accused on 31-03-
2019 and her said husband Sri. Diren Teli lodged FIR against the Rahul
Teli to the O/C Lakhipur P.S. and same is reistered Vide Lakhipur P.S.
Case No. 83/ 2019 U/S-366 IPC and during investigation the accused
Rahul Teli was arrested and her said daughter was recovered from the
custody of the said accused and produced before the Ho’nble Court of
S.D.J.M(M) Lakhipur, Cachar but during recording Statements U/S- 164
Cr.P.C. my said daughter denied to return at paternal house nor to the
house of her earlier matrimonial house and presently she is residing
under the care and custody of “UJJAWALA HOME” since long.

In view of the above facts and circumstances, it is

prayed that the Smirti Teli i.e. victim may kindly be given
“Zimma” to the petitioner as Aunt i.e. father’s sister on
behalf of the parents for admission of her brighter career
and life as the time of admission is going to be expired for
ends of justice ;
