COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS

This compromise agreement is entered into this 23rd day of August 2019
by and between:

Yyyyyyyyyyyyyyyyyyyyyyyyyyyyy, of legal age, Filipino married,

and with postal address at popopopopopopopopopopopo, hereinafter referred
to as the Plaintiff;

-and-

Zzzzzzzzzzzzzzzzzzzzzzzzzzzzzzzzz, of legal age, Filipino, married,

and with postal address at Lolololololololololoolo, hereinafter referred to as
the Accused;

WITNESSETH:

WHEREAS, the Plaintiff has filed a criminal case for two (2) counts
of Violation of Pambansa Blg. 22 or Anti Bouncing Check Law against the
Accused now pending before Branch 35 of the Quezon City Metropolitan
Trial Court captioned as People of the Philippines vs. xxxxxxxxxxxxxxxxxxxx
and docketed as Crim. Case No. 123456789;

WHEREAS, the parties are desirous of settling amicably their pending

dispute and thereby put to rest a long and costly litigation;

NOW THEREFORE, in consideration of the foregoing premises, the

parties hereby undertake as follows:

 1. That the Accused admits and acknowledges to have issued Plaintiff
two (2) BDO checks with check nos. 0123584 dated August 1, 2016 and
0123585 dated August 15, 2016, respectively, subject of the above-captioned
case, in the amount of ONE MILLION PESOS (P1,000,000.00) per check or
in the total amount of TWO MILLION PESOS (P2,000,000.00).

2. That upon presentment for payment to the drawee bank, both checks
bounced for the reason – account closed.

3. That in order to buy peace, Plaintiff has agreed to accept from the
Accused the settlement amount of ONE MILLION SEVEN HUNDRED
FIFTY THOUSAND PESOS (P1,750,000.00) to be paid as follows:

a. One Hundred Thousand Pesos (P100,000.00) upon signing of this

agreement;
b. One Hundred Thousand Pesos (P100,000.00) payable on
September 23, 2019;
c. One Hundred Thousand Pesos (P100,000.00) payable on October
23, 2019;
d. One Hundred Fifty Thousand Pesos (P150,000.00) payable on
November 23, 2019;
e. One Hundred Fifty Thousand Pesos (P150,000.00) payable on
December 23, 2019;
f. One Hundred Fifty Thousand Pesos (P150,000.00) payable on
January 23, 2019;
g. One Hundred Fifty Thousand Pesos (P150,000.00) payable on
February 23, 2019;
h. One Hundred Fifty Thousand Pesos (P150,000.00) payable on
March 23, 2019;
i. Three Hundred Fifty Thousand Pesos (P350,000.00) payable on
April 23, 2019; and
j. Three Hundred Fifty Thousand Pesos (P350,000.00) payable on
May 23, 2019;

4. That the Accused shall issue Plaintiff ten (10) post-dated checks
representing the above-enumerated schedule of monthly payments;

5. That upon receipt by Plaintiff of the respective check payments from

the Accused, the former shall manifest before the Court where the case is
pending a Motion for Provisional Dismissal of the instant case with express
consent of the accused as a consequence of this agreement.

6. That the Accused understands and agrees that in case any of the check
payments shall bounce or otherwise denies Plaintiff encashment thereof by
the drawee bank, the subject case shall be revived without prejudice to all
other legal recourses that may be available at the time to the Plaintiff.

 IN WITNESS WHEREOF, the parties hereto have caused this
Compromise Agreement to be executed and duly delivered and effective as of
the date of the last party to sign this Compromise Agreement below.
