MANIFESTATION

COMES now plaintiff, unto this Honorable Court most respectfully avers:

1. That a Compromise Agreement was entered by XXX23, employee of XXX

Bank of ABC Inc. with Juan De Guzman, the defendant, in lieu with the latter’s
debt with the plaintiff bank. Attached hereto is the copy of the said Compromise
Agreement as annexed “A”;

2. That at the time of the entry of the said agreement, XXX23 was not among
the authorized representative to enter the said agreement as per Board
Resolution # 50 Series of 2011. Attached hereto as annex “B”;

3. That the Board of XXX BANK OF ABC, INC is not amenable to the
monthly payment of the defendant in the amount of Two Hundred Pesos
(P200.00) but instead they are amenable of monthly payment of Two Thousand
Pesos (P2,000.00) in the Compromise Agreement;

4.Thus, the undersigned plaintiff respectfully manifests that they may be allowed
to enter into another Compromise Agreement with the defendant in the pursuit of
implementing the Board Resolution through its authorized representative JOSE
DELA CRUZ;

WHEREFORE, in view of the foregoing, plaintiffs humbly pray that may this
Manifestation be given due course.
Other just and equitable relief available in the premises is likewise prayed for.
