COMPLAINT
Plaintiff Puff Corporation (“Puffco” or “Plaintiff”) hereby states its complaint
against Focus V LLC (“Focus V” or “Defendant”) for trade dress infringement, false
designation of origin, false advertising, and unfair and deceptive trade practices in
violation of the Lanham Act, 15 U.S.C. § 1125(a), and N. C. Gen. Stat. § 75-1.1 et seq.
THE PARTIES
1. Plaintiff Puffco is a Delaware Corporation with its principal place of business at
1201 West 5th Street, Suite T-530, Los Angeles, California 90017. Puffco manufactures,
advertises, distributes and sells various types of electronic vaporizers throughout the
United States, including to consumers physically residing in the state of North Carolina
and this District.
2. Upon information and belief, Defendant Focus V is a Nevada Limited Liability
Company with a principal place of business at 2663 S. Lindell Road, Las Vegas, Nevada

89146, (the address of two Managers of the LLC provided to the Nevada Secretary of
State), or at 6419 Eldora Ave, Las Vegas, Nevada 89146, (the mailing address listed on
its webpage: https://focusvproducts.com/pages/privacy-policy). The registered agent for
Focus V is Rocket Lawyer Corporate Services, LLC located at 318 N. Carson Street
#208, Carson City, Nevada 89701.
3. Upon information and belief, Defendant also manufactures, advertises, distributes,
and sells various types of electronic vaporizers throughout the United States, including to
consumers physically residing in the state of North Carolina and this District. By way of
example only, Defendant’s products, including the accused products, have been and are
sold in this judicial district at Smokey Shays.
4. Upon information and belief, Defendant operates an interactive website at
https://focusvproducts.com/, which displays the infringing trade dress, promotes the
infringing products, publishes the false advertising claims, and allows Internet users to
purchase Defendant’s infringing products, and this website is directed to and accessible
by customers in North Carolina and this District. See Exhibit 1, Screen print out of
https://focusvproducts.com/.
JURISDICTION AND VENUE
5. This Court has original subject matter jurisdiction over Plaintiff’s federal claims in
this action pursuant to Section 39 of the Lanham Act, 15 § U.S.C. § 1121, and 28 U.S.C.
§§ 1331 and 1338. This court has supplemental jurisdiction over Plaintiff’s related state
law claims pursuant to 28 U.S.C. §§ 1338 and 1367.

6. This Court has personal jurisdiction over Defendant because, upon information
and belief, (a) Defendant has committed acts of trade dress infringement in the State of
North Carolina and this judicial district, and Plaintiff’s claims arise out of such acts; (b)
Defendant’s products which infringe Plaintiff’s trade dress are available for purchase in
the State of North Carolina and this judicial district, (c) Defendant regularly conducts
business in the State of North Carolina and this judicial district; and (d) Defendant has
otherwise made or established contacts in the State of North Carolina and this judicial
district sufficient to permit the exercise of personal jurisdiction. By way of example
only, Defendant’s products, including the accused products, have been and are sold in
this judicial district at Smokey Shays.
7. Venue is proper in this judicial district pursuant to 28 U.S.C. §§ 1391 and 1400.
FACTUAL BACKGROUND
A. Puffco’s PEAK® Vaporizer Trade Dress
8. Puffco, founded in 2013, is an award winning manufacturer of a variety of
electronic vaporizer products. Since the company’s launch in 2013, Puffco has become
one of the most well-known brands in the electronic vaporizer industry. One of Puffco’s
most successful products is the PEAK® vaporizer.
9. Puffco invested significantly in the development of the overall design and
appearance of its PEAK® vaporizer with the desire to create an electronic vaporizer that
was unique in the industry and instantly recognizable by consumers due to its sleek,
futuristic design.

10. To distinguish Puffco’s PEAK® vaporizer from other brands of vaporizers on the
market, Puffco adopted a unique, distinctive, and non-functional trade dress which
includes both the overall design and shape of the product as well as the uniquely shaped
glass top. The features of the PEAK® Trade Dress are depicted in detail Exhibits 2 and 3
but can be more generally, and non-exhaustively described, as follows:
 Triangular design with the base of the device being larger in diameter than the
top of the device.
 A glass top, also in the shape of a triangle, which is transparent showing the
internal compartments of the water filtration system.
 Circular shaped detachable base with a thin band of LED lighting appearing as
a diagonal line across the center of the base.
 An atomizer bucket which extends upwardly from the center of the device in a
semi-circle shape.
11. All of the features described above and the overall shape of the PEAK® vaporizer
were adopted for the purpose of aesthetics and are not functionally essential to the
devices intended use or purpose.
12. The non-functional design of the glass top is the subject of a design patent
application which Puffco filed on November 11, 2018. See Exhibit 2, which is a copy of
the filing receipt for U.S. Patent Application No. 29/669,756.

13. The non-functional overall design of the PEAK® vaporizer is the subject of a
design patent application which Puffco filed on November 11, 2018. See Exhibit 3, which
is a copy of the filing receipt for U.S. Patent Application No. 29/669,755.
14. Competitors are not at a significant non-reputation related disadvantage by
Puffco’s exclusive use of the PEAK® Trade Dress as is evident from the existing
electronic vaporizers currently on the market which utilize alternative designs both in
terms of differences in overall appearance and differences in the shape of the top of the
vaporizers. See Exhibit 4, screen print outs showing competitive products with alternative
design features.
15. Since its launch on or about January 2018, the PEAK® vaporizer and its
associated Trade Dress quickly gained the attention of the media, and the relevant
consumers, and has since been the subject of a number of unsolicited third party media
reports, including, among others, where the PEAK® vaporizer was referred to as “the
future of dabbing” and “the first ever smart-rig.” See Exhibit 5, examples of third party
media coverage of the PEAK® vaporizer.
16. Numerous news media sources, in reporting on the launch of the PEAK®
vaporizer, discuss the overall design and appearance of the PEAK® vaporizer as being
unique and/or memorable. See Exhibit 6, additional examples of third party media
coverage of the PEAK® vaporizer.
17. Since its launch on or about January 2018, Puffco has invested significant
amounts of money and substantial effort in the nationwide advertising and promotion of

its PEAK® vaporizer which has resulted in great commercial success and widespread
consumer recognition of the PEAK® Trade Dress as an indicator of source.
18. Since its launch on or about January 2018, Puffco has sold in excess of 60,000
PEAK® vaporizers resulting in estimated aggregate sales revenue of more than $20
million dollars.
19. Puffco’s PEAK® vaporizer has been continuously sold in U.S. commerce
nationwide directly from Puffco’s online retail store, as well as, through third party
retailers who distribute the products through online retail stores and in physical retail
locations.
20. As a direct result of Puffco’s continuous, wide spread use of the PEAK® Trade
Dress in connection with its electronic vaporizer, extensive advertising, promotion, and
extensive sales of the product under the PEAK® Trade Dress, the relevant consuming
public has come to recognize the PEAK® Trade Dress as identifying Puffco as the source
of the goods.
21. The PEAK® Trade Dress has developed primary significance in the minds of the
public as identifying Puffco as the source of the PEAK® vaporizer, rather than
identifying the product itself.
22. Thus, the PEAK® Trade Dress has acquired valuable goodwill, recognition, and
secondary meaning among the relevant consumers.

B. Defendant’s Infringing Product Design
23. Upon information and belief, sometime between April and July of 2019,
Defendant began marketing, promoting, manufacturing and selling the Carta Erig (the
“Infringing Product Design”), which is an electronic vaporizer for use with dry herbs and
concentrates.
24. Upon information and belief, Defendant manufactured and sold, and continues to
manufacture and sell, among other variations, the Carta Erig which copies features of,
and is confusingly similar in appearance to, Puffco’s PEAK® Trade Dress, and therefore
is likely to deceive or confuse the purchasing public as to the source or origin of
Defendant’s products.
25. Upon information and belief, the Defendant was aware of Plaintiff’s PEAK®
vaporizer and its associated Trade Dress and goodwill associated therewith at the time it
adopted and began use of the Infringing Product Design.
26. Upon information and belief, the Defendant intentionally and directly copied a
number of distinctive, non-functional features from Plaintiff’s PEAK® Trade Dress
intending capitalize on the popularity of, and demand for, Puffco’s PEAK® vaporizer. A
side by side comparison is illustrative of the similarities:

Carta Erig Puffco Peak
27. In addition to the Defendant’s Carta Erig having a similar overall appearance and
commercial impression as that of Puffco’s PEAK®, the following is a summary of some
of the distinctive, non-functional features which infringe Puffco’s PEAK® Trade Dress:
 Triangular design with the base of the device being larger in diameter than the
top of the device.
 Includes a glass top, also in the shape of a triangle, which is transparent
showing the internal compartments of the water filtration system.

 Circular shaped detachable base with a thin a diagonal line appearing across
the center of the base.
 LED lights displayed as small circles along a diagonal line across the center of
the base.
 An atomizer bucket which extends upwardly from the center of the device in a
semi-circle shape.
The features described above and overall design depicted in the image of the Carta Erig
above, are collectively referred to as the “Infringing Product Design.”
28. A number of features of the Infringing Product Design of Defendant’s Carta Erig
are substantially and confusingly similar to a number of the non-functional, distinctive
features of the PEAK® vaporizer and as a result the overall appearance and commercial
impression of the Carta Erig is confusingly similar to the overall appearance and
commercial impression of Puffco’s PEAK® Trade Dress.
29. Defendant is not authorized or licensed to distribute, market, or sell any products
incorporating or using the PEAK® Trade Dress or any confusingly similar variation
thereof.
30. Defendant is a direct competitor of Puffco and the PEAK® vaporizer and Carta
Erig are sold by at least a few of the same online retailers. See Exhibit 7, examples of
third party retailers currently offering both the PEAK® vaporizer and the Carta Erig.
31. Defendant’s Carta Erig and Puffco’s PEAK® vaporizer are marketed and sold to
the same consumers.

32. Defendant’s marketing, sale, promotion, and use of the Infringing Design is likely
to cause retailers and consumers to be confused or deceived or mistakenly believe that
Defendant’s Infringing Product Design is made, sponsored, endorsed, authorized by, or in
some other manner affiliated with Puffco, which it is not. This is especially harmful to
Puffco with respect to those consumers who perceive a defect or lack of quality as being
attributed to the Puffco instead of to the Defendant.
33. Thus, the likelihood of mistake, confusion, and deception caused by the
Defendant’s use of the Infringing Product Design has caused and will cause in the future,
irreparable harm to the goodwill symbolized by the PEAK® Trade Dress and the
reputation it embodies.
34. The forgoing activities by Defendant have caused and will continue to cause
Puffco to suffer damages, including but not limited to lost sales, lost profits, and damaged
goodwill.
CAUSES OF ACTION
COUNT I-TRADE DRESS INFRINGEMENT UNDER SECTION 32 OF THE

LANHAM ACT (15 U.S.C. §1125(a))
35. Puffco repeats and realleges each of the allegations above as if fully set forth
herein.
36. Puffco is the owner of the PEAK® Trade Dress, which is protectable at law,
under the Lanham Act. The PEAK® Trade Dress is primarily non-functional, highly
distinctive, and has become widely associated to the relevant consumers as identifying a
single source of the electronic vaporizer, namely, Puffco.

37. The PEAK® Trade Dress is primarily non-functional as evidenced by Puffco’s
pending design patent applications that cover ornamental – and by extension, non-
functional – elements of the PEAK® Trade Dress. See Exhibits 2-3.
38. The PEAK® Trade Dress has acquired secondary meaning by virtue of its
extensive promotion, media attention, and widespread, nationwide, commercial sales in
excess of 60,000 units generating aggregate revenue of more than $20 million.
39. The PEAK® Trade Dress acquired secondary meaning before the defendant
adopted and began use of the Infringing Product Design. Additionally, upon information
and belief, Defendant intentionally copied the PEAK ® Trade Dress, which created a
presumption of secondary meaning.
40. Defendant’s Carta Erig and Plaintiff’s PEAK® vaporizer are highly similar if not
substantially identical in light of both being, generally, electronic vaporizers for use in
connection with personal inhalation of concentrates and dry herbs, the products are also
similar in size and weight.
41. The Defendant’s Carta Erig and Puffco’s PEAK® vaporizers are marketed and
sold to the same consumers and travel in the same channels of trade.
42. Defendant’s acts of distributing, marketing, and selling its Carta Erig designed in
a way that is confusingly similar to Plaintiff’s PEAK® Trade Dress constitutes unfair
competition, false designation of origin and false descriptive of fact that is likely to cause
consumers to be confused as to the source, affiliation, connection, association, or

approval of Defendant or Defendant’s goods in violation of the Lanham Act, 15 U.S.C. §
1125(a).
43. Upon information and belief, the Defendant’s activities described above have
been willful and in deliberate disregard of Plaintiff’s trade dress rights, and for the
purpose of intentionally misappropriating and capitalizing off of Plaintiff’s goodwill.
44. Defendant’s acts are exceptional within the meaning of 15 U.S.C. § 1117.
45. As a direct and proximate result of Defendant’s unlawful conduct and willful
infringement, Plaintiff has suffered and will continue to suffer, damage to its valuable
brand, and other damages in an amount to be proved at trial, including Defendant’s
profits and Plaintiff’s lost profits.
46. Plaintiff Puffco has no adequate remedy at law and will continue to suffer
irreparable harm and injury to its good will and reputation if the Defendant’s activities
are not enjoined.
COUNT II-VIOLATION OF THE UNFAIR COMPETITION AND DECEPTIVE

TRADE PRACTICES ACT UNDER NORTH CAROLINA LAW
47. Puffco repeats and realleges each of the allegations above as if fully set forth
herein.
48. Defendant’s adoption and use of the Infringing Product Design is likely to cause
consumer confusion, deception, or mistake as to the source, affiliation, connection,
association, or approval of Defendant or Defendant’s products.

49. Defendant’s conduct alleged above constitutes unfair methods of competition and
unfair or deceptive acts or practices in or affecting North Carolina commerce, as defined
by N.C. Gen. Stat. §75-1.1.
50. As a direct and proximate result of Defendant’s conduct, Plaintiff has suffered
and will continue to suffer pecuniary damages, including, but not limited to, losses and
damages in an amount to be determined at trial.
51. Defendant’s conduct justifies an award of treble damages pursuant to N.C. Gen.
Stat. § 75.16.
52. The damage suffered by Plaintiff as a result of Defendant’s conduct is, and will
be, irreparable leaving Plaintiff without an adequate remedy at law and entitling Plaintiff
to preliminary and permanent injunctive relief.
53. Defendant willfully engaged in the acts and practices alleged in this complaint
entitling Plaintiff to recover its attorneys fees from Defendant under N.C. Gen. Stat. § 75-
16.1(1).
PRAYER
WHEREFORE, Puffco prays for judgment against Focus V as follows:
(1) That the Court preliminary and permanently enjoin defendant Focus V and/or
their respective employees, officers, directors, agents, representatives, attorneys,
successors, and assigns, and all persons in active concert or participation with any
of them, from using the PEAK® Trade Dress, and/or any confusingly similar
variations thereof, in any manner or form, or any other reproduction, counterfeit,

copy, or colorable imitation of such trade dress, either alone or in combination
with any other designation, on or in connection with any advertising, marketing,
promoting, offer for sale, or sale of Defendant’s goods; and from otherwise
infringing the distinctive nature of Puffco’s PEAK® Trade Dress; and from
otherwise competing unfairly with Puffco;
(2) That the Court order Focus V to destroy and/or obliterate any
and all electronic vaporizers which reflect the Infringing Product Design,
including and not limited to the Carta Erig, any signs, brochures, advertisements,
and other items in their possession, or under their control, upon which appear or
reflect any of Puffco’s PEAK® Trade Dress and/or any confusingly similar
variations thereof, in any manner or form, or any other reproduction, counterfeit,
copy, or colorable imitation of Puffco’s PEAK® Trade Dress either alone or in
combination with any designation, and all molds, matrices and other means of
making the same;
(3) That the Court order Focus V to pay Puffco its costs and
expenses incurred in and related to this action;
(4) That the court order Focus V to account for and pay to Puffco all
profits realized by Focus V as a direct and proximate cause of Focus V’s unlawful
conduct;
(5) That Puffco recover any actual damages suffered as a direct and
proximate cause of Focus V’s unlawful conduct;

(6) That the Court order Focus V to pay to Puffco’s attorneys’ fees;
and
(7) That the Court award such other and further relief as the Court
deems just and proper under the circumstances.

ELECTRONIC VAPORIZER, of which the following is a specification, reference being
had to the following drawings, forming a part hereof.

Be it known that we, Roger VOLODARSKY, Avi BAJPAI and Roger SAYRE,
have invented a certain new, original and ornamental design for a ELECTRONIC
VAPORIZER, of which the following is a specification, reference being had to the
following drawings, forming a part hereof.

Build Quality
When it comes to build quality, the Switch is one of the best vaporizers. It is relatively large and heavy,
but very stable. The 50 mil mouthpiece is made out of glass and located right on top of the unit. The
mouthpiece might be quite huge, but it feels very stable sitting on top of the base. The vaporizer heats
up using two induction cups made of titanium. The cups are covered with a heavy duty ceramic. One is
white, and it’s meant to be used on concentrates, and the other one is black for dry herb.
Induction Heating
Induction heating is the best heating method compared to conduction and convection. This is because
it uses an electromagnetic coil to heat up the dry herb and concentrates. Induction heating heats up
the coil from inside out instead of outside in. One of the main advantages of induction heating method
is that it is faster compared to other heating methods, while still reaching the perfect, wax-friendly high
temperatures.
Vapor Quality
With concentrates, the Switch is de nitely at the top of the line. The incredibly fast heat up time, dense
avor and large hits will leave any user impressed. The vaporizer does an awesome job of ltering and
cooling the hit before it gets into your lungs. The unit is also equally good with the dry herb though it
requires some ne tuning. This is because the current power settings are either too high or too low
which may result in a chattered or mild taste.

blowtorch. Aka, users often turn their marijuana consumption into a chemistry project, and

intimidated, less habitual weed smokers typically stick to classic bongs. The Peak changes
that by giving smokers a wireless way to consume concentrated cannabis with four different
heat settings and the click of a button. According to Engadget, each charge provides about
25 to 30 hits, which is more than enough to guarantee you and your buddies will get high as
hell.
The Peak will be available for preorder on Puffco’s site Jan. 15, shipping out in early
February. These smart bongs are expected to sell for $350 each.

If Apple Were to Design a Bong, This Is What It Would Look Like

Puffco, a Brooklyn-based vaporizer startup, was one of only two marijuana companies to debut at CES this year. Now its
high-tech smoking device is being hailed the Keurig of cannabis.

At CES in January, amid the robotic armoire that folds clothing and the suitcase that doubles as a go-kart, there were
only two cannabis companies. Vapium, a Canadian manufacturer, was there to debut its new medical marijuana
vaporizer. The other company, Puffco, had spent the prior two years rebuilding itself from the brink of failure. Its
founder, Roger Volodarsky, had not only managed to resurrect his Brooklyn-based startup, but his team would be
unveiling what they believe to be cannabis tech's biggest breakthrough yet: a "smart" bong.
CES denied Puffco a booth, Volodarsky says, but that wasn't going to stop him from his company's coming out party.
The 34-year-old ew to Vegas and booked a suite at the Mirage Hotel overlooking the Strip. The night before CES
started, during a media event for tech companies to demo their gadgets for journalists, he revealed the Puffco Peak, a
high-end electric water pipe for vaporizing THC concentrates. At the after-party in his 28th- oor suite, Volodarsky then
hosted a live demo with a smaller group of reporters, leading to rave reviews everywhere from Engadget to CNET.
CNET described the Peak's functionality as "easy to work as a Keurig coffee maker" and noted that Puffco "ambitiously
domesticated the dab rig through re ned design." It was hardly faint praise, considering dab rigs (a particular type of
bong used to vaporize a potent, sticky marijuana extract that contains THC) typically resembles an oversize crack pipe.
Among Puffco's other high-tech tweaks, the Peak managed to redesign the most unsavory part of the smoking
device's user interface: Instead of requiring an actual blowtorch to heat it (like the ones chefs use on a creme brulee),
the Peak is activated by a simple double click of a button. By the end of the massive Vegas trade show, the Peak was
nominated for the "most unexpected" tech product to debut, according to Engadget.
The competition in the vape tech industry is cutthroat. At the top of the food chain are the originators of innovative

cannabis vaporizers like Pax, founded by two Stanford grads; Fire y, founded by a former Apple designer; and the
Volcano, created by a graphic designer and civil engineer from Germany. At the bottom end, there are counterfeiters and
rip-off artists who buy other companies' products, ask factories in China to make a few tweaks to the branding, resulting
in low-cost vaporizers. Somewhere in the middle is Puffco, a small hardware startup that has had to ght for space and
recognition.
Volodarsky, a Coney Island native, isn't your typical cannabis startup founder. With sleeve-length tattoos and the ability
to smoke any self-respecting cannabis a cionado under the table, he doesn't bother portraying a squeaky clean image.
(In 2012, he was arrested for marijuana possession in Fort Lee, New Jersey.) He also didn't set out to raise a bunch of
money like other green rush entrepreneurs. Instead, in 2013, Volodarsky bootstrapped Puffco after being disappointed

with the existing vape pens on the market. Since then, he's had one simple vision: To make the indiscreet act of dabbing
more socially acceptable through smarter technology and great design.
His company didn't start gaining traction until 2015, when Volodarsky launched the Puffco Pro, a small pen-size
vaporizer made to consume concentrates on the go. That summer, the Pro won one of the industry's highest honors--
the best portable concentrate pen vaporizer at the High Times Cannabis Cup. Suddenly Puffco was on the map, and
orders were ying in.
In 2016, from Puffco's former headquarters in a Brooklyn basement, Volodarksy and his team of two engineers and
industrial designers came up with a new product, the Puffco Plus. The vape pen, which features a ceramic bowl, went
on to win a string of awards from High Times. But Puffco's success and attention came with increased competition and
supply chain issues.
The commercial launch of the Plus faltered because the rst 2,000 units delivered from its factory in Shenzen, China,
were defective. A competitor seized the moment, and posted on social media that all Puffco customers were welcome
to send them their broken Puffcos, in return, receiving a free vape from their brand. To make matters worse, Puffco's
factory in Shenzhen then went out of business.
The prior year, Puffco had made $5 million in sales, but now it had zero product to sell and hundreds of angry
customers. For the rst three quarters of 2016, Puffco stayed a oat by selling replacement parts to existing customers.
Without a functioning product and no factory, Volodarsky decided to discontinue his products and y to Shenzhen to try
and build a new supply chain.

"We were on the brink of failure and didn't know how to become a well-oiled consumer product company," says
Volodarsky.
Volodarsky decided to build a supply chain that was purposely fragmented, to make it harder for competitors to steal
his partners. "We did it with boots on the ground. We visited every assembly house and manufacturing partner in
Shenzhen," he says. He also worked with his lawyer to write stronger contracts with manufacturers to stem
counterfeiters. With the supply chain in place, Puffco started taking new orders by November; during the last 60 days of
2016, the startup brought in more money than they had the prior year.
While the experience was challenging, it also helped Volodarsky refocus his priorities on the one thing competitors
couldn't commoditize: great design. He decided to channel all the company's resources to what he believed was his
secret sauce--a killer in-house engineering and design team, led by Avi Bajpai, the former senior design engineer at Ben
Kaufman's Quirky. "Innovation grows old fast, so you only have one option--make products that are hard to copy," says
Volodarsky.
For one year, Volodarsky and Bajpai had a singular focus--creating a smart dab rig that did not require a blowtorch and
wasn't embarrassing to leave on the coffee table. If the dab rig was ever going to make it to the mass market, it would
have to look more like an Apple product than something t for a college dorm. The result was the Peak, a sleek electric
bong that uses "intelligent" temperature calibration to heat up in 20 seconds. The Peak retails from $379.99 on
Puffco's website.
Puffco's next big move will be a literal one, across the country to a new headquarters in Los Angeles. Volodarsky says
California, which just legalized adult-use sales in January, will be a more welcoming business environment for a weed
tech company. New York has a strict medical program that allows only edibles, tinctures, and pre- lled vape pens.
Patients in New York could not legally buy THC concentrates and use Puffco's products.
"It's going to be hard to leave New York, but I sacri ced a lot, all of us at Puffco sacri ced a lot," says Volodarsky,
explaining that there was, and still is, a level of risk running a cannabis-related business in certain states. "There weren't
many believers, or supporters, when we started."

The Puffco Peak and other high-tech tools help legal
marijuana flourish in the face of mainstream
apprehension.

Every year when I attend the annual CES technology trade show, held
each January in Las Vegas, I expect to see plenty of the "unexpected."
TVs that curl like snakes, potentially life-saving health tech, talking
toilets, maybe a cool dog-robot.
But what I didn't anticipate was leaving Las Vegas most impressed by a
slick, high-tech space-vape that looked like something the First Order
would smoke out of (if it had one ounce of chill).
Despite being held in "Sin City," where legalized recreational marijuana

sales started six months ago, CES 2018 was practically a desert for

consumer cannabis tech, unless you went out of your way to find it.
However, the few companies that made it to the biggest tech trade show
optimistically shed a small light on the cannabis-centered tech thriving in
the margins of the mainstream, patiently waiting in the wings for
consumers to wake up and smell the weed.

Puffco made an impression with the Peak, and inspired a timely
conversation about the complex public place a concentrate vaporizer
occupies at a tech trade show that's caught in the desert crosshairs of
federal prohibition and the swiftly developing marijuana industry
emerging in Nevada following local legalization.
Peak is the first "smart rig," or at least that's what Puffco is calling it. The
creative minds behind the company's award-winning vaporizer pens
pivoted to transforming a previously cumbersome (and sometimes
dangerous) process into a sleek and streamlined experience.

It's as easy to work as a Keurig coffee maker. Simply add water, load the
ceramic bowl with the concentrate then cover with the cap, press the
(only) button, wait 20 seconds, then inhale from the narrow end of the

lava lamp-shaped tube. It has four heat settings that automatically adjust
and calibrate for consistent results every draw.
The desktop vaporizer successfully combines elements of existing dab

rigs; it's electric, cordless, fully charging via micro-USB in about two
hours, and uses water-filtration which helps cool down the smoke.
Peak popularity
The Puffco Peak would look out of place in a typical headshop. Looking
more like a "Tron" movie prop with a delicately slim and subtly accenting
LED light band around its base, it'd fit in more on the brutalist coffee
table of a swanky stoner cafe or an indie magazine editor's home shelf.
The only thing that could make it any cooler is if Kendrick Lamar
produced a soundtrack for it.
As a safer, streamlined and state-of-the-art way to consume cannabis

concentrates, Puffco ambitiously domesticated the dab rig through
refined design and is now taking reservations for anyone interested in
buying the Peak. Official pricing hasn't been announced, but it's
expected to be around $350-$400.
Legal but not equal

In Nevada, legal cannabis consumption is only allowed on private
property, and, because the gaming industry is regulated by federal law,
tourists shouldn't even think about sparking up on a casino floor.
Las Vegas currently doesn't allow for any type of business that provides
a place for people to consume cannabis, like a bar for alcohol. Similarly,
cannabis companies that braved CES 2018 skirted tricky conundrums
just to be there.

High expectations
Marijuana is often normalized and regularly celebrated in fashion, music,
movies and TV, yet it doesn't have the same kind of open acceptance in
the tech scene. Weed is still a serious legal risk, even for medical use.
Vapium, a company that specializes in medical vaporizers, also made a

quiet CES 2018 appearance. The company showcased its upcoming
Smart Flow system, a Wi-Fi and Bluetooth connected cartridge-based

vaporizer with USB-C that measures dosage, frequency, usage and

efficacy via app.

The Smart Flow system and Puffco Peak are both technically vaporizers,
similar outliers in the broad category of consumer tech. But the two
devices couldn't be any more different, and they're made for two very
different demographics.
The growing variety of "weed tech" products that range from portable
decarboxylation devices, stylish purses that mask the stench of
marijuana and oil infusers for cooking, highlight the obvious fact that the
cannabis consumer is not a monolith. With or without federal approval,
and whether or not the mainstream -- and CES -- cares to pay attention,
the cannabis industry is fearlessly growing up high-tech.

When technical advancements combine with legal cannabis, you get a smart
bong.
Cannabis company Puffco announced a new product on Monday that takes your
standard, everyday run-of-the-mill bong, and brings it right into 2018. The Puffco
Peak is a battery-operated desktop concentrate vape, but the best part is that it
incorporates water filtration — it's a smart bong, dude.

Dubbed the "first-ever smart rig for concentrate consumers," the Peak heats up in
just 20 seconds and operates completely wirelessly, making handoffs a breeze.
The rig has four pre-programmed heat settings, as well as a "boost mode" to clear
out any leftover concentrates so nothing goes to waste.
Dab rigs have been a huge trend in the cannabis world since Colorado voted to
legalize recreational cannabis in 2012. The concept is pretty simple, though it can
be a bit intimidating for a beginner. Instead of using cannabis flower, a dab rig
takes use of cannabis concentrates, which often come in wax form. The wax is
heated using a heated coil, instead of a flame, which delivers a cleaner and more
pure form of extracting THC.
It also gets you stoned out of your mind.
Dab rigs can be hooked up to most bongs with little modification, but they're big,
bulky, and require a power source. It basically looks like a science experiment.

But the Peak is small enough to hold in your hand, and you're not bound to an
outlet while using it.

One of the more impressive features on the Peak is the Intelligent Temperature
Calibration. According to a Puffco, the feature "allows the device to maintain a
consistent experience when sharing with friends. If the device was just used, it
pivots its heat setting to account for the change in temperature, and delivers an
adjusted heat cycle for the next person, guaranteeing quality flavor and vapor
each time."
Of course with anything battery-powered, you'll have to recharge it. Puffco says
the Peak charges to full power in just two hours, which is good for 30 or more
cycles. Heat cycles and battery level are indicated using and LED light band, and
changes for settings are indicated with haptic feedback.
The Puffco Peak will be available for preorder on Jan. 15. Info on pricing was not
immediately available.

This post is part of our High-tech High series, which explores weed innovations,
and our cultural relationship with cannabis, as legalization in several U.S. states,
Canada, and Uruguay moves the market further out of the shadows.
It's 2018, and marijuana vape pens are so common in California they may as well
be on the state flag. (They're certainly more widespread than bears. Sorry, bears.)
Pens are not the preserve of stoner stereotypes, either: Walk through the Financial
District of San Francisco on a sunny day after work, and at the outdoor tables of
wine bars and pubs alike, you'll easily spot dozens of those slim, telltale
cartridges being casually withdrawn from suit jackets and purses for a politely
discreet two-second sip.
In a few short years of legalization, vape pens have become the cocktails of
weed: pretty, classy, concentrated, available in many intriguing varieties, dinner-
party friendly; a nice little sippable pick-me-up, presuming you don't have too

much. It's fair to say I am familiar with (and respectful of) pens and cocktails in
equal measure.

Then at the other end of the spectrum, there's dabbing. Until last week, like a lot
of people, I would have described dabbing as the crack-smoking of weed; the
thing you do if you want to get seriously messed up, like downing a pitcher of a
particularly strong cocktail.
But I also would have had no idea what I was talking about. Because it turns out
dabbing is a lot closer to downing a double espresso than chugging martinis.
The rhyme and reason of rigs

From a chemistry-class perspective, dabbing and vaping are almost the same
thing. The pens heat liquid cannabis concentrate (added to various kinds of oil)
very fast to create vapor, whereas dabbing is simply about heating solid cannabis
concentrate very fast to create vapor. The solid version unadulterated by oil may
be a little healthier because you don’t add anything in the extraction process, but
dabbing has historically involved a cumbersome, daunting industrial setup.
Dabbers own "rigs" that look like they belong in the lair of an evil scientist. They
use blowtorches, albeit indirectly, and vape their solid concentrate on a "nail" or
an "e-nail." They spend hundreds of dollars on butane alone. I'd even heard of
dabbers placing concentrate between red hot kitchen knives. Getting high around
large hot pointy objects? Yeah, that's a big fat nope from me. Besides, why bother
if it's the same effect as a vape pen?
Then I interviewed Roger Volodarsky, the Los Angeles-based founder CEO of

Puffco, who assured me it was most definitely not the same effect. Volodarsky
created the Puffco Peak, a small push-button "smart rig" that "removes the stigma
and the learning curve from dabbing," he says (and makes you pay $380 for the
privilege — far cheaper than the average rig, still pricy for the average
consumer).
Price notwithstanding, the Peak has been getting rave reviews all year, including
the ultimate design distinction of being compared to an iPhone. But more than the
Steve Jobs of rig design, Volodarsky sees himself as a dabbing evangelist. He's
the Johnny Appleseed of solid concentrate. And he thinks people like me have
greatly misunderstood the effects and the benefits of dabbing.
'When I dab, I'm not

slowed down. I'm
more interested.'
"That's likely THC distillate in your vape pen," Volodarsky said dismissively
when I made the comparison. "That's one slim shade of cannabis, and not a
fraction of the experience of dabbing. When you're consuming concentrate,
you're leaving behind CBN, which is [a cannabinoid molecule] known for
making you sleepy and disassociated. When I dab, it's like having a coffee. I'm
not slowed down. I'm more interested." He described the effect as "zoning in."
Well, okay then. Who doesn't want to be more interested? Who couldn't use being
more focused and "zoned in"? Who has consumed cannabis (or cocktails, for that
matter) and not had the occasional unreliable experience where they wished the
result was less head-foggy, with more ability to hold down a conversation?
Maybe Volodarsky was on to something with this no CBN thing.
I found a few studies suggesting that "reclaim" — dark sticky stuff left over after
dabbing — was indeed unusually high in the CBN molecule. But that didn't seem
conclusive, so I ran Voldarsky's claim past my next interviewee, scientist Tristan

Watkins, who has a Ph.D in what cannabinoids do to the brain. He cautioned that
more study was needed — a perennial problem for what is still, unbelievably, a
schedule 1 drug at the Federal level.
But Watkins did add his own memorable anecdote to the pile. He recalled that
one time, he had set out to dab the CBN-heavy reclaim of a CBN-heavy strain.
He was so immediately ready for a snooze that "it was a struggle to go upstairs to
get to bed," he said.
If we have indeed isolated the must-sleep-now molecule in marijuana, that alone

could be a game-changer. Some $2 billion is spent every year on sleeping pills in
the U.S. alone; three quarters of that is spent on prescription drugs. CBN would
probably be a lot safer and more reliable than a hypnotic like Ambien, which can
apparently lead to crazy tweeting.
Meanwhile, the CBN-free, pot-as-coffee market could be just as big a deal. So

when Puffco sent me a Peak to review, I swallowed my reluctance and marched
into my nearest recreational dispensary.
Peak Experience
That's where I ran into the other problem that confronts dabbing newbies: the
confusing varieties of non-liquid concentrate. They too are cursed with names as
foreboding as rig and nail. There are the solid shards known as "shatter," which
look like something Walter White might cook up. Then there's "wax," which calls
to mind Madame Tussauds' and ears and ewwww.
On the advice of my budtender, I dropped $45 on something called Sweet and

Sour live resin sauce by a company called Raw Garden. Live resin is made by a
process that preserves the plant immediately after harvesting, flash freezing it so
it doesn't dry out and lose its terpenes in the traditional curing process.
Still, the cost seemed outrageous for what you get: a thumb-sized dollop of
yellowish goo, albeit fascinating yellowish goo studded with tiny reflective
crystal forms.
Raw Garden's marketing copy assured me I was getting "single-source, fresh-

frozen, whole-plant flowers" that had been "refined into a flavorful concentration
of terpenes and cannabinoids" via "advanced crystallization techniques." A QR
code on the container took me directly to an independent lab test of this batch,
certified free of all impurities.
All of which seemed appropriately uncompromising and futuristic for the Peak.
Like the stuff it vaporizes, the Peak is surprisingly small. It looks like a bong
from the 22nd century — a 7-inch-tall one that fits in the palm of your hand and
carries a Katniss-like quiver of Q-tips to keep it clean.

It may be simple and push-button so far as rigs go, but the Peak is not un-
intimidating for a beginner. There are a lot of confusing spare parts when you
unbox it, each in their miniature box, and I reflected on the fact that an
"atomizer" is just as intimidatingly named as a "nail."
The Peak, at least, is mercifully nail free; you merely place a tiny bit of
concentrate (somewhere between a grain of rice and a pea) inside a ceramic
chamber (to the right in the picture above, under the glass stopper). Then put a
tiny amount of water, a fluid ounce or so, in the main tube.
The main impediment is charging up the base, which took about 2 hours to fully
charge via USB the first time. But that was enough for dozens of cordless
sessions, each one initiated by a double tap on the device's only button. The Peak
hits its temperature mark in just 20 seconds. Each session is as compact as the
device and its contents, keeping the heat on for just 12 seconds. That's all you'll
need, trust me.
It's also essential to learn the color code of the Peak. A single tap of the button
cycles between blue, green, red, and white, which increases in temperature in that
order. On an early attempt to dab with my also-a-beginner wife, we mistakenly
set the Peak on white — assuming red was the highest setting, therefore white
must be the lowest.
I fizzed with ideas,

but more importantly
I was capable of
remembering them
The result? "It stole an afternoon and confined me to the couch with racing
thoughts," is how my wife describes it now. (Meanwhile, as if to prove how much
this stuff affects everyone differently, I acquired a sudden urge to clean the
house.)
But then there was the blue setting. Ah, the blue setting! Blue means the Peak is
vaporizing at a mere 450 degrees Fahrenheit, versus 600 degrees for white. At

that temperature you can really taste the complex flavors from terpenes coming
through in the vapor, chilled by filtration through the water. (Because it's just
vapor, there are none of the horrors of dirty bong water; the only part that needs
cleaning is the ceramic bowl.)
More importantly, I discovered, Volodarsky was right. After a single blue session,
I felt focused and utterly calm, like I'd just downed a large cappuccino. I fizzed
with ideas, but more importantly I was capable of remembering them for more
than a few seconds and writing them all down.
The traditional forgetfulness was gone, and conversation came easily —

something I confirmed by taking it to a dinner party where friends passed it
around and nattered happily on a wide range of topics. (Because the Peak
disassembles into two main pieces, the base and the glass tube, it's surprisingly
portable.)
And here's the result I didn't expect: Almost immediately, I lost all interest in
vape pens. My attitude had flipped 180 degrees. Pens seemed a pale imitation
now, foggy and flavorless. Why would anyone bother with them?

I was curious about whether this dislike extended to Puffco's more portable
device, the $80 Puffco Plus pen. Like the Peak, the Plus is a groundbreaking
product in its category; it's the first dabbing pen to have a built-in "dart." You use
it to secure the wax or resin, as in the image above, before screwing it in to the
ceramic chamber. (Other dabbing pens, and even the Peak itself, require you to
use a separate and fiddly metal tool to apply the concentrate.)
My verdict on the Plus? Meh. It's okay, I guess; better and slightly more clear-
headed than a regular vape pen. But you're inhaling through a rubber flange at the
top, which is kind of annoying, and it certainly doesn't give you the rich, chilled
flavor of the Peak. Plus the concentrate seemed to disappear a lot faster in the
Plus, which. I suspect I was also therefore inhaling a larger dose of CBN, as the
experience wasn't as clear-headed as the Peak.
After the peak experience of the Peak, in fact, it is possible that I am ruined for
other forms of cannabis consumption. All of them seem like going back to basic
box wine after you've tasted the rich complexity of a good pinot noir for the first
time.

Volodarsky says he'll still enjoy a joint every now and then, usually at the end of
the day when he actually welcomes those foggy, sleepy CBN effects. Personally,
I'd be happy to remain smokeless, but I wouldn't say no to a strong CBN-rich
concentrate for the nights when I need to combat insomnia.
Just don't give it to me in vape pen form.

In 2018 A.I. robots can walk, self-driving cars are basically here, and now wireless bongs are
ushering in a new technological age for stoners. The cannabis company Puffco introduced
the future of getting blazed with its battery-operated bong the Puffco Peak. If the "first-ever
smart rig" sounds too cushy for your kush, fear not: the Peak will still get you totally high
bro, using concentrated cannabis and water filtration.

The battery-operated bong is designated for concentrate users, meaning this smart bong is
for dabs (nope not this dab). Unlike the cannabis flower, dabs are more concentrated doses

of THC that often come in wax form. As weed continues to be legalized in states across the
country, dabbing has become a more popular, since it is often considered a cleaner, faster,
and more pure way to get high, according to Mashable.
Dabbing generally requires rigs that incorporate a power cord and heating rings or a butane
blowtorch. Aka, users often turn their marijuana consumption into a chemistry project, and
intimidated, less habitual weed smokers typically stick to classic bongs. The Peak changes
that by giving smokers a wireless way to consume concentrated cannabis with four different
heat settings and the click of a button. According to Engadget, each charge provides about
25 to 30 hits, which is more than enough to guarantee you and your buddies will get high as
hell.
The Peak will be available for preorder on Puffco’s site Jan. 15, shipping out in early
February. These smart bongs are expected to sell for $350 each.

What is an E-Nail?

An Electronic Nail (or E-Nail) is an accessory which attaches to a bong or water pipe to facilitate
vaporizing concentrates such as dabs or waxes. Portable E-Nail rigs are also available, incorporating
