MOTION TO LIFT WARRANT OF ARREST & CONFISCATION OF BOND

COMES NOW, accused, by himself, and unto this Honorable Court

most respectfully states:

That on September 26, 2016, the Honorable Court ordered the

issuance of a warrant of arrest and the forfeiture of bond against herein
accused for his failure to appear on the scheduled hearing of the above-
entitled case;

That the absence of herein accused on said date and hearing was due
to the fact that prior to the said date of hearing, he was confined at the
Batangas Medical Center and stayed there for one (1) week until his
recovery, copy of the Medical Certificate is hereto attached to form part of
this Motion;

That accused is now in custody by virtue of the said Warrant of

Arrest;

That accused has no intention to delay the proceedings of this case

and his absence in the hearing of the case is solely because of the above-
mentioned reason;

That accused requests for the Honorable Court’s kind indulgence and
understanding as well as that of the prosecution for his non-appearance and
prays that the Order for his arrest and the posting of bond be recalled.
