In June 6, 2018, I purchased a real property from you, in your capacity as Attorney-
in-fact of the property owners DARIUS SEPULVEDA SUBIDA, ALEXANDER
SEPULVEDA SUBIDA and ALFRED SEPULVEDA SUBIDA, for an aggragate price of One
Million Four Hundred Ninety (P1,490,00.00) pesos, Philippine Currency, in hand
paid to you and receipt of which amount was expressly acknowledged by you, in
the presence of my live-in-partner Raniel Madroño and my daughter Elinaz Orio,
together with two other persons, namely, Barangay Councilor Delia Calatrava and
a certain ARACILE SUICO who acted as a medium or conduit in your behalf to
accompolish in finding me as a buyer of your real property. However, after you
received the aforementioned amount I paid to you, you promised me and
bound/obliged yourself to execute the corresponding Deed of Absolute Sale of Real
Property, which is situated in Barangay Cadaruhan, Municipality of Borbon,
Province of Cebu, being a portion of Transfer Certificate of Title (TCT) No. TP-27971.
While I trusted you through the intercession of ARACILE SUICO whom I have known
personally for quite sometime, you have refused to execute the Deed of Absolute
Sale for reasons only known to you. I have made repeated attempts to contact you
through Aracile Suico but you have not come forward to comply with what is
incumbent upon you and/or return the money I paid to you as set forth in the
foregoing.
I will expect a response to this letter within the period aforestated. If this matter is
not resolved by the time specified above, I reserve the right to commence legal
proceedings to compel you to specifically perform your obligation without further
notice to you and/or file a criminal case against you should the evidence so
warrants. This letter may be tendered in court as evidence of your failure to do so.
