JOINT CONFIRMATION OF SALE and DONATION

We, FRANCISCA ALMIÑE GUADALQUIVER, of legal age, Filipino, married and a

resident of Prk. Malinawon, Brgy. Maag, San Isidro, Davao Oriental, NESTOR P. PONDIAS,
SR., of legal age, Filipino, and a resident of Brgy. Maputi, San Isidro, Davao Oriental, and
JUANITA PEÑARANDA TALINGTING, likewise, of legal age, Filipino, married and a
resident of Brgy. Maputi, San Isidro, having been duly sworn to in accordance with law,
hereby depose and say: That

1. We, FRANCISCA ALMIÑE GUADALQUIVER, one of the children of the

deceased CORNELIO ALMEÑE, JUANITA PEÑARANDA TALINGTING, one of the children
of the deceased VICTORIO PEÑARANDA, and NESTOR P. PONDIAS, SR., presently the
Punong Barangay of Barangay Maputi San Isidro, have personal knowledge surrounding
the existence of two contracts, the first contract being a sale and thereafter a donation,
involving the same parcel of land originally owned by CORNELIO ALMEÑE, more
particularly described as follows:

A parcel of unregistered land identified as Lot No. 2354, CAD-1005-D, situated in

Brgy. Maputi, San Isidro, Davao Oriental, containing an area of THIRTEEN
THOUSAND NINE HUNDRED FIFTY THREE (13,953) SQUARE METERS, more or
less, covered by TD/ARP No. 10-0011-00135, and having the following boundaries,
to wit: Bounded on the North by Lot No. 35; on the South by Lot Nos.
03,04,05,06,07,08,09,10; on the East by Lot 006; and on the West by Lot 004 as
described in the said Tax Declaration of Real Property hereto attached.

2. Based on our personal knowledge, sometime in the year 1965, CORNELIO

ALMEÑE, (father of FRANCISCA ALMIÑE GUADALQUIVER) sold the abovementioned
property to the late VICTORIO PEÑARANDA (father of JUANITA PEÑARANDA
TALINGTING), for a valuable consideration but because of the scarcity of a notary public
during those times, the sale was not put into writing, but the whole of amount of
consideration was wholly received by the seller, CORNELIO ALMEÑE and affirmed and
confirmed by the whole family.

3. After handing over the amount so agreed, VICTOR PEÑARANDA, thereafter,

took possession of the said property and immediately introduced improvements thereon for
almost two (2) years.

4. In 1967 when Barangay Maputi, still part of the Municipality of Governor

Generoso, was in need of a site for the elementary school to be established by the then
MINISTRY OF EDUCATION CULTURE AND SPORTS (MECS) now DEPARTMENT OF
EDUCATION (DepEd), VICTOR PEÑARANDA, readily accepted the challenge, and offered
to donate the property which he bought from CORNELIO ALMEÑE – the same property
being described in paragraph 1 above.

5. While there was no question that the donation had indeed transpired,
executed and accepted by the MECS, the Deed of Donation affecting the title of the
abovementioned parcel of land was, for two succeeding times, not reduced into writing,
although the MECS through the School Principal later sent a letter to the DONOR VICTOR
PEÑARANDA accepting the said donation and likewise thanked him for his generosity in
giving his land for the school;

6. We attest that the foregoing facts indeed transpired, and that we have
personal knowledge to support its existence as we were around when those transactions
were negotiated, accepted and then ultimately perfected by the mentioned parties, being

NESTOR P. PONDIAS, SR)

7. We caused the execution of this instrument to attest and to apprise the

concerned agency of the truth of the foregoing facts in support of the claim of ownership by
the Department of Education through Jose P. Laurel Sr. Elementary School, Brgy. Maputi,
San Isidro, Davao Oriental to the herein described property.
