NOTIFICATION

G.O. (P) No. 135/2002/Fin Dated, Thiruvananthapuram, 14th March, 2002

S.R.O. No. 237/2002- In exercise of the powers conferred by sub-section (1) of section 2 of
the Kerala Public Services Act, 1968 (19 of 1968), read with section 3 thereof, the Government of
Kerala hereby make the following rules further to amend the Kerala Service Rules, namely:-
RULES
(C.S. No. 3/2002)
1. Short title and commencement - (i) These rules may be called the Kerala Service (Amend-
ment) Rules, 2002.
(ii) They shall be deemed to have come into force on the 25th day of July 1995.
2. Amendment of the rules- In Part I of the Kerala Service Rules,
(i) For Government Decision No. I under Rule 44, Part I of the Kerala Services Rules, the
following shall be substituted.
"Notwithstanding anything contained in the second and third provisos to Rule 44 (1) Part I of
the Kerala Service Rules, House Rent Allowance and City Compensatory Allowance admissible
from time to time will be payable during the periods of leave with allowances, including leave prepa-
ratory to retirement, if the total period of such leave at a time does not exceed 180 days or if the
actual duration of the leave exceeds 180 days, for the first 180 days of such leave".
(ii) In Rule 93,
(a) for clause (iii) the following clause shall be substituted, namely:-
"(iii) Hill Tract Allowance, House Rent Allowance and City Compensatory Allowance
admissible from time to time will be payable during periods of all leave with allowances, if the total
period of such leave at a time does not exceed 180 days of such leave"
(b) Note 2, shall be omitted.
(c) In Note 3, for the words "four months", the figures and word "180 days" shall be
substituted.
(iii) for Rule 94, the following rule shall be substituted, namely:-
"94. An Officer on commuted leave is entitled to leave salary equal to twice the amount of
the pay admissible under clause (i) of Rule 93 and the allowances applicable under clause (ii) and
(iii) thereof to the pay so admissible.

Explanatory Note
(This does not form part of the notification, but is intended to indicate its general purport.)
House Rent Allowance, City Compensatory Allowance, Hill Tract Allowance which were ad-
missible only upto first four months of leave with allowances, were enhanced upto first 180 days of
such duration of leave vide G.O. (P) 448/95/Fin. dated 25-7-1995 and G.O. (P) 523/96/Fin. dated
1-9-1996. This notification is mainly to give statutory validity to the said orders.
This notification is intended to achieve the above object.
