The Court-Appointed Mediator, Layn R. Phillips (Fmr. U.S. District Judge) hereby reports that

he held a mediation session in New York, New York, on August 19, 2019, in the ATS Actions. Except

as set forth below, counsel for all of the bellwether parties and representatives of Defendant Chiquita

attended in person, and all bellwether Plaintiffs and individual Defendants participated by telephone.

Attorney Paul Wolf and the Wolf bellwether Plaintiffs did not participate. See May 31, 2019 Order, ECF

No. 2470.

The mediation was unsuccessful. The mediating parties agree the Mediator should re-engage

with them following the Court’s ruling on pending motions.
