Sub: Submission of request to stop the on line sale of scheduled(H,H1
and X) drugs in India.
Ref: Draft Notification dated 28/08/2018 published in the Gazette ofIndia
for allowing e-pharmacy for retail sale in India by GOI.
1. INTRODUCTION :
The Tamil Nadu Chemists and Druggist Association (TNCDA) , Chennai having
40000 membership is affiliated to National Trade association “ALL INDIA
ORGANISATION FOR CHEMISTS AND DRUGGISTS (AIOCD)” having
membership of about eight lakh (8,00,000) pharmaceutical traders all over India.
We have already submitted our objections to permitting e- Pharmacy in India providing
elaborate details of dangers and Adverse effect in sale of drugs in online compare
to very few advantages expected from e-Pharmacies likely to be benefited that too
by few corporates and micro fraction of Indian population. There is no doubt that
Online sale is an advent of new technology but with respect to sale of drug is
concerned, most of the countries like China, Japan, Germany, France,Russia and

other Asian countries have permitted e-pharmacies only for selling of Over the
counter (OTC) drugs(‘non-prescription’ medicines) and not for prescribed medicines.
However USA, CANADA, BRAZIL have permitted for online sale of drugs
because they have pool proof system to monitor and regulate the online sale and very
less number of community pharmacies and located faraway from public reach. The
Government of Indiais well aware that these countries are already facing extreme
difficulties to stop the sale of counterfeit drugs and not of standard quality (NSQ)
drugs by rogue online web sites as many rogue pharmacies are operating in their
countries.
Hence Permitting e- Pharmacies for selling of life saving Schedule H, H1 and X
drugs in India is great harmful attempt and substantially increase counterfeit and
substandard drugs in the market and public will suffer by getting substandard and
fake medicines. At present, clandestine sale of medicines over internet are operating
in India and selling the drugs. The regulating authorities are unable to identify and
eliminate those illegal online operators even after Delhi high court order to stop the
sale of line sale drugs in India and facing extreme difficult to ensure efficacy,
safety and quality of drugs to consumer through these unauthorised/unlicensed
online operators.
2.0. The following are some of the harms, sufferings, risk of life threatening
resulting from online purchase of unsafe, counterfeit and not of standard quality
drugs. The reasons for strongly opposing online sale through e-pharmacies in
India for prescribed medicines and even for permitting online sale of OTC drugs,
the government of India, before permitting the e-pharmacies for OTC drugs, the
following important information/requirements/regulation/ systems are to be ensured
to monitor the online sale of OTC drugs (there is scope to include some more
medicines to OTC brand from scheduled drugs which can be bought without
prescription by consumer and no harm to human consumption/application).
a) We have at present about 8 lakh community pharmacies licensed and operated
in India which is almost equal to total pharmacies existing in most of the top 20
countries in the World (USA-67000. China-2,00,000 Japan.26000, etc.,). Our

domestic turnover of about one lakh crore (1.1% of world total turnover of
ninety lakh crores as per MAT 2016) which works out to an average turnover of
about Rs.12.5 lakh per annum per pharmacy with meagre margin of 16% of total
average turnover of Rs. 12.5 lakh works out to an amoun of about Rs 2.0 lakh
per year per pharmacy and is providing livelihood for dependent of more than
30 lakh Indian population and providing jobs (self and full time employment)
for about 8 lakh qualified pharmacist. The individual shop owners are struggling
to maintain and sustain in running the pharmacy as the cost of selling
medicine is sharply increasing in all fronts with fixed margin of 16% provided
by Drug price control order to retailers.

b) The community pharmacies in India is located at remote villages, medium


towns, big towns, metro cities and quality and effective medicines are sold with
in the distance of customer reach. The pharmacists are ensuring availability of
medicines to our population and patients are satisfied with ease of buying
medicines immediately. At present we have one pharmacy for every 1600 people
in India and no other countries have this much cluster of pharmacies

c) According to World Health Organisation (WHO) more than 50% of drugs


available for sale on the internet are believed to be spurious, counterfeits and
not of standard qualities (This is on the basis of report during Dec, 2012). In
fact, compliance with the report, Ordinance was published in the official journal
of French Republic. The European countries permit online sale of non-prescription
(OTC) drugs only and also they have provided strict conditions for online sales
of OTC brands.

d) The Health professionals are not favouring this unnecessary and hazardous new
proposal of on-line sale of prescribed drugs in India. As the minors and youngsters
can buy controlled suspense without adult supervision and become addict.

e) Even in the most advanced countries like USA, nearly 30% of the internet
buyers have informed that they lacked confidence as per new survey among the
online buyers of medicines.

f) In India, the medicine is brought under essential commodities and it is mandatory
for essential commodity marketer to ensure the compliance with relevant statuary
requirements as per Essential Commodity Act, 1955. Further, the effective
controlled pricing of National list of essential medicines are fixed and notified
under Drug Price Control order(DPCO) by NPPA, Department of
pharmaceuticals, Govt. of India and Maximum Retail price of drugs is fixed
with specific margin of 16% to retailers. Hence price advantages expected
over internet is not possible in India unless unethical trade practice is carried out
and monopoly in business is established by e-pharmacy operators. In most of the
countries in the world, there is no drug price control order is imposed on the
manufacturer by the Government and no margin is fixed for retailers like in our
country. If anybody sells too low a price to the public in India either it should be
a fake / counterfeit drug or unethical sales.
g) By permitting on line sale of drugs not only deprive of livelihood of qualified
pharmacist but there is no possibility of increase in sales turnover or increase in
production or improvement in quality in the manufacture of drugs in India, as
drugs are different from the normal merchandise and it has to be taken as per
prescription provided by the Registered medical Practitioner and no choice for
patients to buy on their own like any other products. Hence by permitting e-
Pharmacies for retail sale will not increase either surge in turn over or increase in
production or improvement in quality. The introduction of e-pharmacy in our
country can deprive of poor people to run their community pharmacy in remote
and medium towns. It may be noted that the growth rate has declined for the
world pharmaceutical market (MAT 2016), 11 out of 20 top global market
particularly countries like USA, Canada had growth of 5.4% and 3.1% respectively
where internet/online sale of drug is permitted as against the increase in growth
of 10% in India. This achievement in India is possible due to government strict
policy on ensuring quality and affordable health care with affordable cost for our
citizens. Further, this growth is made even after NPPA action on bringing more
molecules are under price control and brought down price to large number of
molecules. This sustained increase in growth in India is possible when growth

rate for the world is sharply declined, due to the effort of manufacturer and
more than 8 lakh community pharmacies(traders) put sustained effort in growth
by ensuring availability of prescribed medicines in nook and corner of our
country.
h) When government is unable to identify and eliminate the existing unauthorised/
unlicensed online sale of medicine in India (As per present Drugs and Cosmetic
Act 1940 and Rules made thereunder, it is not permitted to sell drugs over internet
and drugs shall be sold only at the specific licensed premises and all prescribed
medicines must be dispensed by the qualified person /Pharmacist). At present,
when government regulators are unable to stop the clandestine sale of drugs
over internet and unable to take criminal action against them as per D&C Act,
how it is possible to control the unapproved online sale operators when gate is
opened for sale of drugs over internet. Even in USA, they are struggling to stop
the unauthorised sale of drugs over internet.
i) In India, the prescription will be issued only after physical examination by the
registered medical practitioner and the prescribed medicines are available either
at the attached pharmacy or community pharmacies well within 100 metres of
particular Registered Medical Practitioner and not like 10KM to 50 KM in
USA. In practice patients are easily buying medicine without any problem and
most of the patients are showing the medicines to doctor and get conformed the
medicines bought is as prescribed.
j) Hence at present, in India, buying prescribed medicine is easy, when patient
visiting doctor and getting prescription and buying medicine immediately at nearby
pharmacy and take medicine from the day one and need not wait and buy
prescribed medicine by on-line and take course of medicine after two or
three days and that too without guarantee that medicines received through online
is properly stored and remained same state as and when acquired and possess
efficacy and quality of drugs.
k) The present regulatory strength and infrastructure are not conducive to undertake
inspection of e-pharmacies and control online sale of drugs.

l) Some of the websites/e-pharmacies may offer prescription medication without
proper prescription. This practice is potentially dangerous as only doctors can
reliably assess contradictions, risk/benefit ratios, and the suitability of medication
for a specific individual.
m) Hence in the larger interest of public, we humbly request Government of India
not to permit e-Pharmacies for retail sale of Schedule H,H1 and X drugs and
plead to protect the safety, health and precious life of our Indian citizen as
buying drugs from e-pharmacies is unsafe and dangerous to human life.
3.0. SPECIFIC OBJECTION TO NOTIFICATION
3.1. The drugs and cosmetics Act, 1940 has to be amended to permit retail sale of
drugs through e- pharmacies by our parliamentarian as the quality of the drug
is beyond the understanding of our common man. It is the responsibility of
GOI and concerned department to ensure the availability of quality drugs to
public and the market is free from counterfeit, spurious, substandard and
misbranded drugs. Then only rule to be amended with stringent condition for
online retail sale of drugs.

4.0. SUMMARY
4.1. Online sale will lead to harmful and health hazard to large section of our
countryman and hence in the interest of public, GOI shall not permit online/
e-pharmacies for selling of prescription drugs,( Schedule H, H1, X drugs)
and we completely oppose the online pharmacies owing to risk involved and
injurious to health hazard of common man.
4.2. The provision in the Act is only for licencing with conditions for sale of
drugs at the licenced premises by the qualified person(pharmacist) and No
provision in the present Act for registration of online web sites and e-
pharmacies.
4.3. Due to increased competition, rising maintenance costs, increased expenditure
on human resources and the strict price control, the sustainability of the retail

pharmacies are under strain and trade business is dying and further it will
be great setback for the profession/trade if permission of online sale through
e-pharmacies is permitted in our country as this will lead to unhealthy
competition between online pharmacies and community pharmacies resulting
into unethical sale of sub-standard and spurious drugs in the market.
4.4 The drugs are not just any other commodity that can be either be sold or bought
like any consumer merchandise. Drugs are highly potent and their misuse or
disuse could lead to serious consequences for human health, both for person
who consume them and longer run for the humanity at large. Considering
above, online sale of drugs in most of the countries is limited to only non-
prescription drugs that too with stringent condition on licences for retail e-
pharmacies.
4.6. Before introduction of on line sale of drugs, all drugs must be bar coded and
sale of drugs to the patient shall have the possibility of track and traceable.In
this regard DTAB in its 69th meeting dated 22/04/2015 clearly recommended
amendment Drugs and Cosmetics Rule 1945 to enforce bar coding of drugs
within two years for the track trace of drugs in India and till date there is no
amendment made for this important mandatory requirement of bar coding of
drugs packing. All other countries where they permitted e-pharmacies, bar
code of drugs are implemented and can help to some extent counterfeit drugs
in the market.
4.7. THERE IS NO BURNING NEED OF ONLINE PHARMACIES IN INDIA
AS OF NOW. It is great concern that the present regulating system is
inadequate human sources and infrastructure to effectively control the online
pharmacies and to stop abuse of on-line of sale drugs.
4.8 The present draft proposal is inadequate to stop illegal website/online sale of
medicines and penalty class for criminal activities are not properly given and
online operator may easily escape only by suspension or cancellation of
registration for selling substandard or counterfeit drugs and any violation of
e-pharmacy rules.

4.9. The applicability of IT Act, 2000 shall be incorporated in the Drugs and
cosmetics Act, 1940 for both community pharmacies and e-pharmacies and
suitable amendment to the various provisions has to be made in the drugs and
cosmetics Rule, 1945 for maintenance of records, evidences etc.
4.10. The issues of selling of medicines through internet was deliberated by DTAB,
the statutory body appointed by the Government of India, in its 69th meeting
held on 22/04/2015 and it gave the following recommendations.
“The drugs are different from normal merchandise and the manufacture and
sale of drugs is regulated under the provisions of the Drugs and Cosmetics
Act,1940 and the Rules made thereunder. The sale of drugs is a licenced activity
and sale is required to be carriedout at the licenced premises under the
supervision of a qualified pharmacist and in the compliance to the provisions
prescribed under the Drugs and Cosmetics Rules, 1945. Online sale in
contravention to the provision of said Act and rules should not be permitted”.
Hence before permitting of e-pharmacies, both Act and rule must be amended
and not rule alone as the existing Act is only for sale of drugs by community
pharmacies at the licenced premises and Drug Act has been introduced before
effective use of internet.
4.11 The existing Act and Rule is made for the interest of public safety by the
government and should not make avenue to the public to buy medicine
through online and put their life and health into risk. In fact buying of medicine
by on line shall be banned in our country like smoking, consuming tobacco,
gutca etc. We are also confident that the present popular government will not
see closure of large number of community pharmacies which is back bone of
the pharmaceutical industry and dispensing of medicines to nook and corner
of our country for the sustained growth of pharmaceutical industry in our
country.
4.12. Most of the public, pharmaceutical manufacturer, medical practitioner, traders
and regulators believe that fair conduct of retail traders and their adhere to the
set of standards for ethical, moral and legal conduct in their business are

satisfactory in buying of medicines at Community pharmacies. The retail
traders serve their customer through well-established channels and following
fair trade practices for more than 7 decades and no need for online sale of
drugs in our country.
4.13. Our Government fixes right prices with specific margin to retailers and price
notified in the drug price control order. The sale of drugs by e pharmacies
with predatory price is consider as a anti competitive and is illergal under
competition law. The competition Act 2002, outlaws predatory prices, treating
it has an abuse of dominant position, prohibited under section 4. Predatory
pricing under the Act means the sale of drugs at a price which is below cost
as may be available at the market with a view to reduce competition or eliminate
the competitor. Hence unfair competition practices like monopolies, cartels
etc thwart the growh of smaller business establishments which are essential to
the growth of an economy. Hence introduction of online sale of drugs in our
country will eliminate the existing community pharmacies with a result of any
price reduction to specific online operator as a cartelisation attempt with
group of companies.
We request our Director of Health Services, Drug controller General(India), FWFHS,
GOI, to with draw the draft notification for the benefit of public health of 130
crore indian population and protect the livelihood of 8 lakh traders and 30 lakh
members of their families by not allowing on line sale of drugs and steps taken to
ban the online sale of drugs in India unless fool proof system is established.
