1.0 PRELIMINARIES

I. THE SITE

Project Location
NATIONAL HIGHWAY, GAMU, ISABELA

Site Visit

The Contractor shall be deemed to have visited the Site, to acquaint


themselves with the location, means of access, nature of soil, facilities for
storage, parking and working space and other information which may
affect their tender. No claim will be considered for extra payment or an
extension of time for not doing so.

Access to the Site

The General Contractor shall be responsible for ensuring that they are
properly authorized to cross the roads and adjacent properties and must
give all notices, pay all fees and reinstate and make good at their own
cost all damage caused to such roads and adjacent properties however
the damage occurs.

Use of the Site


The Contractor shall accept The Site as found on the Commencement
Date and at their own expense clear The Site of any debris, which may
have been left by any preceding occupants and/or Contractors.

All temporary structures, offices, workshops, store sheds, etc. shall be


restricted to areas not used by the Owner's Staff, the Project Manager,
the Owner's Consultants and the general public. Their precise positions
shall be agreed with the Project Manager prior to their erection.

Adjacent Structures and Buildings

Before commencing The Works, the Contractor should undertake a


comprehensive survey of any adjacent land, buildings, structures,
services and the like which may be affected by The Works. Three sets of
the survey, inclusive of color photographs, reports and records of the
adjacent land, building, structures shall be submitted to the Project
Manager.

The Contractor shall be solely responsible for the safety and stability of
any adjoining structures and buildings and allow for any shoring and
strutting required. Such shoring shall be positioned or altered and
adopted from time to time so at to maintain adequate working space for
construction operations.

If the Contractor wishes to erect scaffolding or otherwise make use of


adjoining land or its airspace, they shall serve notices, obtain all
necessary permissions and clear away and make good any damage at
their own expense and pay all costs in connection therewith.

Existing Mains/Services/Utilities

Prior to Commencement of the Works, the Contractor shall carry out


extensive site investigations to ascertain and confirm the exact routes and
locations of all existing services whether or not shown on the drawings.
The Contractor shall make additional records by means of cable detection
equipment, exploratory trial holes and/ or other methods approved by the
Project Manager. If necessary, the Contractor shall obtain this information
from the Statutory Authorities or adjacent site or property owners.

The Contractor shall, where necessary, provide due allowances for


making arrangements for necessary diversion of the existing services.

The Contractor shall exercise the greatest care during the process of the
Works to avoid damage to or interference with any public utility and
communication services within the limits of or within the immediate vicinity
of the Site and shall be solely responsible for making good any damage
caused by him or his agents directly or arising indirectly from anything
done or omitted to be done and pay all costs and charges therewith. The
Contractor shall carry out all temporary works necessary to adequately
support and protect such services.

The Contractor shall allow for complying with the obligations, liabilities
and services described in the General Conditions of Contract.

III. BONDS AND INSURANCES

a. Surety Bond (Downpayment Guaranty) - 30% of total contract amount


b. Performance Bond - 30% of total contract amount
c. Retention or Guaranty Bond - 10% of total contract amount
d. Contractor's All Risk Insurance (CARI)
(Bonds and insurances shall be secured from Owner approved Bonding Company).

The Owner shall not be liable for or in respect of any damages or


compensation payable at law in respect of or in consequence of any
accident or injury to any workman or other person whether in the
employment of the Contractor or any sub-contractor. The Contractor shall
indemnify and keep indemnified the Owner against all such damages or
compensation and against all claims, demands, proceedings, costs,
charges and expenses whatsoever in respect thereof or in relation
thereto.

IV. PROVISION, CONTENT AND USE OF DOCUMENTS

Generally

In case of using alternative materials and workmanship, it must be equal


to those originally specified and subject to the Project Manager's and
Owner's approval.

Dimensions/Ordering Materials

Before commencing any work or ordering any materials the Contractor


must verify all dimensions, measurements, etc. No claim will be
considered for extra payment or an extension of time arising from the
Contractor failing to implement the requirements.

The Contractor shall provide evidence that the orders have been placed
with sub-contractors and/or suppliers within one week of request of the
Project Manager.

Setting Out

The Contractor shall establish a temporary benchmark, to establish levels


and inform the Project Manager of details of such benchmarks used for
this purpose. Immediately after taking possession of The Site and before
commencing The Works, the Contractor shall check and verify the actual
levels against those shown on the drawings. Any discrepancy between
actual dimensions or levels and those shown on drawings shall be
referred immediately to the Project Manager for clarification and further
instruction.

The Contractor shall allow for providing, all instruments and labor
requested by the Project Manager for the purpose of checking the levels
and setting out.

In the event of any works varying from its correct position by more than
the permitted tolerances mentioned in the Contract Specification, the
Project Manager may consider it necessary, require the Contractor at the
Contractor's expense to rectify and make good the error. No extension of
time will be granted for these works.

V. MANAGEMENT OF THE WORKS

Generally
The Contractor shall accept responsibility for co-ordination, supervision
and administration of The Works, including all subcontracts, arrange and
monitor a programme with each sub-contractor, Nominated Sub-
contractor, Nominated Supplier, Statutory Authority and obtain and supply
information necessary for co-ordination of The Works.

Site Management Personnel


The Contractor shall constantly keep upon The Works, on fulltime basis,
the following site personnel:

a. A competent and experienced "Contractor's Construction Manager"


who shall be overall in charge of The Works.

b. Adequate, qualified and competent Civil and Structural Engineers

d. Adequate , qualified architectural finishing Foremen.

e. A qualified and competent Safety Officer, who shall continuously be in


charge of all aspects of safety in connection with the Works.

h. Adequate foremen, who shall be continuously in charge of the


execution and maintenance of The Works throughout the currency of the
Contract.

i. Adequate assistant foremen, site supervisors and all necessary "back-


up" staff who are skilled, competent and experienced in their respective
callings.

Overtime

The Contractor shall at their own expense supply all necessary additional
labor at night and overtime work as may be necessary to complete The
Works in accordance with the Construction Period.

Prior notification to the Project Manager shall be given before overtime


works is carried out.

Site Meetings
The Project Manager will hold regular weekly site meetings to review
matters arising from the administration of the Contract.

The Contractor's Construction Manager shall be required to attend all


meetings called by the Project Manager and must be empowered to make
decisions on behalf of the Contractor.

The Contractor shall submit to the Project Manager and other Consultants
before each meeting an agenda listing site problems, variations or extra
works instructed by the Project

Managed the progress of The Works and any other matters for
discussion during the meeting

The Contractor shall ensure the availability of suitable accommodation at


the time of all such meetings.

Programme of Work/Progress

Prior to commencing The Works, the Contractor shall submit to the


Project Manager for approval two copies of a detailed master programme
using MS Project, showing the intended method, stages, by milestone
commitments, and order of proceeding with The Works, together with the
period of time estimated for each and every stage of progress.

The programme for the Works must show the intended construction
method, sequence, stages and order of proceeding with The Works and
include for all:
a. Planning and mobilization by the Contractor

b. All key dates, e.g., Date of Possession/Commencement, topping off,


testing, building watertightness, Taking Over, etc.

c. Provision of and approval of samples, mock-ups, etc.


d. Approval periods inclusive of all inspections
e. Off-site activities, e.g. fabrication, early order of major plant and
equipment
f. Works shown on the drawings
g. Running in, adjustment, commissioning and testing of all engineering
services and installations

h. Any other activities having a bearing on the time required to complete


The Work.

Monthly Report/Other Reports


The Contractor shall prepare and submit to the Project Manager, on a
monthly basis, copies of a project report, in a format and containing
information agreed, in advance, with the Project Manager. This report
shall be submitted to the Project Manager during the last week of every
month.

VI. DRAWINGS AND SUBMISSIONS TO BE PREPARED BY THE


CONTRACTOR
Drawings
The Contractor shall prepare and submit to the Project Manager for
approval the following drawings and information, at various stages during
the Construction Period.
a. Working Drawings
b. Shop Drawings
c. As-built Drawings

Samples, Specimen Finishes, etc.


The Contractor shall prepare specimens, samples, etc. as required by the
Contract Specifications and/or Contract Drawings, for the Project
Manager's approval before proceeding with The Works.

The Contractor shall provide full size models/mock-ups of the principal
features or details and shall erect them at the correct height for the
approval of the Project Manager if so required by the Contract
Specifications.

Tests
The Contractor shall allow for all tests that may be required by the
Contract Specifications including all costs associated with the carrying out
of the tests, whether the test is successful or not no extension of time or
loss and expense to be considered. The Contractor shall submit a copy of
each test certificate to the Project Manager as soon as is practicable and
retain copies of all such certificates on The Site.

VII. QUALITY STANDARD AND CONTROL

Quality of Products

All materials to be incorporated to the project shall be new and as


specified. The Contractor shall obtain certificates of compliance from
Manufacturers when requested by the Project Manager.

Compliance of Products
The Contractor shall check all delivery tickets, labels, identification marks
and, where appropriate, the products themselves to ensure that all
products comply with the project documents. In particular, the contractor
shall check the following:
a. the sources, types, qualities, finishes and colors are correct and match
to approved sample
b. All accessories and fixing are complete.
c. Sizes and dimensions are correct.
d. Quantities are correct
e. Products are clean and undamaged.
f. Products, which have limited shelf life, are not out of date.

Protection of Products
Protect all the products from distortion or any type of physical damage,
keep clean and free from contamination.

Quality of Workmanship
The Contractor shall ensure that all operatives are appropriately skilled
and experience for the type and quality of work that they are undertaking
and take all necessary precautions to prevent damage to The Works from
sun, rain and other hazards.

The Contractor is responsible for the safety of all persons engaged in the
execution of The Works and take precaution necessary to protect the
public from injury or death during the course of The Works.

The Contractor is to provide and enforce the wearing of construction


safety helmets where necessary, face masks, eye goggles, ear protectors,
safety harnesses and other personal protection equipment for all persons
engaged in the execution of The Works.

The Contractor shall provide all temporary signage, warning tapes, flags,
signals and marking and during the hours of darkness such lights, as the
Project Manager or any Statutory Authority may require for the safety of
site personnel, the public or aircraft. Remove at Taking Over and make
good all affected locations.

IX. SECURITY

The Contractor will be solely responsible for safeguarding The Works. The
employment of Security Guard will not be considered as relieving the
Contractor's responsibility for safeguarding the Works, materials, fittings,
plant, etc. against losses or damage.

The Contractor shall be responsible for implementing a photo


identification (ID) to the approval of the Project Manager. All Contractors
workmen, including management and supervisory staff, subcontractors,
hourly paid or contract workers will be required to keep their ID card in
their possession at all time.

The Contractor shall ensure that gates are fitted at all entrances and will
be closed and locked during all non-working hours. Every entrance may
have a watchman/ or guard on duty at all times during which the entrance
is open.

The Contractor shall make provision for protecting all work from damage,
weather, etc. and provide casing or covering for the protection of any work
requiring it throughout the Contract Period. Where work is of an especially
vulnerable nature or is exposed to abnormal risks, the Contractor shall
provide special protection to ensure that damage does not occur. Any
damage arising in this context shall be made good at the Contractor's own
expense.

The Contractor shall inform the Project Manager of the intended sitting of
all spoil heaps, Temporary Works, etc. and obtain his approval prior to
their positioning.

Maintain, alter, adapt and move Temporary Works as necessary or as


required by the Project Manager. Remove at Taking Over and make good
all locations.

The Contractor shall pay all fees and other charges levied in connection
with all Temporary Works

Toilets, Storage, Workshops, etc.

The Contractor is to provide and erect field offices, toilets workshops, and
storage sheds as they may require and maintain them and keep them in
good order to the satisfaction of the Project Manager.

The Contractor will be responsible for arranging the necessary temporary


connections to the sewers and making good at completion of The Works.

Lighting, Power, Water, Telephone, Fire Protection, Ventilation &


Air-Conditioning, etc.

The Contractor is to provide electric supply , which shall be obtained by


metered supply from the mains grid where available or otherwise from a
source approved by the Project Manager.

The Contractor shall pay all fees and charges for the supply, meter,
temporary wiring and connections.

The Contractor shall provide meters and temporary arrangements for


electrical distribution around the site including that required by all sub-
contractors.

The Contractor shall provide all artificial lighting and electric power for The
Works, including that required by all contractors and subcontractors.

The Contractor shall provide clean, fresh water for The Works including
that required by all sub-contractors and temporary arrangements for
storage and distribution around the site.

The Contractor shall provide fire extinguishers, sand buckets and other

Prior to Taking Over, the Contractor shall clean The Works thoroughly
inside and out to the satisfaction of the Project Manager.

The Contractor shall leave The Works secure with all accesses locked.
Account for and adequately label all keys and hand over to Owner with
itemized schedule, retaining duplicate schedule signed by Owner as a
receipt.

The Contractor shall list and handover to the Owner al spare parts, tools,
"attic stock", etc. required in the Contract Documents.

The Contractor shall be responsible for the production of all parts of the
operation and maintenance manuals. They shall be a comprehensive
