TOPIC/DISCUSSION/ACTION ITEM
The Project Affected Persons of Barangay San Isidro were gathered in their Barangay Hall for the
conduct of the consultation meeting.

Checklist were given to the PAPs for them to comply for possible claim for payments.

Agenda Item No. 1 Technical aspect


The project will start at Sta. 0 + 00 – Sta. 699.

Mr. Gumabao explained that this project is for implementation this 2019 since it is already included
in the GAA. If the fund of this project lapses, then it will be returned back to the National Treasury.

The design of the project for Dike 1 shall include the foundation of steel sheet pile. Then there will
be a construction of a pile cap for the connection of routed riprap and structural concrete.

At the top of a structure would be a parapet, for the protection of the pedestrians, of .40 meter
wide. There would be a pavement of 1 meter and a foundation of .50 meter.
All in all, dike 1 is 8 meters wide reckoned from the bank of the river.

As for Dike 2, there will be a boulder of .20 to .30 diameter. It will also include as steel sheet pile,
a construction of pile cap, routed riprap, structural concrete, and a parapet. There will also be a
foundation at the back of the structure.

The dike 2 is 10 meters wide from the bank of the river.

As for the dike 3 there will be boulder of Class A. It will also include a steel sheet pile, a construction
of pile cap, routed riprap, then structural concrete with steel bars. Sheet piles will also be added.

Agenda Item No. 2 Right-of-Way Aspect


Engr. Orobia explained that the primary objection of the implementation of this project is to ensure
the safety of the people as well as their properties that might be affected if there would be a change
in the course of the river.

Engr. Orobia clarified that the measurement of the easement shall be from the bank as provided in
Art 51 of the Water Code of the Philippines (RA 1067, January 1976). Shores of seas within a zone
of three meters in urban area, 20 meters in agricultural areas and 40 meters in the forest areas are
subject to public use. The discussed flood control project falls within the 20 meters easement.

According to Article 91 of the Water Code of the Philippines it is prohibited to construct structures
within the 20 meters easement. He explained that sometimes due to human consideration, no one
apprehended for those who have constructed within the 20 meters easement.

He also explained about the cash-based portion of the project program of the current
administration. The payment would be only the up to the portion finished. The rest would be
returned to the treasury.

Agenda Item No. 3 Open forum


Kagawad Talento asked if the implementation will utilize pile cap or tubo or concrete. He added
that the construction of a flood control structure before utilizes tubo.

Engr. Orobia that it would be concrete with sheet piles. He also added that the project plan is a
public document and if they ever observe that there is something wrong during the implementation,
then they may inform the district or regional office regarding the matter. It would be better if they
would have a documented proof of their complaint.

A male attendee said that the drainage in their area was washed out by the water from the river.
He asked if they can request for the reconstruction of the said drainage.

Engr. Orobia said that they may request this during the implementation charged from the budget
of project implementation.
Ms. Geraldine Bernabe asked if a path or stair could be provided for those who have bangka can
be provided.
Engr. Orobia answered that they may request for it. A male attendee added that the contractor will
coordinate with the barangay captain prior the project implementation and the residents may use
it as a chance to inform the implementing office of their concern pertaining to project.

Kagawad Talento, in behalf of the Project Affected Residents, asked what will happen to those
structures that would be affected by the project.

Engr. Orobia reiterated that the government cannot pay for those illegally constructed structures.
It is also not included in the contract of the contractor to pay for those mentioned. He however
explained that there are some contractors who extends assistance to the PAPs.

A male attendee asked what if the project has been already finished and there has been a portion
that was skipped due to unwilling owner whose structure is within the easement.

Another male attendee shared that “malawak pa noon ang lupa, ang ginawa pinagkalkal yung lupa.”

Engr. Orobia answered that he cannot really comment whether the act was wrong since they might
be considering deepening/widening if the river is constricted.

Engr. Orobia clarified that the river control project is programmed to be completed all throughout
but the implementation would be intermittent since the allotted fund cannot cover the whole flood
control project.

Agenda Item No. 4 Other matters

Mr. Gumabao explained the concerns of the DENR and PCA. The DPWH should have an approved
permit before they can cut a tree. One of the requirements is the conduct of the consultation
meeting and that the residents in the barangay is represented by the Barangay Captain as well as
the Mayor and that they do not interpose any objection to the cutting of the affected trees. The
trees inside the easement of 20 meters will be turned over to the DENR and they will have the
jurisdiction over it. The DepEd shall be the first beneficiary of the cut trees. The LGU may also
request for it, supported by estimate and quantity that they will use.

He further explained that for every tree that will be cut, 100 seedlings or saplings shall be replaced
and shall be planted on the designated place by the DENR. It shall be maintained by the contractor
for 3 years with a survival ratio of 80%.

Engr. Orobia added that the residents in the barangay shall be benefited of the project
implementation since there is a law that provides for the employment of the project affected persons
through the labor force. If they are qualified then they can be hired by the contractor.
The checklist of requirements to receive compensation was explained by Engr. Orobia and a copy
given to the barangay.
