NOTICE OF SUMMARY SUSPENSION

Ms. Junge,

This letter provides you with Notice of Summary Suspension of your daycare license for Mickey & Minnie’s
Playhouse, 345 E 2 nd N, Mountain Home, Idaho 83647, effective September 12, 2019. The Department of
Health and Welfare is exercising its right to summarily suspend your daycare license pursuant to Idaho Code 39-
1113 based upon violations of the following section of Idaho Code.

IDAHO CODE 39-1113. DENIAL, SUSPENSION OR REVOCATION OF LICENSE.


(1) A daycare facility license may be denied, suspended or revoked by the department if the department finds that
the daycare facility is not in compliance with the standards provided for in this chapter or criminal activity
that threatens the health or safety of a child.

IDAPA 16.06.02.111. ENFORCEMENT REMEDY OF SUMMARY SUSPENSION AND TRANSFER OF


RESIDENTS OR CHILDREN. The Department may summarily suspend a daycare center, group daycare facility,
family daycare home voluntarily licensed by the Department, foster home, children’s agency, children’s
therapeutic outdoor program, children’s camp, or a children’s residential care facility license and require the
program to transfer residents or children when the Department has determined a resident’s or child’s health and
safety are in immediate jeopardy. Children in a daycare center, group daycare facility, or family daycare home
voluntarily licensed by the Department, will not be transported from the facility, instead the parent or legal
guardian will be contacted.

The Department is taking the above action based upon the following:

• On September 12, 2019, the Department was notified that Eric Eugene Junge, staff for Mickey & Minnie’s
Playhouse, 345 E 2nd N, Mountain Home, Idaho 83647, was arrested on September 11, 2019, by Mountain
Home Police Department for the felony criminal charge of Lewd Conduct with Child Under 16 (MHPD
Report #19-001595). The alleged criminal activity threatening the health or safety of a child appears to have
occurred while the child was attending or on the premises of Mickey & Minnie’s Playhouse.
IDAPA 16.06.02.390. CONTINUED COMPLIANCE, REPORTING CHANGES, AND CRITICAL
INCIDENTS.
Each daycare owner or operator must remain in compliance at all times with fire, safety, and health requirements
as required in this chapter of rules.
03. Critical Incidents. A daycare operator must report any of the following to the Department within
twenty-four (24) hours:
b. Any arrests, citations, withheld judgments, or criminal convictions of disqualifying crimes associated with
Section 39-1113, Idaho Code, of an operator or any other individual regularly on the premises of the facility and
provide documentation that the individual is not working with children or is not on the premises.

• Jane Junge, owner of Micky & Minnie’s Playhouse, 345 E 2nd N, Mountain Home, Idaho 83647, had not
reported to the Department the arrest of Eric Eugene Junge or provided documentation that the individual is
not working with children or not on the premises, prior to the issuance of this Notice of Summary Suspension.

The above information indicates conditions existed that endangered the health or safety of a child due to non-
compliance as defined in Idaho Code 39-1113 and IDAPA 16.06.02.300. STANDARDS FOR DAYCARE.

You may appeal this decision by filing a written request for hearing on this matter with the Hearings Coordinator,
Department of Health and Welfare, Administrative Procedures Section, 450 West State Street, 10 th Floor, PO Box
83720, Boise, Idaho 83720-0036. Appeals must be filed in writing within twenty-eight (28) days from the date
of this notice. The appeal must state your name, address and phone number, and the reason(s) why you are
appealing. An appeal is filed when it is received by the Department or postmarked within the 28-day timeframe.
IDAPA 16.06.02.003; 16.05.03.101. Upon receipt of your notice of appeal, the Department will set the matter for
a hearing at which you must appear. The hearing is your opportunity to demonstrate why the Department should
not summarily suspend your daycare license.

Either party may request review of the hearing officer’s decision and order to the Department Director for a Final
Order. IDAPA 16.05.03.150, .152. Appeal of the Final Order may be made to the district court of the county
where the affected daycare facility is and shall be heard de novo by the district court. Idaho Code § 39-1113(6).
Such appeal must be filed within twenty-eight (28) days of the issuance of the Final Order. Idaho Code § 67-
5273(2).

Subject to meeting all requirements under Title 39, Chapter 11, Idaho Code, and the rules and minimum standards
in IDAPA16.06.02 Standards for Child Care Licensing, the Department will determine the type of daycare license
required by an owner or operator providing daycare by counting each child in attendance, regardless of
relationship to the person or persons providing the care. Please be advised, it shall be a misdemeanor to operate a
daycare facility without first obtaining a daycare license from the department. If there is reason to suspect a
facility is operating without a daycare license, all related information will be forwarded to law enforcement.
