MOTION To REINSTATE

The Honorable, Andrew Adams, by counsel James H. Voyles and Jennifer M. Lukemeyer,

respectfully moves this Court to reinstate him as a judicial officer in Clark Circuit Court 1. In

support thereof, the Honorable Andrew Adams avers the following:

1. Judge Adams was charged criminally on June 28, 2019 under 49G1 8—1906-F6—025482 with

two counts of Battery Resulting in Moderate Bodily Injury, as Level 6 Felonies; two counts

of Battery Resulting in Bodily Injury, as Class A Misdemeanors; two counts of Battery, as

Class B Misdemeanors; and one count of Disorderly Conduct, as a Class B Misdemeanor.

On June 28, 2019, the Indiana Commission on Judicial Qualifications (hereinafter the

“Commission”) moved for this Court to suspend Judge Adams pursuant to Admission and

Discipline Rule 25 V.(A) because he faced felony charges.

This Court granted the Commission’s request on the same day.

On September 9, 2019, Judge Adams plead guilty to one count of Battery Resuldng in Bodily

Injury as a Class A Misdemeanor pursuant to a plea agreement. A11 other charges were

dismissed as part of the plea agreement.

On September 9, 2019, Judge Adams was sentenced to a fully suspended sentence With a

$100 fine and court costs assessed. No probation was ordered, nor were any other

 conditions placed on Judge Adams as part of his sentence. Attached hereto and marked as

Exhibit A is the sentencing order.

6. The sole reason for the Comrnission’s request for Judge Adams’ suspension was the pending

felony that no longer exists.

7. Since his suspension from the bench, a senior judge has been presiding over Clark County

Circuit Court 1. It is counsels understanding, the appointed judge, the Hon. Steven Fleece

desires to vacate the bench and resume his senior judge status.

8. Judge Adams faces possible additional sanctions by this Court and should that sanction be

further suspension, he feels obligated to prepare the Clark County Circuit Court 1 for

another absence.

9. Judge Adams’ reinstatement to the bench is in the best interest of the Clark County judicial

system.

WHEREFORE, the Honorable Andrew Adams prays this Court will terminate the suspension it

ordered on June 28, 2019 and reinstate him as a judicial officer of Clark County Circuit Court 1 and

for all other relief just and proper.
