FINAL JUDGMENT

On June 27, 2018 came to be considered Defendant American Traffic Solutions, Inc.’s

(“ATS”) Motion to Dismiss All of Plaintiff’s Claims Against It Pursuant to Chapter 27 of the

Texas Civil Practice and Remedies Code. The Court examined the pleadings and held a hearing

pursuant to TEX. CIV. PRAC. & REM. CODE § 27.004.

On June 29, 2018, the Court issued an Order finding that Plaintiff’s legal action is based

0n, relates t0, or is in response to ATS’s exercise 0f the right of free speech. TEX. CIV. PRAC. &
REM. CODE § 27.005(b). The Court further found that Plaintiff Bu‘sPatrol America LLC cannot

establish by clear and specific evidence a prima facie case for each essential element of its claims

against ATS. The Court further found that ATS has established by a preponderance of the

evidence each essential element 0f valid defenses to Plaintiff‘s claims.


The Court dismissed all of Plaintiffs claims against ATS with prejudice. The Court

further ordered ATS shall receive its court costs, reasonable attorney’s fees, and other expenses

incurred in defending against Plaintiff’s legal action, pursuant to TEX. CIV. PRAC. & REM. CODE

§ 27.009(a)(1). The Court also ordered ATS t0 submit proof of the total of its fees by affidavit

by July 13, 2018, which it did on July 2, 2018.

The Court has reviewed American Traffic Solutions, lnc.’s Request for Court Costs,

Attorney’s Fees, Expenses, and Sanctions Pursuant to the Court’s June 29, 2018 Order and Texas

Civil Practice and Remedies Code § 27.009.

IT IS THEREFORE ORDERED THAT:

a. BusPatrol shall pay to American Traffic Solutions, Inc. the amount of


$420,950.70 in reasonable attorneys’ fees;

b. BusPatrol shall pay to American Traffic Solutions, Inc. the amount of $9,959.09

d. In conformance with the Court’s June 29, 2018 Order, BusPatrol’s claims against
ATS are dismissed with prejudice in their entirety.
