exercise of powers conferred by the subsection (a) of section 52 of the Myanmar


In
Engineering Council Law, the Ministry of Construction of the Govemment of the Republic of the
Union of Myanmar, with the approval of the Union Govemment, issues these rules in coordination
with the Myanmar Er,rgineering Council.

Chapter I
Title and Definition

1. These rules shall be called the Myanmar Engineering Council Rules.


2. The council expressed in these rules means the Myanmar Engineering Council.

Tlie expressions contained in these rules shall have the meanings as the expressions contained in the
Myanmar Engineering Council Law. Furthermore the following expressions shall have the meaning
given hereunder.

(u) Apprentice engineer certificate means the certificate issued by the council after being
nominated to the council as a graduate engineer.

(b) Apprentice graduate technician certificate means the certificate issued by the council
after being nominated to the council as a graduate technician.

(c) Apprentice technician certificate means the certificate issued by the council after
being hominated to the council as a technician.

(d) Registered technician means the person, who obtained a technological diploma from
any of the domestic or abroad technological universities or any of technological
coilege, and applied to the council to get registered technician certificate on successful
completion of apprenticeship nominated under this law, obtains a registration
technician certificate issued and designated by the council.
(e) Registered graduate technician means the person, who obtained technological
graduate from any of the domestic or abroad technological universities or any of
technological college and applied to the council to get a registered graduate technician
certificate on successful completion of apprenticeship nominated as an apprentice
graduate technician under this law, obtains technician registration certificate issued and
designated by the council.

(f) Law means the Myanmar Engineering Council Law.

(g) Commission means the Election Commission, including a chairman, vice-chairman


and joint secretary, selected and assigned duty by the patron body ofthe council.

Chapter II

f,'ormation of Myanmar Engineering Council

Duties and Powers of Patron Body

3. The duties and powers of patron body are as follows:


(a) Necessary suggestion and guideline to make successful implementation of the functions
of council contained in this law;
(b) Observation and discretion whether or not the council performs or be able to perform
the functions in accordance with the provisions of the law;
(c) Formation of executive committee with the Council Members in accordance with these
rules:
(d) Adjudication on complaint of any Council Member, of being illegal in the election of
the 12 Council Members out of the executive committee;
(e) Substitution on a vacancy of Council Member;
(0 Mitigation (lessening) in respect of the qualifications to have for registration in the
council on reasonable grourd of special matters.

Formation of Myanmar Engineering Council

4. The patron body shall form the council with the members not more than 60 out ofthe persons
from the Union Ministries, Govemment Departments, Government Organizations, non-Govemment
Organizations, and the appropriate experienced engineers related to the following engineering work. In
lorming the council, at least a person from each engineering specialization and at least 9 persons from
the number of lady engineers are to be involved.
(a) Experienced Engineers from Accountable Ministry, and Ministries relating to the
Engineering and Government Organizations - 15 persons

Fornation of Executive Committee of the Council

5. An executive committee of the Council shall be formed as follows:


(a) The executive committee of the council shall be formed with a total of 15 persons,
including a chairman, two vice-chairmen, a secretary, two joint secretaries, a treasurer
and eight executive members out of the 60 Council Members,.
(b) The patron body of the council shall select and assign duty to a chairman, a vice-
chairman and a joint secretary out of the 60 Council Members.
_ (c) The Council Members shall elect a vice chairman, a secretary, a joint -secretary, a
treasuier, and 8 executive members out of the remaining 57 Council Members'
(d) Electoral System

(i) Formation of Election Commission -A group, including a chairman, a vice-


chairman and a joint secretary, selected and assigned by the patron body of the
council, is an election commission.

(ii) Nomination of a would-be vice-chairman- The Council Members, who desire


a Council Member out of them as a would-be vice-chairman, may nominate in
writing signed by themselves to the commission or the Council Members may,
if desired to perform as a vice-chairman, nominate themselves in writing to the
commission as a would-be vice-chairman.

(iii) Issuance of the nominee of the would-be vice-chairman -After scrutinizing
the nomination letter the commission shall issue the nominees for a position of
the vice-chairman.

(iu) Voting - The other Council Members except three commission members shall
. vote one out of the nominees as a vice-chairman under a confidential voting
system.

(v) Counting votes and declaration of the name of the vice-chairman- The
commission shall count the votes casted under a confidential voting system in
the presence of the Council Members and declare as vice-chairman the Council
Member who obtains the maximum vote. In the event of equal votes of two
candidates or more than that, such candidates shall be elected again rurder
confidential votins svstem.

(vi) Nomination of Would-beSecretary, Voting and Declaration -For the


election of a position of the secretary, it shall be performed under the aforesaid
subclauses ii, iii, iv, and v.

(vii) Nomination of Would-be joint Secretary, Voting and Declaration - For the
election of a position of the joint secretary, it shall be performed under the
. aforesaid subclauses ii, iii, iv, and v.

(viii) Nomination of Would-be Treasurer, Voting and Declaration- For the


election of a position of the treasurer, it shall be performed under the aforesaid
subclauses ii, iii, iv, and v.

(ix) Nomination of Eight Executive Members -The other 53 Council Members


other than three commissions and four elected Council Members may, if desired
to perform the duty of the executive member, submit in writing and signing to
the commission by themselves.

(x) The applicant as executive member shall not be absent at the time of convening
election

, (xi) Counting vote and declaration of eight executive members - For the election
of 8 executive members, it shall be perfbrmed under the aforesaid subclauses ii,
iii. iv. and v.

(xii) Not to organize and persuade to vote -As the Council Members are admired
' by the professionals in the engineering field, undignified persuasion of voting
shall not be made in the election.

(xiii) Right of complaint -ln respect of the assumption of the unlawful performance
of the commission on the eleotion of the executive committee, any Council
Member may complain in writing to the patron body of the council.

(xiv) Decision of the Patron Body -The patron body of the council has right to
adjudicate on the particulars contained the complaint letter.

Affirmation of Executive committee and Council Members

6. The executive committee and Council Members shall make affirmation in the presence of the
a1 least 3 members of the patron body as follows.
(a) We, who are assigned as Council Members in the Myanmar Engineering Council
organized under the law, promise that we will carry out dutifully our duties and
responsibilities authorized under the law.
(b) We promise to carry out in good faith the duties and responsibilities of the council
carefully as much as best ofour physical and mental capacity.
(c) We promise not to abuse the rights of the Council Member and the name of the council
for sclf-interest during carrying out powcrs as Council Members.

Succession of the duties and responsibilities

7. The council shall succeed the duties and responsibilities of the technician monitoring and
maintenance authority established under the ASEAN reciprocal recognition measure.

8. The executive committee of the council shall form a team to be succeeded of the duties and
responsibilities ofthe supervisory committee ofthe technician monitoring and maintenance authority.

Chapter III
Qualifications, Duties and Powers of the Council Members

Qualifications, Duties and Powers of the Council Chairman

9. Qualifications, Duties and Powers of the Council Chairman are as follows.

(a) Qualifications of Council Chairman


(i) He, who has attained the age of60 and above, and has already had a certificate
of a registered professional engineer, shall be a Myanmar citizen experienced I
engineer;

(ii) He shall have at least 35 years experience in his engineering work.

(iiD He shall be qualified with the ethic, dignity and integrity of the professional
engineer.

(iv) He shall be admired by the Myanmar engineering field due to making endless
effort for the improvement of Myanmar Engineering.

(v) He shall be loyal to the nation and citizens.

(vi) . He shall be capable leader in successfully implementing of objectives of the


council.

(vii) He has never been convicted ofany crime in any court oflaw.

(viii) He shall preserve not to breach his integrity and ethic of the technician in
performing the profession.

(ix) He shall be the person whose engineer registration certificate is not to be


revoked and cancelled.

(b) Duties and Powers of the Council Chairman

(D He shalt successfully carry out the objectives of the engineering council by


using the powers authorized under the law and rules.

(ii) He shall issue certificate of registration and certificate of registration for


engineer signed by him.

(iii) He shall undertake as the chairman in the meetings of the council and the
executive committee, and monitor the meetings to be proper.

(iv) The Council Chairman shall manage the fund of it in accordance with the
existing financial rules and regulations, and directives.

(v) The Council Chairman has the right to spend the fund as the amount stipulated
bY the council.

Qualifications, Duties and Powers of Vice-Chairmen of the Council

10. Qualifications, Duties and Powers ofthe Vice-chairmen ofthe council are as follows:

(a) Qualifications of the Vice-Chairman of the Council

(D The vice-chairman of the council shall have same qualification of the Council
Chairman to be able to undertake as the chairman of oouncil in the event of a
. vacancy of the Council Chairman due to various reasons.

(ii) The vice-chairman shall be able to perform duties and responsibilities of the
Council Chairman when assisned on behalf of the Council Chairman.

(b) Duties and Powers of the Vice-Chairman of the Council

(i) The vice-chairman of the council shall undertake the duties and powers of
Council Chairman on behalf of chairman when assigned by the Council
Chairman.

(iD The vice-chairman shall advise and assist to the Council Chairman in respect of
duties of the council.

Qualifications and Duties of the Secretary of the Council

11. Qualifications and duties ofthe secretary ofthe councii are as follows: -
(a) Qualification ofthe secretary ofthe council
(i) He, who has attained the age of55 and above, and has already had a certifioate
. of a registered professional engineer, shall be a Myanmar
citizen experienced
engineer.

(ii) He shall have at least 30 year-work experience in his field ofengineering'

(iii) He shall have the qualifications stipulated in subrule (a) ofrule 9 except the age
and work experience.
(b) Duties ofthe Secretary ofthe Council

(i) The secretary of thc council shall manage the meetings of the executive
committee to be propcr.

(ii) The secretary of thc oouncil shall obtain the approval of the submission fiom
respective working corttntittccs in the cxecutive committee.

(iii) The secretary shall supcrviso and manage the chief registrar and staffoffice.

(iv) He shall sign ancl issuc thc orders and directives of the council under the
permission ol' thc chairman.

(v) He shall submit, in coordination with the treasurer, the collection of the
requisite fund of the respective working committees to the chairman.

Qualifications and Duties of the Joint Secretaries of the Council

12. Qualifications and duties ofthe joint secretary ofthe council are as follows: -
(a) Qualifications of the joint secretary of the council

(D He, who has attained the age of 50 and above, and has already had a certificate
of a registered professional engineer, shall be a Myanmar citizen experienced
engineer;

(ii) He shall have at least 25 year-work experience in fields ofengineering.

(iii) He shall have the qualification stipulated in subrule (a) of rule 9 except his age
and work experience limits.

(b) Duties ofthe joint secretary ofthe council

He shdll advise and assist in respect ofthe duty ofthe secretary.

Qgalifications and Duties of the Treasurer of the Council

13. Qualification and duties of the treasurer ofthe council are as follows: -
(a) Qualifications of the treasurer ofthe council
(D He, who has attained the age of 55 and above, and has already had a certificate
of a registered professional engineer, shall be a Myanmar citizen experienced
engineer.

(ii) He shall have at least 30 years-work experience in his field ofengineering.

(iiD He shall have the qualification stipulated in subrule (a) of rule 9 except his age
and work exoerience limits.

(b) Duties of the treasurer of the council

(i) He shall submit the receipt, expenditure, balance and the allocation for spending
ofthe finance in every meeting of the executive committee.

(iD He shall monitor all financial affairs of the council in accordance with the
existing law, rule and regulation for accurate performance.

(iii) He shall supervise and scrutinize the entry and keeping of the financial statistics
and ledgers.

(iv) He shall supervise and perform timely deposit of the tumover to the bank and
for the due availability of the bank deposit and transaction.

Qualifications and Duties of the Executive Members

14. Qualifications and duties of the executive members are as follows:


(a) Qualifications of the Executive Members

In the event ofany vacancy ofthe joint secretiuy due to various reasons, he shall have the
same qualifications of the joint secretary to be able to discharge duties of the joint
secretzuy.
(b) Duties of the Executive Members
Every executive member shall, with approval of the executive committee, serve the duties
of chairman of the Working Committee formed by the executive committee.

Qualification and Duties of the Members of the Council


15. Qualification and duties of Council Members are as follows:
(a) Qualification of the members of the council
(i) He, who has attained the age of45 and above, and has already had a certificate
of a registered professional engineer, shall be a Myanmar citizen experienced
engineer.

(ii) The Council Member representative from the Myanmar Architect Council shall
be the architect professional.

(iiD He shall have at least 20 years-work experience in his architecture field.


' (iv) He shall have the qualifications stipulated in subrule (a) of rule 9 except his age
' and work experience limitation.

(b) Duties of the Member of the Council


Every Council Member shall serve the duties of the member with the selection and
approval of the executive committee in any Working Committee or more than one formed
by the executive committee.

Substitution, Selection, Stipulation, Assignment and Election

16. In vacancy of any position of a Council Chairman, a vice-chairman and a joint secretary
selected and assigned duties by the patron body of the council, the body shall, in accordanoe with
subrule (b) of rule 5, select and assign a suitable member out of the Council Members as the Council
Chairman, a vice-chairman orjoint secretary.
17. In vacancy of any position of the another vice-chairman of the executive committee, a
secretary, a joint secretary, a treasurer, and a Council Member out of the 8 executive members, the
election commission shall supervise the Council Members to be able to elect any such position among
the Council Members in accordance with subrule (d) of rule 5.

Chapter IV

Formation of Working Committees and Working Groups

Formation of Working Committees

18. The Council may assign the executive committee to form the following working committees to
perform its duties.
(a) RegistrationCertificateAssessmentWorkingCommittee;
(b) EngineeringDisciplincAccreditationWorkingCommittee;

(c) Ethic Preservation Working Committee;


(d) DisciplinaryWorkingCommittee;
(e) Working Committee for Preparing Standard, Basic Norms of Work and Engineering
Procedures;
({) Working Committee for Sustainable Engineering Teaching;
(g) Working Committee for Accreditation and Assessment of Engineering Companies and
Organizations;
(h) Intemational and Public Relation Working Committee;

19. Registration Certificate Assessment Working Committee - The executive committee shall
form the Registration Certificate Assessment Working Committee with an executive member as
chairman and Council Members not more than 15 persons as members and shall assign the duties to
the Committee.
(a) Duties of the Working Committee

(D The Working Committee may, with the approval of the executive .o.-itt"", O
issue the following registration certifi cates;

(*) ApprenticeTechnicianCertificate;
(bb) Apprentice GraduateTechnician Certificate;
(cc) ApprenticeEngineerCertificate;
(dd) Technician RegistrationCertificate;
(ee) Graduate Technician Regislration Certificate;
(tr) EngineerRegistrationCertificate;
(gg) Registered Senior Engineer Certificate;
(hh) Registered Professional Engineer Certificate;
(iD Registered Limited Engineer Certificate;
(tj) RegisteredLimitedProfessional EngineerCertificate;

(ii) The Working Committee shall perform the following functions to issue
registration certifi cate :

(aa) coordination with the relevant working committees for the development
initiative course;
(bb) holding assessment written examination;
(cc) scrutiny ofthe reports ofthe experience and quality perfectness;
(dd) interview;

(iii) The Working Committee may submit to the executive committee to suspend or
reject the issuance of registration certificate, if there is a reasonable ground that
the applicant is a lack of quality stipulated or unable to fulfill the requirement.'

(iv) . The Working Committee may submit to the executive committee to cancel the
registration certificate issued due to any of the following facts:
(aa) scrutiny and findings of the submission of the fraudulent diploma and
graduate certificate to obtain the registration certificate;
(bb) being unable to be connected by the council;

(cc) default of application for the extension of the registration certificate for
consecutive 5 years and above;

(v) The Working Committee may permit the recommencement and performance of
the different level of registration when the applicant, whose registration
certificate was cancelled, reapplies for the new registration in excess of 3 years
and above.

(vi) The Working Committee may submit the necessary rules and regulations,
directives and procedures occasionallv to the council.

(b)
Procedures
Registration Certificate Assessment Working Committee shall perform in accordance
with the means prescribed in chapter VIII ofthe rules to issue a registration certificate.
20. Engineering Discipline Accreditation Working Committee- The executive committee shall
form the Working Committee with a member of the executive committee as chairman and the Council
Members not more than 15 as members and shall assign the duties to the Committee.
(a) Duties of the Working Committee
(i) Occasional declaration of the engineering degree, technology degree and
technology diploma, recognized by the council;

(ii) Stipulation of qualifications necessary to be applied by holders of the degree


and diploma which are recognized by the council.

(b) Procedures
The following policies and procedures shall be drafted to ensure to perform the
functions of the Engineering Discipline Accreditation Working Committee of the
Coturcil:

(i) to submit to the council to approve after drafting policy and procedure in
respect of engineering disoipline accreditation of Myanmar Engineering
Council;

(iD to prepare and draw the manual ofthe technical quality scrutiny and recognition
and engagement lor scrutiny in detail;

(iiD to stipulate and issue the quality scrutiny fees for all the expenditures to be
raised for the confirmation and engagement of the quality scrutiny recognition
to be claimed to the relevant technological university, college and organization,
and to form and assign duty to the assessment boards for the recognition of the
engineering work;

(iv) to stipulate the recognition period and to notify, if any requirement, for carrying
on and to decide the recognition of the arrangements and engineering service on
the basis of reviews and findings alter receiving the reports and assessment
records ofthe board;

(vl to settle the submission relating to dissatislaction with the performance and un-
clearance in respect of recognition of the engineering service programs;

(vi) to involve in the agreement of the engineering with other nations on behalf of
the Myanmar Engineering Council;

(vii) to study and submit to the council tle necessary performance for the promotion
of quality with regard to engineering, which should be done;

(viii) to scrutinize and notify the quality and standard of the university and college
attended by the foreign engineers to be sent by the Registration Certificate
Assessment Working Committee;

(ix) to occasionally submit activities of the committee to the Myanmar Engineering


Council;

(x) The Working Committee may occasionally submit necessary rules and
regulations, directives and procedures to the council.

21. Ethic Preservation Working Committee - The executive committee shall form the Ethic
Preservation Working Committee with an executive member as chairman and Council Members not
more tlan 15 as members and shall assign the duties to the Committee.

(a) Duties of the Working Committee

(D To stipulate the assumption which is ethical principles to be preserved and


complied with by the engineers, graduate technician and technician,
commitments of engineers, procedural rules to be exercised and followed by the
engineers, and technical duties and responsibilities of the engineers;

(iD To prevail conscience of the ethical principle preservation ofthe engineer;

(iiD To inspect and monitor whether or not the engineers comply or be familiar with
the ethical principles in coordination with the Working Committee for
sustainable engineering learning and the Registration Certificate Assessment
Working Committee;

(iv) To take action of the engineers who commit a breach of ethics in coordination
with the Disciplinary Working Committee.

(b) Procedures

(i) To obtain the approval of the council for the ethics drafted by the working
committee;

(iD To perform various ways, including leaflet, lectures, courses, emails and
websites for the engineers to know and follow the preservation ofethics widely;

(iii) To stipulate the ethic as a subject in the written examination and interview in
coordination with the Working Committee for sustainable engineering leaming
and the Registration Certificate Assessment Working Committee;

(iv) To take action as follow in coordination with the Disciplinary Working


Committee for the investigating of the so-called engineers who are notorious for
a breach of the ethic:

(aa) the group, including members of the Disciplinary Working Committee


and the ethic preservation working committee, shall be formed to
investigate the such engineer:
(bb) out of the ethics, which ones iue committed by such engineer, shall be
reviewed;
(cc) the group shall send the review on the commission of any ethics in
writing to such engineer after stipulating the date for resubmitting
whether it is right or not;
(dd) the group shall investigate other evidences, evidentiary items and
documents regarding the case as available as possible while
investigating in writing such engineer;
(ee) after scrutinizing the elaboration of such engineer and investigation of
the group, the group shall review whether such engineer commits a
breach ofthe ethics or not;
(ff) the group shall submit its review to the nearest meeting ofthe executive
committee of the Myanmar Engineer Council and shall obtain the
decision.

22. Disciplinary Working Committee-- The executive committee shall form a Disciplinary
Working Committee with the executive member as a chairman and Council Members not more than
15 as members and shall assign the duties to the Committee.

(a) Duties of the Working Committee

(i) Monitoring compliance and preservation of the ethical practice and


of
regulations of the engineering by the persons at domestic and abroad holding a
registration cerlificate registcred in the Myanmar Engineering Council, and
investigating, inquiring and taking action, as required, in default of ethics;

(it Monitoring compliance and preservation of the ethical practice and


of
regulations of the engineering by the companies and organizations of the
engineering at domestic and abroad, scrutinized and recognized by the
'Myanmar Engineering Council, and investigating, inquiring and taking action,
as required, in default of ethios.

(b) Procedures
The Disciplinary Working Committee shall perlorm in accordance with the ways
prescribed in the chapter X ofthe rules fbr the discipline.

23. Working Committee for Preparing Standards, Basic Norms of Work and Engineering
Procedures - 'fhe executive committee shall form this Working Committee with an executive
member as the chairman and the Council Members not more than l5 as members and shall assign the
duties to the Committce.

(a) Duties of the Working Committee

(D Preparation of Myanmar standard in cooperation with the relevant ministry to


preserve and promote the quality and standard of the engineering and technical
work;

(iD Preparation of the basic norms of work in cooperation with the relevant ministry
for the preservation and promotion of the quality and status of the engineering
and technical work;

(iii) Cooperation with other organizations and the relevant ministries to prepare
relevant specialization engineering procedure code, grouping according to
specialization;

(iv) Submission to the council to issue the procedures required to promote and
preserve the quality and status of the engineering and technical work;

(b) Procedures

(D To make reference of the Myanmar, ASEAN and intemational standards for the
orms and standards of engineering and technical work;

(ii) To make reference of the procedures of the modem and developed nations and
. the ASEAN nations for preparation of the engineering and technical procedures
according to the relevant specialization.

24. Working Committee for Sustainable Engineering Teaching Program-The executive


committee shall form this Working Committee with an executive member as a chairman and the
Council Members not more thanl5 as members and shall assign the duties to the Committee.

(a) Duties of the Working Committee

(D Holding practical and theoretical courses, workshops and conferences on the


sustainable development of engineering and technology, and managing to
participate and attend to the intemational and regional meetings and conferences
on behalf of the State;

(ii) Advising and providing, as may be necessary, to the Ministry of Construction,


the other relevant union ministries and the other organizations suggestion and
assistance required for sustainable teaching of engineer, graduate technician,
and technician;

(iiD Implementation of sustainable development system of technician level;

(iv) Suggestion and assistance to the Ministry of Construction, other relevant union
ministries and other organizations in respect of the development and research
for the enhancement ofthe engineering and technical standard;

(vl Suggcstion, assistance, and cooperation in communication with the government


departments, government organizations and non-govemment organizations to

enhance and preserve the quality of the engineer, graduate technician, and
technician.

(b) Procedures

(i) The Working Committee shall, with the approval of the executive committee,
perform in coordination with the Ethic Preservation Working Committee and
the Registration Certificate Assessment Working Committee in implementation
. of sustainable technician level study and teaching system and opening
theoretical and practical courses;

(iD The Working Committee shall submit the recognition of sustainable study and
teaching program and measurement of engineering development presented by
the respective organizations to the council to issue the procedure;

(iii) The Working Committee shall make a decision to accept or reject after
scrutinizing the sustainable study and teaching program of the applicant to
register;

(iu) The Working Committee shall coordinate the Working Committees according
, to the engineering specification for sustainable study and teaching program;

(v) The Working Committee shall, with the approval of the executive committee,
declare the detailed procedure of the sustainable study and teaching program to
be cxcrciscd;

(vi) The Working Committee may issue the letter of recommendation on an


. applicant's claim and recognition to know the score of cunently sustainable
study and teaohing ofthe applicant to register by the prescribed payment;

(vii) The Working Committee shall coordinatc with the Registration Certificate
Assessment Working Committee for the requirements and the stipulations of the
registered person under the sustainable development program.

25. Working Committee for Accreditation and Assessment of Engineering Companies and
Organizations- The executive committee shall form the Working Committee with an executive
member as a chairman and the Council Members not more than 15 as members and shall assign the
duties to the Committee.

(a) Duties of the Working Committce

(i) Reply to the respectivc Ministry after scrutinizing in accord with the permission
of the Ministry of Construction whether works of the local and foreign
consultant companies, engineering and technioal companies, organizations,
contractor and contract companies operating within Myanmar are consistent
with the prescribed procedures, standards and work elementary norms or not;

( ii) 'fhe Working Committee shall pcrform recognition of operation by scrutinizing


the operating foreign and local contractor and contract companies within
Mvanmar;

(iii) The Working Committee shall perform recognition of operation by scrutinizing


the operating local and foreign engineering consultant companies and
organizations within MYanmar.

(b) Procedures

(D The Working Committee shall perform the scrutiny and recognition based on
the following facts:

(aa) structure of the company to be formed within Myanmar;


(bb) work experience and educational qualification and the name of the
officer in charge to be assigned within Myanmar;
. (cc) name, engineering degree, registration certificate, and experience of the
engineer in charge;
(dd) condition of preservation and monitoring of the work quality;
(ee) condition ofthe safety ofthe operational site;
(ff) supporting materials and equipment ofthe operational use;

(iD The Working Committee shall perform the scrutiny and recognition annually.

26, International and Public Relation Working Committee -


The executive committce shall
form the Working Committee with the executive member as a chairman and the Council Members not
more than l5 as members and shall assign the duties to the Committee.

(a) Duties of the Working Committee

(i) Implementing and looking for the ways of cooperation and exposure of
opportunity to communicate with governments' private organizations'
universities or professionals around the world, which ensure supporting the
development of the quality and standards of Myanmar citizen engineers,
sraduate technicians and technicians:

(ii) Study of experience and preservation work of the prevailing quality and tfr" I
standard in regard to the engineering and technology skills of every nation of
the world;

(iii) Communication with the intemational engineering council, including of


ASEAN nations, exposure of the prospect of the reciprocal cooperation and
information dissemination of the Myanmar Engineering Council;

(iv) Further dissemination of the experience, research and development works of


the every nation of the world with regard to modem engineering technology'
new skillful process and engineering technology beneficial to the natural
environment and human to Myanmar engineers, graduate technician and
technician:

(v) Organizing Myanmar engineers, graduate technicians and technicians to attend


meetings, conferences, trainings, excursions and the paper reading session firr
obtaining the intemational experience.

(b) Procedures

(i) To disseminate, after establishing the Myanmar Engineering Council Website,


the information about the Myanmar Engineering Council from such website
from time to time;

(iD To acquire the information in

Intemational Engineering Councils, including of ASEAN nations;

(iii) To coordinate and draw the programs to be able to enhance the reciprocal
relations between the relevant engineers;

(iv) To arrange the necessary internet system and computer rooms for the
international relations and dormitories for international guests;

(v) To acquire and upload the information to the counoil website in linkage with the
respective working committees formed under the Myanmar Engineering
Council;

("i) To provide assistance to resend the letters and information, which are sent by
professionals from intemational govemmental organizations, or private
organizations and the international universities to the Myanmar Engineering
Council, to the Council Members and those concerned;

(vii) To disseminate the inlormation relating to registration, ethics, recognition,


quality and preservation discipline of engineers, sustainable engineering
teaching, basic work standard, and scrutiny of engineer companies and
organizations, which are implemented by the engineering councii nationwide to
the relevant working committees.

27. Other requisite working committees - The executive committee shall form other requisite
working commitlees as appropriate.
O Engineering Specializations Working Groups

28. The executive committee shaL:

(a) form the following engineering specializations working groups:

(i) Urban F-ngineering working groups;

(ii) Industrial Engineering working groups;

(iii) Electric power engineering working groups;

(iv) Electronic engineering working groups;

(u) Chemical engineering working groups;

(r,i) Cotton and textile engineering working groups;

(vii) Petroleum engineering working groups;

(viii) Metal mining engineering working groups;

(xi) Metallic engineering working groups;

(x) Marine engineering working groups;

(xi) Aviation engineering working groups;

(xii) Information Technology, Engineering working groups;

(xiii) Industrial Electronic engineeringworking groups:

(b) form the specializations, not including in clauses (1) to (13) of such subrule (a)in the
working groups related to them;
(c) assign the relevant specialization Council Member as chairman and 5 to 10 engineers
who obtained a registered professional engineer certificate according to the respective
specializations as members in the respective working group;
(d) implement the matter that should be done with the approval of the council m". I
considering the advices in respect of the relevant specialization, given by the working
goups to the council.

ChaPter V
Meetings of the Council

Meetings

29. The Council meeting - The regular meeting of the council shall be convened quarterly. In the
event of the emergence of a special meeting on official witten request of at least one-fourth (25%o) of
Council Members, a special meeting of the council shall be convened witl-rin 14 days from the date
that the chief registrar accepts the submission. If at least more than half of the Council Members are
present, the meeting is valid.

30. The Executive Committee Meeting - The regular executive committee meeting shall be
convened once a month. When required to convene special meeting, the special meeting of the
executive committee shall be held. If at least more than half of the executive members are present, the
meeting is valid.

31. Working Committee Meeting - The coordination meetings of the Working Committee shall
be convened as and when necessary.

32. Discussions and decisions of the council meetings, the executive committee meetings and the
Working Committee meetings shall be stipulated as a limit level.

lnvitation

33. (a) The chief registrar shall invite in writing at least 5 days in advance of the meeting,
stating the agenda, including the time, date and venue of the meeting, to be consulted at
the meeting.

(b) The resolution of the meeting shall not be null and void because of the absence ofany
Council Member without receiving the invitation due to various reasons.

Minutes of the meeting

34. (a) The chief registrar shall perform as the recorder ofthe meeting.

(b) The chief registrar shall duly record and maintain all the minutes ofthe meeting.

(c) After stipulating the last date to be confirmed, the chief registrar shall disseminate the
draft ininute of the meeting to be confirmed by all attendees whenever a meeting
finishes.

(d) Every minute of the meeting is the evidence for all decided particulars of the meeting.
Unless the meeting of any minute is proved to be contrary in some way, it shall be
deemed as a meeting systematically held.

Voting

35. A majority of the attendees of the meeting may hand up for their votes of decision for any
problem arisen in every meeting. However, if any attendee of the meeting requires to record, the
names ofthe recommender, the objector and neutral, shall be recorded in the minute ofthe meeting.

Submission of Financial Statement

3;. The council treasurer shall submit a financial statement at every meeting of the executive
committee as follows:
(a) The council treasurer shall submit up{o-date situation ofthe income and expenditure of
the council within the current financial year to the meeting.
(b) Up-to-date balance sheet shall be submitted.

ChaPter VI

Formation of Staff Office

37. The Council shatl form the staff office to be able to perfbrm functions and duties ofthe council
and executive committee under the permission of the Ministry of Construction as follows.

Chief Registrar

38. Duties and Responsibilities of Chief Registrar - The duties and responsibilities of chief
registrar are as follows:
(a) submission and scrutiny of registration certificate of the engineer, graduate technician
and technician in accordance with the law:
(b) entry into register, preparation of register and occasional issuance,
(c) cansellation from the register, re-entry into a register;
(d) monitoring and supervision ofthe functions and duties ofstaffoffise;
(e) invitation to hold the meetings of the council and the executive committee;

(f) performing as meeting recorder at the meetings of council and executive committee;
(g) preservation minutes of the meeting;
(h) performing the duties assigned by the council and the executive committee and
submitting reports of the situations of work perlormance occasionally;

Assistant Chief Registrar

39. The assistant chief registrar shall be accountable to the chiefregistrar.

Accounting Oflicer

40. The accountirig officer shall be accountable to the treasuer and shall undertake the accounting
matters of the council.

Salary and Allowance

41. The chief registrar, assistant chief registrar, accounting officer and office staffs are, with the
approval of the Ministry ofConstruction, entitled to salary and allowance stipulated by the council.

Chapter VII
Finance

42. The council shall establish a firnd to implement and perform the provisions ofthe law with the
following receipts.
(a) Registration fees, annual fees, overdue fees and other deserving cash;
(b) Donations and financial supports from the local and foreign organizations and donors;
(c) Official increments and interests of the fund;
43. The council:
(a) shall try standing independently on its own fund;
(b) may, if insufficient frrnds, submit and claim to incur from the union budget with the
permission of union govemment through the Ministry of Construction.

44. The receipts of the council, including registration t'ees and annual fees, the donations by tn" O
local and foreigrr donors and the financial expenditure incurred by the Ministry of Construction shall
be entered into the accounts, spent, issued the balance and occasionally inspected in accordance with
the existing financial regulations.

45. All the cash belonging to the council, including registration fees paid to the council under these
rules shall be paid to the bank account opened by the council. All the cash withdrawal by cheque shall
be signed by the chairman or the vice-chairman assigned duty on behalfofthe chairman and two other
executive committee members.

46. The accounts ofthe council shall be inspected by the Office ofthe Union Auditor General.

47. The council shall report in writing its performances and financial situations within the last two
years to the Ministry of Construction, not in excess of three months after expiry of the financial year.

48. Procedures to be able to accept cash donation, materials, the technical and other
assistances from organizations and donors in the local and foreign

(a) If it is local organization, this organization shall officially be registered and formed;
(b) If it is foreign organization, it shall be the organization officially registered and formed
in the relevant country and there shall, if required, include the scrutiny and the
recommendation of the relevant embassies;
(c) Name, address, donation, material value, date ofdonation relating to donations from the
donors shall systematically be recorded and receipts of the donations shall be returned
without fail;
(d) If donation of movable and immovable properties, the evidence relating to the
ownership may be accepted with the scrutiny and recommendation of relevant
departments and organizations;
(e) If technical and other assistance, the transferred technology and other aids shall be
systematically recordcd; and
(0 Coordination shall be made with the concerned to have the tax exemption on all
donatibns.

Chapter VIII
Application for Registration Certificate and Issuance of it

49.. After obtaining a relevant degree and diploma from universities, colleges and institutes
recognized by the council, technicians, graduate technicians and engineers, who seek a registration
certificate under these rules, shall apply to the council.

50. When the Registration Certificate Assessment Working Committee, as required, scrutinizes
and approves to issue the certificate, it notifies to the chief registrar to be able to issue the certificate.
The chief registrar has the applicant pay the registration fees, annual fees and shall issue the following
certificate signed by him;

(a) Apprenticetechniciancertificate;
(b) Apprenticegraduatetechniciancertificate;
(c) Apprenticeengineercertificate.

5l . The chiefregistrar shall enter into register book the issued certificates.

Apprenticeship

52. The apprenticeship of apprentice technician, apprentice graduate technician and apprentice
engineer shall be as the following against it.

(a) Apprenticetechnician 2 yrs


(b) Apprentice graduatetechnician 2 yrs
(c) Apprenticeengineer 4 yrs

53. The apprentice technician shall submit the lcttcr of recommendation signed by the relevant
registered senior engineer or registered professional engineer with the satisfaction of issuance of a
technician registration certificate on perlormance ofapprentice under his control.

54. The apprentice graduate technician shall submit the letter of recommendation signed by the
relevant registered senior engineer or registered professional engineer with the satisfaction of issuance
of a graduate technician registration certificate on performance of apprentice under his control.

55. The apprentice engineer shall submit the letter of recommendation signed by the relevant
registered professional engineer with the satisfaction of issuance of a engineer registration certificate
on performance ofapprentice under his control.

56. Technician Registration Certificate -When the apprentice technician, who has finished the
apprenticeship, applies a technician registration certificate with the letter of the recommendation ofthe
relevant registered senior engineer, if it is found that applicant has eligibility in oral and written
examination, the Registration Certificate Assessment Working Committee shall recommend to the
executive committee for the issuance oftechnician registration certificate.

57. Graduate Technician Registration Certificate - When the apprentice graduate technician,
who has finished the apprenticeship, applies a graduate technician registration certificate with the 1
letter of the recommendation of the relevant registered senior engineeq if it is found that the applicant U
has eligibility in oral and written examination, the Registration Certificate Assessment Working
Committee shall recommend to the executive committee for the issuance of a graduate technician
registration certificate. When the technician completed two years stipulated and the prescribed
stipulations for eligibility, the Registration Certificate Assessment Working Committee shall
recommend to the executive committee the qualified registered technician to promote the registered
graduate technician.

58. Engineer Registration Certificate -


When the apprentice engineer, who has finished the
apprenticeship, applies engineer registration certificate with the letter of the recommendation of the
relevant registered professional engineer, if it is found that the applicant has eligibility in oral and
written examination, the Registration Certificate Assessment Working Committee shall recommend to
the executive committee for the issuance of engineer registration certificate. When the registered
graduate technician completed four year stipulated and the prescribed stipulations for eligibility, the
Registration Certificate Assessment Working Committee shall recommend to the executive committee
the qualified registered graduate technician to promote the registered engineer.

59. Registered Senior Engineer Certificate -When the qualified registered engineer, who has
already obtained the engineer registration certificate, completed two years, and be able to fulfill the
prescribed stipulation, applies to promote the registered senior engineer, the Registration Certificate
Assessment Working Committee shall scrutinize whether or not tlre applicant has eligibility of
prescribed requirements, and if fulfilled, recommend to the executive committee to issue the registered
senior engineer certifi cate.

60. Registered professional Engineer Certificate -When the qualified registered senior engineer,
who has already obtained the registered senior engineer certificate, completed one year and be able to
fulfill the prescribed stipulation, applies to promote the registered professional engineer, the
Registration Certificate Assessment Working Committee shall scrutinize whether or not the applicant
has eligibility of prescribed requirements, and if fulfilled, recommend to the executive committee to
issue the registered professional engineer certificate.

61. In the event of approval of tlre executive committee on the submission of rules 56, 57, 58, 59
and 60, the Registration Certificate Assessment Working Committee shall notify in writing to the chief
registrar to issue a registration certificate. The chief registrar has the applicant pay registration fees
and annual fees, and issues the relevant registration certificate signed by the chairman or the
authorized person of the chairman. The chief registrar shall enter into the register book the issued
certificates.

Registration Limited Certificates

62. Registration Limited Engineer Certificate- When the Registration Certificate Assessment
Working Committee, with the approval of the executive committee, notifies describing the permitted
kind, status, location and term of engineering specialization to issue the certificate to foreign engineer
who comply with the following facts, the chief registrar has the applicant pay registration fees and
annual fees, and issue the registration limited engineer certificate signed by the chairman or the
authorized oerson of the chairman:

(a) The applicant shall work under a foreign engineer who has a registration limited
professional engineer certificate and practices the same kind of engineering
specialization; or
(b) The applicant shall work under Myanmar citizen, registered professional engineer;
(c) The applicant shall perform in accordance with the existing laws, rules, regulations,
notifications and directives relating to immigration in respect of entry and residence of
the foreigners;
(d) The applicant shall pay the income tax according to the prescribed income rate lor the
forei gner.

63. Registration limited professional engineer certificate - When the Registration Certificate
Assessment Working Committee, with the approval and scrutiny of the executive committee, notifies
describing the limited kind, status, location and term of engineering specialization to issue the
certificate to ASEAN foreign professional engineer and other foreign professional engineer who
comply with the following facts under the ASEAN reciprocal recognition, the chief registrar has the
applicant pay registration fees and annual fees, and issue the registration limited professional engineer
certificate sigaed by the chairman or the authorized person of the chairman:

(a) He shall work jointly with Myanmar citizen registered professional engineer;
(b) He shall perform in accordance with the existing laws, rules, regulations, notifications
and directives relating to immigration in respect ofentry and residence of the foreigner;
(c) He shall pay the income tax according to the prescribed income rate for the foreigner.

Requirements of applicants of the registration certificate

64. Registered graduate technician -'fhe registered technician, who applies to the council for a
registration graduate technician certificate, shall meet the following requirements.

(a) Technician level development program course


In this course, technical subjects shall be discussed and lectured and all the applicants
shall attend at least 20 hours. Subject detailed and specification of the study shall be
expressed in the specific direction.

(b) Written Examination for Technician Level Assessment-All registered technicians,


who apply the certificate, shall take written examination. This assessment includes two
portions that are elementary and advanced examination. Advanced examination shall be
allowed only after passing an elementary examination. The elementary examination
allowed is two hours in the moming and two hours in the evening and the advanced
examination time allowed is two hours in the moming and two hours in the evening.
The spbject in details to be taken in the examination shall express in the specific
direction.
(c) Technician Level Experience and Quality Eligibility Report - The registered
technicians, who apply the certificate, shall write the report in English from word limit
2000 to 4000 and submit five copies. The type of the report to be written shall be
expressed in the specific direction.
(d) Technician Level Interview -All registered technician shall be interviewed by a
group, which is formed by the Registration Certificate Assessment Working

65. Registered engineer -The apprentice engineer, who applies registration engineer certificate to
the council, shall meet the qualifications prescribed in rule 55. The registered graduate technician, who
apfilies registration engineer certificate to the council, shall fulfill the following requirements:

(a) Graduate technician level development program course - The training shall discuss
and lecture engineering specialization and all applicants shall attend at leastthefull30
hours. The subject in details and the specification of time to be attended shall be
expressed in the specific direction.
(b) Graduate technician level assessment written examination - All registered graduate
technicians, who apply the certificate, shall take written examination. In this
assessment, there are two portions that are elementary and advanced examination.
Advanced examination shall be allowed only after passing an elementary examination.
The elementary examination time allowed is two hours in the moming and two hours in

the evening and the advanced examination time allowed is two hours in the moming
and two hours in the evening. The subject in details to be taken in the examination shall
be expressed in the specific direction.
(c) Graduate technician level experience and quality eligibility report -all registered
graduate technicians shall write the report in English from word limit 2000 to 4000 and
five copies of report shall be submitted. The tlpe of the report to be written shall be
expressed in the specific direction.
(d) Graduate technician level interview -All registered technicians shall be interviewed
by a group, which is formed by the Registration Certificate Assessment Working
Committee, involves at least three members after passing the written examination and
submitting the report.

66. Registered senior engineer - The registered engineer, who applies for the registration senior
engineer certificate to the council, shall meet tlte following requirements.

(a) Engineer level development program course - The engineering specialization shall
be discussed and lectured in the training and all applicants shall attend at least the full

30 hours. The subject in details and the time to be attended shall be expressed in the
specific direction.
(b) Engineer level assessment written exarnination - All registered engineers, who apply
the certificate, shall take written examination. This assessment includes two portions
that are elementary and advanced examinations. Advanced examination shall be
allowed only after passing an elementary examination. The elementary examination
allowed is two hours in the moming and two hours in the evening and the advanced
examination time allowed is two hours in the moming and examination hours in the
evening. The subject in details to be taken in the examination shall be expressed in the
specific direction.
(c) Engineer level experience and quality eligibility report - The registered engineers,
who apply the certificate, shall write the report in English from word limit 2000 within
4000 and submit five copies. The type of the report to be written shall be expressed in
the specific direction.
(d) Engineer level interryiew - All registered engineers shall be interviewed by a group,
which is formed by the Registration Certificate Assessment Working Committee,
involves at least tlree members after passing the examination and submitting the report.

67. Registered Professional Engineer - The registered senior engineers, who apply the
refistration professional engineer certificate to the council, shall meet the following requirements.

(a) Professional level development program course -The engineering specialization


shall be discussed and lectured in the training and all applicants shall attend at least the
full 30 hours. The detailed subject and time to be attended shall be expressed in the
specific direction.
(b) Professional level assessment written examination-All registered senior engineers,
who apply the certificate, shall take written examination. In this asscssment, they
include two portions that are elementary and advanced examinations. Advanced
examination shall be allowed only after passing elementary examination. The
elementary examination allowed is two hours in the moming and two hours in the
evening and the advanced examination time allowed is two hours in the moming and
two hours in the evening. The subject in details to be taken in the examination shall be
expressed in the specific direction.
(c) Professional level experience and quality eligibility report - The registered senior
engineers, who apply the certificate, shall write the report in English from word limit
2000 within 4000 and submit 5 copies of the report. The type of the report to be written
shall be expressed in the specific direction.
(d) Professional level interview - All registered senior engineers shall be interviewed by a
group, which is formed by the Registration Certificate Assessment Working
Committee, involves at least three members after passing the examination and
submitting thc report.

Exemption

6ti. When the Registration Certificate Assessment Working Committee submits to the executive
oommiltee b mitigate (lessen) the stipulations fiom rules 64 to 67 in respect of requirements to be met
by the registration certificate applicants as a special mattcr, the executive committee shall

continuously submit to the council. The council may, if desired, pemit mitigation in coordination with
the executive committee.

Registration Term

69. The registration term of the registration technician certificate, registration graduate technician
certificate and registration engineer certificate are two years. The registration terms of registration
senior engineer certificate and the registration professional engineer certificate are as the period in the
conditions under the subsection (b) of section 28 and subsection (b) of section 29.

Extension of Registration term

70. At the end of the term prescribed at time of registration certificate if


holders of
issuance,
registration certificate seek to extend the term, they shall apply to the council at least 60 days before
the expiry of the term. On approval of extension of the Registration Certificate Assessment Working
Committee, the term.of registration shall be extended by making them pay annual fees. In excess of
targeted period, applicants may apply extension after paying annual fees as well as overdue fees.

Refusal of Extension of Registration Term

71- The executive committee:

(a) may refuse an extension of registration, if it is found that there is any of following
maters:

(D being imprisoned ofany offence relating to morality;

(iD misbehavior found by the Ethic Preservation Working Committee or the


Disciplinary Working Committee;

(iii) mental illness, unsound mind or deficiency of body organ or other reason and
inability to perform duties of the holder ofthe registration certiflcate.

(b) shall notity in writing to the chief registrar the cancellation of the registration certificate O

Appeal

72. The person refused for extension ofthe registration certificate may, ifdissatisfied, appeal to the
council within 60 days of the date ofthe decision ofthe executive committee.

73. The council may confirm, amend or cancel the decision of the executive committee in the
appeal under the rule 72.

Application of new registration certificate

74. 1'he person whose the registration certificate has been cancelled, may apply to the council for
the new registration certificate again in excess of more than three years subsequent to the recession.

Chapter IX

Duties and Rights of Holder of Registration Certificate

'75. The holders of registration certificates issued under the law shall follow other procedures,
order and directive, issued under these rules and law, and relevant regulations and stipulations.

76. The holders of registration certificate shall comply with the ethics of the engineers, graduate
technicians and technicians, prescribed by the council.

77. The holders of registration certificates shall have the right to officially operate relevant
engineering and technology work within the Republic of the Union of Myanmar.

78. The technicians, graduate technicians and engineers, who have obtained registration certificate,
have right to use the terms applicable against the name as follows:

(a) Technician Registration Certificate-The holder of the technician registration


certificate has the right to add and use the R. Tech after the name during the period of
the recognition from the council.
(b) Graduate Technician Registration Certificate -The holder ofthe graduate technician
registration certificate has the right to add and use the R.G. Tech after the name during
' the period ofthe recognition from the council.
(c) Engineer Registration Certificate -The holder ofthe engineer registration certificate
has the right to add and use the Engr. before the name and the R.E. after the name
during the period ofthe recognition from the council.
(d) Registered Senior Engineer Certificate - The holder ofthe registered senior engineer
certiflcate has the right to add and use the Engr. before the name and the R.S.E. after
the name during the period of the recognition from the council.
(e) Registered Professional Engineer Certificate - The holder of the registered
professional engineer certificate has the right to add and use the Engr. before the name
and the P.E. after the name during the period ofthe recognition from the council.

79. The holders of registration certificate have the right to tender advice to the council for the
progress and success ofthe duties and functions ofthe council.

80. The holders of registration certificate have the right to submit his damages to the council and
acquire the suggestion ofthe council.

81. The registered professional engineers have the right to be elected as Council Member if
fulfilled qualifications prescribed by the council.

Chapter X

Preservation Discipline

Disciplinary Working Committee

82. lt is the duty of the council that it has the engineer. graduate technician and technician who
hold the registration certificate issued by the council. and the engineering companies and organizations

scrutinized and recognized by the council comply with discipline. The council assigns the Disciplinary
Working Committee to perform the duty of the preservation discipline effectively.

Privileges of examinee

83. The examinee taken action by the council due to any rs$on:

(a) have the right to adequate defense for the offence;


(b) have the right to be heard the relevant inquiry in the presence ofhim.
(c) have the right to defense the charge ofhim in writing within adequate time;
(d) have the right to be examined orally, as witness by personally, cross-examine the
witnesses.
(e) have the right to claim for the assistance of the friend or help provider of the skill to
conduct.

Complaint

84. Any complainant against registration technician or registration gaduate technician or O


regishation engineer or registered senior engineer or registered professional engineer or engineer may
submit complaint letter to the chief registrar of the council. In that case, the chief registrar shall
consecutively submit the above matter to the executive committee-

85. The executive committee received the complaint shall assign the Disciplinary Working
Committee to inspect and inquire such matter, ifbelieved that there is sufficient reason in it.

86. The Disciplinary Working .Committee shall form the inspection team, comprising three
members out of its members to inquire for breach ofdiscipline of any holder of registration certificate
or company of engineering specialization.

Investigation

87. Prior to the inquiry of the inspection team formed by the Disciplinary Working Committee, the
chief registrar shall noti$ writing of the content of the complaint to the complained holder of
registration certificate or engineering company to resent clarification within 14 days from the date
receiving notice or, as required, to come and explain to the Disciplinary Working Committee
personally.

88. After reading and hearing ofthe re-clarification of the person being complained and ifbelieved
that he had right to adequate defense, the inspection team shall cornrnence to investigate the complaint
in excess of date expressed in the rule 87.

89. The inspection team shall send for officially anyone:

(a) to be examined personally in the presence ofthe team;


(b) to submit the accounting books, documents and other evidentiary documents related to
the matter of the investigation in position of him in the presence of the team.

90. Without exception under the law, the witness shall not make the refusal of the seeking of the
team, the default of cooperation, the refusal to answer or answering fraudulently and incorrectly. If
there is breach ofsuch prohibitions, action shall be taken under section 43 of the law.

91. Any witnesses in the presence of the inspection team shall have the same right and protection
under the law as a witness in any of the court.

92. For tendering legal advice to the inspection team, the council has the right to hire an attomey
by incurring the cost from the fund ofthe council.

93. The inspection team shall complete the investigation within 6 months from the date of
commencement unless the team has permission separately from the Disciplinary Working Committee.

Trial

94. The inspection team shall submit its report which includes frnding and assumption to the
Disciplinary Working Committee when the team completes the inspection.

95. According to the report, the Disciplinary Working Committee:

(a) shall submit complete evidence with the assumption that the complaint is the
unreasonable allegation to the executive committee, if it thinks that the complaint is on
the urneasonabl e ground.
(b) shall submit the report of the inspection team with its suggestion to the executive
committee, if it is found that there is sound evidence in the complaint.
,
96. The executive committee may dismiss the complaint, if it decides that the complained person is
not guilty. If it decides that the complained person is guilty, it may pass any of the following penalties.

(a) censure in writing to the complained person;

(b) fine which does not exceed five hundred thousand kyats;

(c) closing of the engineering work lbr the period not more than two years of the person
complained;
(d) cancellation ofthe registration certificate ofthe complained person.

97. The chief registrar shall send in *'riting to the person being complained the decision passed by
the executive committee.

Chapter XI

Appeal

98. The person who is imposed may appeal to the Council within 60 days from the date of the
decision if he is dissatisfied ofthe decision or penalty passed by the executive committee.

99. The appeal shall be submitted directly addressing to the chairman ofthe council.

100. The appellate plaint shall be submitted and, if required, attached the evidentiary documents
which include the significant evidence that he has no t'ault.

101. The council for a special meeting of the council within 30 days from receiving the

appellate plaint. When the council reviews and scrutinizes of the deoision of the executive committee
and report of the inspection tcam. the council is to give appellant and respondent to be heard. And the

council may confirm, amend or cancel the decision of the executive committee with the approval of
the majority of the Council Members.

ChaPter XII
Prohibited and Constrained Works

102. The prohibition in section 37 means the following engineering works:

(a) Urban Engineering Works;

(D Public buildings (such as school, hospital, cinema hall, sport ground, city hall,
'supermarket and the others) more extensive than flooring area 100sq m and
much higher than six meters until floral accents;

(iD The streets leveled highway, not fumished gravel road and rough gravel road,
normal earth road;

(iiD Wood, Steel and Iron Concrete Bridges more than 12 tons capacity and 6 m of
house posts distance;

' (iv) Earthen reservoir more than 6m high;

(v) Urban work prohibited by the relevant authority and municipal committee

(b) Industrial Engineering Works


(1) Heater, ventilator and air-con installation above 100 kilo watts;
(2) Industrial workshop work above 100 kilo watts;
(3) Ironware and metal works above 100 kilo watts;
(4) Machine, vehicle and mechanism construction work above 25 hp;
(5) Construction works ofengine vessel above 20 hp;
(6) Boiler repair works above 2 tons;
(7) Industrial works prohibited by the relevant regional authorities and govemment I
organizations.
(c) Electric power engineering works
(1) Motor repair works above 50 kilo watt, 400 voltage;
(2) Domestic electricity installation works above 400 voltage;
(3) Transformer repair and installation works above 50 KVA;
(4) Electric line installation works above 400 voltage;
(5) electricity works prohibited by the relevant regional authorities and govemment
organization:.
(d) RemainingSpecializationEngineeringWorks
Except civil engineering work, mechanical engineering work and electric power engineering
work, the council shall issue separate direction for the prohibited and constrained work
regarding the other specialization engineering work.

103. Any registered engineer, registered graduate technician and registered technician shall have the
right to operate the engineering works under the supervision ofthe registered professional engineer or
the registered senior 6ngineer.

104. The registered senior engineer have the right to operate the following engineering works
constrained by these rules, by calculation of design, signing the layout and construction without the
supervision of the registered professional engineer.

(a) Civil Engineering Works

(D Normal residential building, not public buildings (such as school, hospital,


cinema hall, sport ground, city hall and supermarket and the others) not
extensive than flooring area l000sq m and not higher than 28 meters until floral
accents;

(iD Two-lane tar and concrete roads under the capacity load 13 tons;

(iii) House posts distance under 20 meters and steel and iron concrete bridges under
the capacity load 40 tons;

(iv) Earthen reservoirs under 30 meters high.

(b)Mechanical engineering works

(i) Under 2000 kilo watts medium heater, ventilator, and air-con installation;

(iD Under 2000 kilo watts applicable medium industrial workshop;

(iiD Under 2000 kilo watts applicable medium ironware and metal works;

(iv) Machine, vehicle and mechanism construction works under 25 hp;

(v) Medium engine vessel construction works under 50 tons weight;

(vi) Boiler installation and repair works less than 6 tons.

(c) Electric power engineering works:

(D Medium motor, generator manufacture, repair and installation work under 400
kilo watts;

(iD Electricity installation works ofthe building not higher than 28 meters;

(iiD Transformer repair, manufacture and installation in the worksite under 500
KVA;

(iv) Electric power line installation works under I I KV;

(v) Electric power sub-generation installation and repair works under 500 KVA.

Chapter XIII
Miscellaneous

105. The offrce of the Myanmar Engineering Council shall be situated in Yangon City of the
Republic of the Union of Myanmar.

| 06.In the event of the non-civil servant Council Member and the executive member are to attend
the meetings, conferences and workshops invited by foreign engineer organization relating to same
work, they shall have right to hold a kind ofpassport issued to govemment offrcial.

lO7. The non-civil servant Council Members, the executive committee members and the outside
experienced engineers who are the members of the engineering specialization group formed by the
council may -

(a) enjoy the entitlement stipulated by the Ministry of Construction occasionally.


O) enjoy the travelling allowance which cost actually and daily allowance stipulated
occasionally if travelling on duty.
(c) enjoy the honorarium which stipulated occasionally if they attend the meetings of the
council.

Logo

108. The council may, with the approval of the Ministry of Construction, use the logo of it.

Olfice Seal

109. The council: -


(a) has right to use copyright office seal;
(b) shall keep the office seal not to use in other except the official letter ofthe Council;
(c) shall instruct the office seal to be kept safely by the chief registrar;

110. The council may claim the Ministry of Construction to provide the following desirables
enabling to perform effectively its duties:

(a) appropriate office room and accommodation for the council;


(b) office-use furniture, utilities and stationeries;
(c) offrce peons;
(d) transportation.
