AFFIDAVIT

I, MARK M. BALILI, single, Filipino and with office at Legend of


Ice Recruitment Service Inc. Unit 7, 7th Floor, Future Point Plaza, 3#
111 Panay Ave., South Triangle, Quezon City, most respectfully
states that:

1. I am the current HRD/Marketing Manager of the Legend of Ice


Recruitment and Services and has jurisdiction over employees of
Legend of Ice at OCTAGON COMPUTER STORE (UPSON
INTERNATIONAL CORP.) located at Ground Floor, Tth Center,
Puerto Princesa City;

2. The Department of Labor and Employment – Palawan Field Office1


conducted an onsite at OCTAGON COMPUTER STORE2 (UPSON
INTERNATIONAL CORP.) located at Ground Floor, Tth Center,
Puerto Princesa City and made the following findings to wit;

3. On June 4, 2019 at around 9:45 AM Legend of Ice Team


Leader/Supervisor and the undersigned appeared before DOLE –
Palawan and submitted a copy of D.O. 174 s. of 2017 dated March
20, 2019 in relation to Case No. RO4B-5-RI-2019-03-0008-G;

4. At the meeting with DOLE – Palawan Hearing Officer Ms. Anna


Dominique C. Magbanua has instructed us as representative of
the company to submit a position paper or anything synonymous
to it regarding the noted observation of the DOLE inspector on
Octagon and Legend of Ice’s work arrangements to be submitted
before the of June 2019;

5. Based on records the Cashiers and Salesman who had been
assigned at Octagon Computer Store, Tth Building, Rizal Ave.,
Puerto Princesa City are employees hired and recruited by Legend
of Ice Recruitment and Services to man the aforementioned store;

6. The undersigned is the HRD/Marketing Manager who has


jurisdiction over employees posted by Legend of Ice who receives
all concerns and forwards the same to Legend of Ice Management;

7. In relation to sales and other concerns of the Store it is the


Manager of Octagon assigned that caters to the same;

8. In addition, when it comes to demeanors, work rules, payment of


wages, and the going about employees it is the undersigned who
disciplines for the same as the designated HRD/Marketing
Manager of Legend of Ice;

9. Daily Time Records are prepared by Legend of Ice employees and


forwarded to Legend of Ice Management and that any involvement
in the preparation thereof by Octagon could be explained by the
fact that the preparation thereof DTR are made within the
premises of Octagon Computer Store;

10. The disciplining of employees of Legend of Ice assigned at


Octagon Computer Store falls within the jurisdiction of the
undersigned being the HRD/Marketing Manager of Legend of Ice
Recruitment and Services;

11. As such I am executing this Affidavit to attest to the truth of the


foregoing and for whatever legal purposes that this may serve;
