Habitual Tardiness
**Any employee shall be considered habitually tardy if he incurs
tardiness, regardless of the number of minutes, ten (10) times a
month for at least two (2) months in a semester or at least two
(2) consecutive months during the year.

Section 1: Entitlement of Leave Privileges
Appointive officials up to the level of:
•Heads of executive departments
•Heads of departments
•Undersecretaries and employees of the government (permanent,
temporary or casual who render work during the prescribed office hours)

•Leave of absence for any reason other
than illness of an official or employee or
of any member of his immediate family
must be contingent upon the needs of
the service. Hence, grant of VL shall be
at the discretion of the head of
department/agency.

Used for:
• Tardiness and undertimes, except on
account of sickness
• Regular monetization
CONDITIONS:
a. The Head of Agency shall, upon prior
consultation with the employees,
prepare a staggered schedule of the
mandatory 5‐day VL of officials and
employees, provided that he may, in the
exigency of the service, cancel any
previously scheduled leave.
CONDITIONS:
b. The mandatory annual 5‐day VL shall
be forfeited if not taken during the year.
However, in cases where the scheduled
leave has been cancelled in the exigency
of the service by the head of the agency,
the scheduled leave not enjoyed shall no
longer be deducted from the total
accumulated VL.
CONDITIONS:
c. Retirement and resignation from the
service in a particular year without
completing the calendar year do not
warrant forfeiture of the corresponding
leave credits if concerned employees
opted not to avail of the required five‐
day mandatory leave.
CONDITIONS:
d. Those with accumulated vacation leave
of less than 10 days shall have the option
to go on FL or not. However, officials and
employees with accumulated VL of 15
days who availed of monetization of 10
days, under Sec. 22 (ORL), shall still be
required go on FL.

by a proper medical certificate.

• When a person whose leaves have been
commuted following his separation from
the service is reemployed in the
government before the expiration of the
