Grievance Description:
Subject: Malpractices in National Horticulture Board: Legalize functioning between 2012
up to 7-6-2019: Re-register without mandatory documents.
Greetings,
Kindly refer to the all communications read with Societies Registration Act, 2012 &
it is confirmed by the NHB vide its letter dated 30-5-2019 that District Registrar
himself advised to accept documents without mandate provisions, without approved
resolution for re-registration before May 31, 2019, it’s not possible to get new
registration 03745 of 2019 as on 7-6-2019, behind May 31, 2019, if granted without
compliance then District Registrar is responsible, which may be recalled back,
declaring unlawful.
Hence, National Horticulture Board lost his status under Society Registration Act,
2012.

the HRRS (Amendment) Rules, 2018.
Kindly refer to the National Horticulture Board registration No. 1 of 1984-85 under
repealed Society Registration Act, 1860 but never applied for its re-validation under the
Haryana Registration and Regulation of Societies Act, 2012, which is exposed under RTI
Act, whereas CPIO of the National Horticulture Board concealed actual position, while
submitting their replies.
Matter was taken up as whistle blower with many Departments bearing References:

CAGAO/E/2019/01579,DOAAC/E/2019/00883, whereas every year Audited Reports, never
disclosed about the revalidation of the National Horticulture Board Registration No. 1 of
1984-85, keeping in view the legal provisions of the Haryana Registration and Regulation
of Societies Act, 2012.
1. Registration certificate under repealed Society Act, 1860 with last opportunity for re-
validation under the Haryana Registration and Regulation of Societies Act, 2012.
2. Matter taken up with many Departments including Comptroller & Auditor General of
India.
3. Communication made & received under RTI Act, 2005.
4. Nomination of Non official Member even after losing Registration of Society.
5. Audit Report: Never disclosed about re-validation of Registration of Society.
Hence:
1. Immediate legal steps required to safe guard the interest of public funds along with the
persons employed and beneficiaries, recalling Nominations back with apology, keeping in
view last date for renewal was May 31, 2019 as per Extension period for Renewal of
Societies under Rule 8, sub-rule (1) of the HRRS (Amendment) Rules, 2018.
2. Exposing black sheep’s of the system, holding them responsible.
3. Regularizing the budget provisions, keeping in view the utilizations of funds disbursed to
an un-registered Society after 2012 on-wards till date.

Kind attention: Registrar General along with the Secretary of the Ministry:
Subject: Appointment of Administrator to control over National Horticulture Board (NHB).
It is humbly submitted that:
1. National Horticulture Board (NHB) was set up by Government of India in April 1984 on the
basis of recommendations of the Group on Perishable Agricultural Commodities, headed by Dr M.
S. Swaminathan, the then Member (Agriculture), Planning Commission, Government of India. The
NHB is registered as a Society under the Societies Registration Act 1860, with its headquarters at
Gurugram.
2. As per section 92(1) of the Haryana Registration and Regulation of Societies Act, 2012: The
Societies Registration Act, 1860, in its application to the territorial jurisdiction of the State of
Haryana is hereby repealed.
3. As per the Haryana Registration and Regulation of Societies (Amendment) Rules, 2018 (1) Every
existing Society shall apply to the District Registrar for allotment of a new registration number in
Form-VI within a period of two years from the date of coming into force of the Act without any fee
or within next fifty seven months and three days i.e. up to the 31st December, 2018 on payment of
fee set out in the Schedule of fees contained in Appendix-I in terms of provisions contained in sub-
section (4) of section 9 of the Act. The Society shall file application and submit the requisite
documents along with a certificate from the office bearer duly authorized by the Governing Body to
the effect that the Memorandum and the Bye-laws of the Society, as being presented before the
District Registrar, conform to the provisions of the Act and the rules made there under.
Hence:
1. Administrator along with Committee to assist Administrator may kindly be appointed at once to
safe guard the movable & immovable assets along with the day today functioning of the National
Horticulture Board, keeping in view the agreements executed by the previous Body registered
under the repealed Act, 1860.
2. Proper handling of the pending Court cases on behalf of the previous Society, which was
registered under the repealed Act, 1860.
3. Proper handling of the Income Tax Department along with the pay perks with other service
benefits to the officials of the National Horticulture Board.
As per Ex- Officio mechanism, all functioning of the National Horticulture Board, was handled,
please look in to this facts as well without election of the said office bearers.

Kind attention: National Biodiversity Authority along with Haryana State Biodiversity Board.
Subject: Guidelines on Access to Biological Resources and Associated Knowledge and Benefits
Sharing Regulations, 2014 be implement on the National Horticulture Board (NHB).
It is humbly submitted that:
1. National Horticulture Board (NHB) was set up by Government of India in April 1984 on the
basis of recommendations of the Group on Perishable Agricultural Commodities, headed by Dr M.
S. Swaminathan, the then Member (Agriculture), Planning Commission, Government of India. The
NHB is registered as a Society under the Societies Registration Act 1860, with its headquarters at
Gurugram.
2. As per section 92(1) of the Haryana Registration and Regulation of Societies Act, 2012: The
Societies Registration Act, 1860, in its application to the territorial jurisdiction of the State of
Haryana is hereby repealed.

2004, keeping in view the functioning of the National Horticulture Board.
2. Immediate establishment of the Biodiversity Management Committee along with the Peoples
Biodiversity Registers all around in Haryana.
3. The National Biodiversity Authority may direct State Biodiversity Board to take immediate
cognizance, to resolve the issue.

Remarks:
Since, the subject matter of the public grievances is related to National Biodiversity Authority
(NBA), the same was transferred to NBA with a request to give appropriate response at the earliest.

National Horticulture Board lost its registration under Society Registration Act, 1860 being
repealed in 2012, last opportunity to get renewal was extended up to December 31, 2018, keeping in
view, previous section authorised NHB to introduce rules & regulations as per xxxii: To make rules
and bye-laws for the conduct of the affairs of the Society, and add, amended or vary the same from
time to time, but subject always to the approval of the Central Government, whereas Govt. of India
have No power & authority to introduce attached rules & regulations, besides it all decisions taken
on the attached rules & regulations are not valid, lost their legality.
Please find attached here with the copies of rules & regulations, which has lost legality on wards
2012, as & when Society Registration Act, 1860 was repealed, hence over all functioning of the NHB
unlawful & illegal.
Scouts & Guides for Animals & Birds along with United Nation affiliated OIPA: Indian People for
Animals comes forward to take charge on the National Horticulture Board, to regulate its day
today functions, in the interest of public, to safe guard the public funds.

Kind attention: Comptroller & Auditor General of India, to look in to, under which influence, NHB
legal status never been disclosed being lost their registration under Society Registration Act, 1860,
which was repealed in 2012, there was No audit para besides it rules & regulations have No legality
being introduced by the Government of India instead introduced by the NHB.

Horticulture Board along with complete Noting Sheets including as per given below:

1. Please supply me the all copies of resolution passed, addition, omissions, amendments in the
Memorandum of Association duly authenticated by the Registrar of Firms & Societies along with
relevant Noting Sheets.
2. As per section 92(1) of the Haryana Registration and Regulation of Societies Act, 2012: The
Societies Registration Act, 1860, in its application to the territorial jurisdiction of the State of
Haryana is hereby repealed.
Please supply me all communication made & received related to renewal of Registration No. 1 of
1984-85 with present status of registration & renewal.
3. All communications made & received, related to existence of National Horticulture Board
without any legal registration certificate - status, status of agreements, Bank accounts, funds
sanctioned - disbursement, legal matters etc.
4. Legal registration, litigation in the court of law, Income Tax Department, Registration with
Provident Fund, all license of export - Import became unlawful & illegal being unregistered body,
supply me all relevant information.
5. Please supply me copies of rules & regulations, authorized Ex officio office bearers of the Society,
instead election which was registered under repealed Act 1860.
6. Please supply me copies of all resolutions related to elections along with compliance report
related to Memorandum of Association, Rules & regulations.
7. Please supply me complete information related to officials, post sanctioned - retirement
mechanism with the details of service conditions of all employees.
8. Complete details about funds received, disbursed head wise since beginning to till date.
9. Complete details about the action taken on the defaulters with the head wise details to the
beneficiaries along with the status reports on their proper utilization of funds disbursed.
10. Complete details of movable - immovable assets, property & head wise investments.
11. Complete details & status reports on the complaints lodged against National Horticulture Board
along with complete details about the merging of other Boards with the copies of resolutions passed
related to dissolution, resolutions passed for their merging with approval of Registrar of Firms &
Societies.
