Study Grant Agreement

Between

Mangosuthu UNIVERISITY OF TECHNOLOGY

(Hereinafter referred to as The University)

And

……….. (Full names of employee)

………………………………………… (Employee’s numbers)

(Hereinafter referred to as “The Employee”)

1. PREAMBLE

WHEREAS the Employee wishes to improve his/her formal qualifications by registering for a further
studies with a higher Education Institution,

WHEREAS the University has promulgated an Attainment on Formal Qualifications (“Policy), which
facilitates the funding of an employee’s registration fees and tuition fees as well as the granting of
leave to enable an employee to engage in such further study.

WHEREAS the Employee has applied for and been granted funding by the University in order to
enable him/her to further his/her study in accordance with the said Policy,

WHEREAS the employee has also applied for and been granted study leave by the University in order
to enable him to further his/her study in accordance with the said Policy (this paragraph to be
scratched if not applicable)

AND WHEREAS the Employee acknowledge that, in terms of the said Policy, every employee who
receives such assistance from the University shall be required to remain in the employ of the
University for the certain duration after the completion of such assistance to the University for an
equivalent period not so worked by such employee,

WHENCEFORTH the University and the Employee hereby enter into an agreement, the term and
condition whereof appear hereunder:

2. DEFINITIONS

2.1 “Employee”- shall mean a permanent employee or an employee who is on a fixed- term contract of
two (2) years or longer.

2.2 “Institution”- shall mean a higher educational institution at which an employee has registered for a
further study.

2.3 “Study fee”- shall include registration fees and tuition fees.

2.4 “Study leave”- shall include leave for research, pursuing formal qualification and placements for
further development.

2.5 “Parties”- shall mean Mangosuthu University of Technology and the Employees.

2.6 “Policy”- shall mean the Policy on Attainment of Formal Qualifications of the University.

2.7 “Programme”- shall mean a formal qualification pursued by the Employee at an Institution with the
objective of improving his/her own qualifications.

2.8 “University”- shall mean Mangosuthu University of Technology

3. GRANTING OF STUDY FEES

3.1 The Employee certificates that he/she has been accepted in the programme ________ (name of
the qualification) with ____________________________ (name of the Institution) with effect
from___________________ (date of first registration).

3.2 The University hereby agrees to pay the Employee’s study fees with the Institution until he/she
completes the programme, subject to the provision of clause 6 of the Policy on Attainment of
Formal Qualifications. The total amount of study fees for the first year of study shall be as
reflected in Annexure “A” hereto. The study fees for subsequent year shall also be annexed to
this agreement and initialed by both parties.

3.3 The registration and tuition fee is paid as enshrined in section 7 of the policy.

4. GRANTING OF STUDY LEAVE (If applicable)

4.1 Subject to the provisions of the Policy, where an approved application requires the granting of
study leave to an employee; such leave shall be granted on the basis of 1: 1.

4.2 It is hereby recorded herein that the Employee has been granted__________________ study
leave days in order to pursue the accredited programme with the Institution.

5. BONDING AGREEMENT

5.1 As a quid pro quo (in return for) for the financial assistance granted to him/her as well as the
study leave granted to him/her by the University, the Employees hereby agrees and commits to
remaining in the employ of the University after the completion of his programme for a period
which is in accordance with the provisions of section 10 of the Policy.

5.2 Upon completion of the programme, the incumbent Head in the Department of Human
Resources and Development shall, having regard to the provisions of the Policy, compute the
envisaged period and thereafter issue the Employee with a written notification of such period.

6 REPAYMENT AGREEMENT

6.1 The employee agrees that he/she will be liable to repay to the university any financial
assistance, with interest, rendered to him/her by the University under one or more of the
following circumstances:

61.1 If he/she fails to comply with any of the provisions of the policy as well as this
agreement, in which event he/she shall be liable to repay the full amount paid in respect
of his/her study fees.

6.1.2 If he/she leaves the University for any reasons whatsoever prior to him or her complying
with the provisions of Clause 4 hereof, (other than a termination of his/her services
based on operational, requirements or incapacity arising from ill-health or injury), in
which event he/she shall be liable to repay that proportion of the study fees which
he/she has not worked off;

6.1.3 If he/she fails to successfully complete for which the grant was approved, in which event
he/she shall be liable to repay full amount paid in respect of his/her study fees.

6.2 For purposes of determining the amount(s) envisage in Clause 5.1 above, the incumbent Head in
the Department of Human Resources and Development shall issue the employee with a written
notification of such amount and which shall constitute conclusive proof of the amount due by
the employee to the University.

6.3 The amount of interest shall be calculated at the prime rate charged by the University bankers.
To this extent, the University shall be required to produce documentary evidence of such
interest rate to the employee.

6.4 The employee hereby authorizes the University to retain, by way of set-off against his/her
liability, any monies which may be due to him/her by the University or any other third party

7. GENERAL

7.1 This document constitute the agreement between the parties and no alteration, variation, or
addition shall be of any force or effect unless reduced to writing as an addendum to this
agreement and signed by both parties.

7.2 No failure or delay on the part of either party in exercising any right, power or privilege preclude
any other or further exercise thereof, or exercise of any other right, power or privilege.

7.3 If any clause or term of this agreement should be invalid, enforceable or illegal, then the
remaining terms and provisions of this agreement shall be deemed to be severable there from
and shall continue in full force and effect unless such invalidity, enforceability or illegality goes
to the root of this agreement.

7.4 The parties choose the following addresses for the purpose of any notices or legal process that
may be served in terms of this agreement:
