DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Sale made and executed by CELSO A. TINAYA of


legal age, Filipino, married and a resident of Bulak, Dauin, Negros Oriental,
Philippines, hereinafter referred to as the VENDOR;

- WITNESSETH –

That the VENDOR is the absolute owner of a Lot No. 397-D, Pls-
759 located at Bulak, Dauin, Negros Oriental, covered by TRANSFER
CERTIFICATE OF TITLE NO.103-2017000314 located at barrio of Bulak,
Dauin, Negros Oriental consisting an area of THREE HUNDRED SIXTY
(360) SQUARE METERS MORE OR LESS.

That for and in consideration of the sum of ONE HUNDRED FIFTY


THOUSAND PESOS (P 150,000.00) Philippine currency in hand paid to
me and receipt of which is hereby acknowledged to my entire satisfaction
from the Vendee SPOUSES ROMUALDO A. PINO & NOEMI D. PINO,
of legal ages, Filipinos, and a residents of 333 Capt. T. Amores Drive,
Pulantubig, Dumaguete City, Negros Oriental, I hereby by these presents,
SELL, TRANSFER AND CONVEY in a manner irrevocable and absolute
unto the said SPOUSES ROMUALDO A. PINO & NOEMI D. PINO,
their heirs, assigns and successors-in-interest the above described parcel of
land including the improvements free from liens and encumbrances,
consisting of THREE HUNDRED SIXTY (360) SQUARE METERS
MORE OR LESS .

That hereby certify and state that the afore-described parcel of land
is free from all liens and encumbrances and that I have the right or all the
qualifications and none of the disqualification to sell, transfer and convey
title thereof, and that I will defend the same against all claims of any kind
and all persons whoever regarding its ownership;

That the provisions of Articles 1621-1623 of the New Civil Code


referring to the right of redemption and pre-emption of the adjoining owners
had been duly complied with. The property involved in this sale is not
covered by the provisions of the Comprehensive Agrarian Reform Law, the
same falls within my retention limit and not being worked by a tenant.

AFFIDAVIT OF TRANSFEROR
I, CELSO A. TINAYA, of legal age, Filipino, widow and a resident of,
Philippines, after having been duly sworn to in accordance with law, hereby
depose and say:

That the land I sold to SPOUSES ROMUALDO A. PINO &


NOEMI D. PINO of legal ages , Filipinos, with residence and postal
address at 333 Capt. T. Amores Drive, Pulantubig, Dumaguete City, Negros
Oriental, Philippines with an area of THREE HUNDRED SIXTY (360)
SQUARE METERS under Doc. No. ___, Page No. ___, Book No. 34,
Series of 2019 of Notary Public ATTY. DOMINADOR B. UY, JR. on
September 07, 2019 is my retention area or a portion of my retention area
of not more than five (5) hectares.

That the subject property has no pending case at the DARAB, or any
of its adjudicators, the DAR, the Courts or at the Office of the President.

That this Affidavit is executed in compliance with DAR


Administrative Order No. 1, S-1989 as well as to show proof that the land
subject or above-mentioned transaction is a retention or portion of a
retention area.

We, SPOUSES ROMUALDO A. PINO & NOEMI D. PINO of legal
ages ,Filipinos, with residence and postal address at 333 Capt. T. Amores Drive,
Pulantubig, Dumaguete City, Negros Oriental, Philippines, after having been duly sworn
to in accordance with law, hereby depose and say:

That We are the BUYER/TRANSFEREE of a parcel of land, known as Lot No.


397-D, covered by TRANSFER CERTIFICATE OF TITLE NO.103-2017000314 situated
in Bulak,Dauin, Negros Oriental consisting an area of THREE HUNDRED SIXTY (360)
SQUARE METERS MORE OR LESS, by virtue of a document known as Deed of
Absolute Sale duly notarized by Atty. Dominador B. Uy, Jr. as Doc. No. ___; Page
No. ___; Book No. 34; Series of 2019.

That the above mentioned parcel of land is not tenanted nor cultivated by an
agricultural lessee in the concept of Land Reform;

That my total landholdings in the whole Philippines does not exceed five (5)
hectares;

That I execute this Affidavit to attest to the foregoing facts and in compliance
with the Department of Agrarian Reform ( DAR) Administrative Order No. 1, Series of
1989 as well as to show proof that land subject or above-mentioned transaction is a
retention or portion a retention area.
