PLEASE TAKE NOTICE that upon the annexed Declaration of Mark Schroeder; the

accompanying Memorandum of Law; and upon all prior proceedings, defendants Andrew M.

Cuomo, Letitia A. James and Mark J.F. Schroeder will make a motion, taken on submission

unless the court orders otherwise, at the James T. Foley U.S. Courthouse, 445 Broadway,

Albany, NY 12207 on September 19, 2019 at 9:00 a.m., or as soon thereafter as counsel can be

heard, pursuant to 28 U.S.C. § 1404(a), for an order transferring venue of this action to the

Western District of New York; or, in the alternative, for an order staying this matter pending

decisions by the court in the closely related Kearns v. Cuomo, et al. case (W.D.N.Y. 1:19-cv-

0902) on the Kearns plaintiff’s motion for a preliminary injunction and the Kearns defendants’

imminent motion to dismiss in that matter; together with such other or further relief as may be

just.
