JUDICIAL AFFIDAVIT

This judicial Affidavit of Spouses Chiz and Heart Escudero, who are
the defendants of the above mentioned case, are executed to serve
as their direct testimony in the case.

This judicial affidavit s being offered to prove the following:

A. All the allegations in the complaint including all annexes and
appendices which were already marked es exhibits in the case;

B. All other relevant matters, fact and circumstances relevant and

material to this case.

This judicial affidavit was taken at the office of Atty. Donald Trump at
Marasbaras, Blk 4 Lot 9 Tacloban City.

Questions were propunded by Atty. Brandon Kris Go Bitas and

questions are numbered consecutively and each question is
answered by defendants.

1. Do you swear to tell the truth and nothing but the truth?
We do
2. Are you aware that you can face criminal liability for false
testimony or perjury if you will not tell the truth?
We are aware.
3. How did you met plaintiffs?
He went to the house subject of the suit and claimed that as
new owner, he had the right to make us leave the premises.
4. How did plaintiffs utter the statement of “making you leave”?
In a rude tone.
5. Did you tell them that you have contract of lease with the
previous owner and what was the reply after saying the same?
Yes. They replied that they don’t care because they assert their
ownership.
6. Where can we find that contract of lease?
It is attached to our pleading. It was marked as Exhibit 1.
 7. Is this contract registered in the register of deeds?
Yes.
8. When was your first payment of the contract of lease and the
last payment?
We paid in advance the amount of P200,000. We were
suppose to use the land until Aug. 4, 2019.
9. Do you have evidence of payment?
Yes, it is attached their as Exhibit 2.
10. What do you do with your leased property as of now?
We leased it and made it as warehouse since we are selling
furniture and other household items.
